HomeMy WebLinkAbout1986-1660 - Ordinance - 06/26/1986ORDINANCE NO. 1660 AN ORDINANCE AMENDING CHAPTER 1 OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY ADDING A SECTION MAKING IT AN OFFENSE TO FAIL TO RETURN LIBRARY MATERIALS TO THE COLLEGE STA- TION BRANCH LIBRARY, REPEALING ALL ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITHw PROVIDING A SAVINGS CLAUSE, PROVID- ING FOR A PENALTY, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of College Station is in the process of creating a library inside the city limits which will be operated and maintained by the City of Bryan; WHEREAS, the City of College Station needs to prepare for the opening of the library including the preservation of library books and materials; WHEREAS, it is necessary to impose fines for the late return of books and materials; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY COLLEGE STATION: That Chapter 1 of the Code of Ordinances of the City of College Station is hereby amended by adding a new section, which shall be numbered Section 25, which said section shall read as follows: "SECTION 25: FAILURE TO RETURN LIBRARY MATERIALS A person commits an offense if he intentionally or knowingly fails to return library materials to the College Station Branch Library which were loaned to the actor or borrowed in the actor's name. B. The actor's intent and knowledge shall be presumed if: 1. Pursuant to agreement, the library materials were to be returned on a specified date; Actual notice is given or notice in writing is sent by depositing same in the United States mail stating that the library materials were not returned on the date spec- ified. Said notice when mailed to be sent to the address shown on the records of library; and 3. The library material is not returned to the owner within twenty (20) davs of receipt of such notice, If notice is sent by mail, in accordance with subsection (b)(2) of this section, it is presumed that the notice was received no later than five (5) days after it was sent. II. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. III. Should anv section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. IV. That this ordinance shall take effect from and after its passage and in accordance with the Charter of the City of College Sta- tion, Texas. PASSED AND APPROVED THIS THE 26th DAY OF JUNE, 1986.
