AN ORDINANCE REZONING 5 TRACTS OF LAND TOTALLING 13.417 ACRES LY-
ING AND BEING SITUATED IN THE RICHARD CARTER LEAGUE, A-8, COLLEGE
STATION, BRAZOS COUNTY, TEXAS AND BEING MORE PARTICULARLY DE-
SCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM
A-P ADMINISTRATIVE-PROFESSIONAL, R-3 TOWNHOUSE-ROWHOUSE AND R-1
SINGLE FAMILY RESIDENTIAL TO C-1 GENERAL COMMERCIAL, A-P ADMINIS-
TRATIVE-PROFESSIONAL, R-4 LOW DENSITY APARTMENTS AND R-lA SINGLE
FAMILY RESIDENTIAL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STA-
TION, TEXAS:
WHEREAS, the City Council held a public hearing In the City Hall
at 7:00 P.M. on January 9, 1986 on the question of rezoning cer-
taln areas within the city limits; and
WHEREAS, the City Council has determined the following:
To rezone or change the classification of the following five (5)
tracts of land lying and being situated in the Richard Carter
Survey, A-8, College Station, Brazos County, Texas and being more
fully described by metes and bounds as follows:
TRACT NO. 1
Being all that certain tract or parcel of land lying and being
situated in the RICHARD CARTER LEAGUE, A-8, Coilege Station,
Brazos County, Texas, and being part of that 8.876 acre tract
conveyed to J.V. Henton by Delmo Jasper, et-al, by deed recorded
in Volume 452, Page 164 of the Deed Records of Brazos County,
Texas, and being more particularly described as follows:
BEGINNING: at the north corner of said 8.876 acre tract, said
corner being in the south right-of-way line of University Drive;
THENCE: S 14°51'13" E 225.58 feet and S 45'28'00" E - 330.08
feet to a point for corner;
THENCE: S 44"32'00" W - 240.80 feet to a point for corner;
THENCE: N 45"28'00" W - 712.71 feet to a point for corner in
said University Drive line;
THENCE: N 72"27'00" E - 402.60 feet along said University Drive
line to the PLACE OF BEGINNING; and conta~ning 3.923 acres of
land, more or less, from R-3 Townhouse-Rowhouse and R-1 Single
Family Resident~al to C-1 General Commercial.
TRACT NO. 2
Being all that 4.00 acre tract or parcel of land, lying and being
situated in the RICHARD CARTER LEAGUE, A-8, College Station,
Brazos County, Texas, and being a part of that 13.54 acre tract
conveyed to the trustees for the College Heights Assembly of God
Church by Roy V. Simmons, trustee, recorded in Volume 188, Page
738 of the Deed of Trust Records of Brazos County, Texas, said
4.00 acre tract being more particularly described as follows:
BEGINNING: at an Iron rod in the southeast right-of-way line of
University Drlve same being the common corner of Tract No. 3 and
Tract No. 4 of the Putz Partition, D. R. 287/743;
THENCE: N 63"13'00" E - 94.4 feet and N 72"27'00" E - 155.60
feet along said southeast right-of-way line to an iron rod for
corner;
THENCE: S 45"28'00" E - 712.71 feet within Tract No. 4, to a
point for corner;
THENCE: S 44°32'00" W - 226.80 feet to a point for corner in the
common line of Tract No. 3 and Tract No. 4;
THENCE: N 45"28'00" W - 816.41 feet along said common line to
Tract No. 3 and Tract No. 4 to the POINT OF BEGINNING; and con-
raining 4.00 acres of land, more or less, from A-P Administra-
tive-Professional to C-1 General Commercial.
TRACT NO. 3
Being all that certain tract or parcel of land, lying and being
situated in the RICHARD CARTER LEAGUE, A-8, College Station,
Brazos County, Texas, and being part of that 8.876 acre tract
conveyed to J. V. Henton, by Delmo Jasper, et al, by deed re-
corded in Volume 452, Page 164 of the Deed Records of Brazos
County, Texas, and being more particularly described as follows:
COMMENCING: at the north corner of said 8.876 acre tract, said
corner being in south right-of-way line of University Drive;
THENCE: S 14°51'13" E - 225.58 feet and S 45"28'00" E - 330.08
feet to the POINT OF BEGINNING;
THENCE: S 45"28'00" E - 191.89 feet to a point for corner;
THENCE: S 44°32'00'' W - 240.80 feet to a point for corner;
THENCE: N 45°28'00'' W - 191.89 feet to a point for corner;

THENCE: N 44°32'00'' E - 240.80 feet to the POINT OF BEGINNING;
and containing 1.061 acres of land, more or less, from R-1 Single
Family Residential and R-3 Townhouse-Rowhouse to A-P Administra-
tive-Professional.
TRACT NO. 4
Subject to the change in conditions, development of the property
shall not be made until a fence ~s placed between Tract No. 4 and
Tract No. 5 here~n described;
Being all that certain tract or parcel of land, lying and being
s~tuated in the RICHARD CARTER LEAGUE, A-8, College Station,
Brazos County, Texas, and being part of that 8.876 acre tract
conveyed to J. V. Henton by Delmo Jasper, et al, by deed recorded
in Volume 452, page 164 of the Deed Records of Brazos County,
Texas, and being more particularly described as follows:
COMMENCING: at the north corner of said 8.876 acre tract, sa~d
corner being in the south right-of-way llne of University Drive;
THENCE: S 14"51'13" E 225.58 feet and S 45°28'00'' E - 521.97
feet to the PLACE OF BEGINNING;
THENCE: S 45"28'00" E 161.69 feet to a poznt for corner;
THENCE: S 44"32'00" W - 467.00 feet to a point for corner;
THENCE: N 45"28'00" W - 161.69 feet to a point for corner;
THENCE: N 44°32'00" E - 467.60 feet to the PLACE OF BEGINNING;
and containing 1.736 acres of land, more or less, from R-1 Single
Family Residential to R-4 Apartments Low Density.
TRACT NO. 5
Being all that certain tract or parcel of land, lying and being
situated in the RICHARD CARTER LEAGUE, A-8, College Station, Tex-
as, and being part of that 8.876 acre tract conveyed to J. V.
Henton by Delmo Jasper, et al, by deed recorded In Volume 452,
page 164 of the Deed Records of Brazos County, Texas, and being
more particularly described as follows:
COMMENCING: at the north corner of said 8.876 acre tract, sa~d
corner being in the south right-of-way line of University Drive;
THENCE: S 14'51'13" E - 225.58 feet and S 45'28'00" E - 683.66
feet to the PLACE OF BEGINNING;
THENCE: S 45"28'00" E - 159.16 feet to a point for a corner,
said corner located on proposed right-of-way line of Lincoln
Street;
THENCE: S 45"12'51" S - 106.10 feet and S 44"32'00" W - 361.51
feet along said proposed right-of-way line to a point for a cor-
ner;
THENCE: N 45"28'00" W - 157.90 feet to a polnt for a corner;
THENCE: N 44"32'00" E - 467.60 feet to the PLACE OF BEGINNING;
and containing 1.697 acres of land, more or less, from R-1Slngle
Family Residential to R-lA S~ngle Family Res~dential.
And, it is ordained that
