HomeMy WebLinkAbout3-9-2000-13.10 - Resolution - 03/09/2000RESOLUTION NO. 3-9-2000-]_3. ]_0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, APPROVING AMENDMENT NO. 1 TO THE URBAN STREET PROGRAM AGREEMENT BETWEEN THE CITY OF COLLEGE STATION AND THE STATE OF TEXAS, ACTING BY AND THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION. WHEREAS, the Staff of the City of College Station, Texas, has negotiated an amendment to the Urban Street Program Agreement between the City of College Station and the State of Texas, acting by and through the Texas Department of Transportation; and, WHEREAS, the State of Texas, acting by and through the Texas Department of Transportation, and the City of College Station both agree that the George Bush Drive East Widening Project (Project No. ST-9804) should be replaced by the Tarrow Street South Rehabilitation Project (Project No. ST-0002); and, WHEREAS, the Bryan-College Station Metropolitan Planning Organization Policy Committee has approved the use of College Station's portion of Urban Street Program funds originally allocated for George Bush Drive East, to now be used for improvements to Tarrow Street from University Drive to Lincoln Avenue (Resolution 2000-07), now, therefore, BE IT RESOLVED by the City Council of the City of College Station, Texas: PART 1: That the City Council hereby approves Amendment No. 1 to the Urban Street Program Agreement between the City of College Station and the State of Texas, acting by and through theTexas Department of Transportation. WITNESSETH WHEREAS, on the 26th day of January, 1999, an agreement ("AGREEMENT") was made between the State and the City for the reconstruction of Kyle Street, hereinafter referred to as the "Project", and WHEREAS, the agreement provided for certain covenants, provisions, and responsibilities of the State and the City; and WHEREAS, the City has requested an alternate project, previously agreed upon by the State and the City; and WHEREAS, the State and the City both agree that the Project should be replaced by the alternate project as described herein; and NOW THEREFORE, the State and the City, in consideration of the mutual covenants and agreements herein contained, the Agreement is amended as follows: 1. Amendment to the recital, the third '~Nhere as" provision is replaced with the following: WHEREAS, the State and the City desire improvements to an Urban Street Program project, specifically for the reconstruction of Tarrow Street between Lincoln Street and University Street, hereinafter called the "Project"; and 2. Amendment to Article V, Project Funding, Section A is replaced with the following: A. Project Costs The total estimated cost for construction of the Project is $464,344.00. ALL OTHER TERMS AND CONDITIONS OF THE AGREEMENT FOR THE URBAN STREET PROGRAM PROJECT NOT AMENDED HEREIN, SHALL REMAIN IN FULL FORCE AND EFFECT. URBAN STREET PROGRAM AGREEMENT AMENDMENT NO. I 1 of 2 IN WITNESS HEREOF, the parties hereto have caused this Amendment No. 1 to the Agreement to be executed, but this Amendment shall not be valid until it is signed, in full recognition, by a duly authorized representative of each party.
