RESOLUTION DETERMINING NEED
RESOLUTION NO. 10-22-98-9.3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS, DETERMINING A PUBLIC NECESSITY TO ACQUIRE
CERTAIN PROPERTY; GIVING NOTICE OF AN OFFICIAL
DETERMINATION TO ACQUIRE PROPERTY FOR THE NORTHGATE
PUBLIC PARKING GARAGE PROJECT; AND ESTABLISHING
PROCEDURES FOR THE ACQUISITION OF PROPERTY.
WHEREAS, it is necessary to establish procedures for determining the
establishment and approval of just compensation for each of the parcels to be
acquired for the Northgate Public Parking Garage Project; and
WHEREAS, there may be improvements located on some of the real property
acquired for this project and such improvements may be required to be moved or
demolished prior to the beginning of the project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF COLLEGE STATION, TEXAS:
PART 1:
That the City Council of the City of College Station, Texas, hereby
officially determines that there is a public necessity for off-street
parking in the Northgate area, and the public welfare and
convenience will be served by the acquisition of the real property
described as part of Lot 18, Block 5, of the W.C. Boyett Estate
Partition, College Station, Brazos County, Texas, more particularly
described by metes and bounds as follows:
All that certain tract or parcel of land lying and being situated in the
J.E. Scott League in College Station, Brazos County, Texas, being
part of Lot 18 in Block 5 of the W.C. Boyett Estate Partition addition
to the City of College Station, Texas, according to plat of record in
Volume 100, Page 440, of the Deed Records of Brazos County,
Texas, being all of that "Second Tract" conveyed to James Mullen
and Raymond D. St. Peter by deed recorded in Volume 386, Page
127, of the Deed Records of Brazos County, Texas, and being more
particularly described as follows:
Begimfing at a ½" iron rod set at the common corner of Lot 21 in
Block 6-7 and Lot 18 in Block 5 in the southwest line of Main Street
from which a %' iron rod was found N 56° 21 ' E 0.3';
Thence S 41° 45' 21" W - 135.00 feet along the line between Lot 21
in Block 6-7 and Lot 18 in Block 5 to a ½' iron rod set at the

common corner of Lots 20 and 21 in Block 6-7 and Lots 14 and 18
in Block 5 from which a V2 iron rod was found S 41° 45' W - 0.2';
Thence N 46° 08' 17" W - t2.01 feet along the line between Lots 14
and 18 to a '/2" iron rod set at the most westerly corner of the said
Mullen and St. Peter tract;
Thence N 41° 45' 21" E - 135.40 feet along the northwest line of the
said Mullen and St. Peter tract to a V2" iron rod set in the southwest
line of Main Street at the most northerly comer of said tract, from
which a V2" iron rod was found N 47° 08' E - 0.8';
Thence S 44° 13' 39" E 12.03 feet along the southwest line ot'
Main Street to the Point of Beginning and containing 1622 square
feet of land more or less;
and it is the City of College Station's intention to acquire said real
property as part of the Northgate Public Parking Garage Project in
the City of College Station, Texas, for the purpose of constructing a
public parking facility.
That the City Manager is hereby authorized to contract, on behalf of
the City of College Station, with a professional appraiser lbr the
appraisal services, with a professional real estate agent to act as a
land agent for the City and with attorneys for preparation of title
opinions needed by the City from time to time in connection wilh
acquisition of the property for the Northgate Public Parking Garage
Project.
That the City's Land Agent or other staff appraiser is hereby
authorized and directed to examine the independent appraisal reports
as they are submitted to said city to determine whether said appraisal
reports are supported by sufficient data. Based upon such
examination of said appraisal reports, the Land Agent or other
appraiser shall make a recommendation to the City Manager as to the
establishment and approval of the amount of the just compensation
for said parcel.
After consideration of said recommendation, the City Manager shall
establish and approve the amount determined for acquisition of the
parcels.
Upon establishment and approval by the City Manager of the amount
of just compensation for the acquisition, the City's Land Agent is
authorized to communicate a written offer to the owners of said

parcels lbr the acquisition of said parcels at the full mnount
determined and established to be just compensation therdbre and to
negotiatc with said owners on behalf of the City.
That the Mayor alter approval by City Council is hereby authorized
to cxecute all documents necessary to acquire each of the parcels
needed for said project, on behalf of the C~ty of College Station.
That the City Manager be and is hereby authorized to sell such
surplus improvements, or order the demolition thereof, if any,
located on the real property acquired in connection with this project.
That this resolution shall take effect immediately from and after its
passage.
