HomeMy WebLinkAbout3-13-2003-11.05 - Resolution - 03/13/2003RESOLUTION NO. 3-13-2003-11.05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, APPROVING AN OFFICIAL POLICY REGARDING THE EXTENSION OF WATER AND SEWER UTILITY SERVICES TO PROPERTIES WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF COLLEGE STATION, TEXAS. WHEREAS, The City Council of the City of College Station strives through its Vi.rion Statements to provide high quality customer focused basic city services at a reasonable cost, including effective water and wastewater services; and WHEREAS, The City Council of the City of College Starion adopted its current Comprehensive Plan in 1997, that includes Section 2.09 Utility Goal.r and Objectives; and WHEREAS, The City Council of the City of College Starion adopted, as part of the Compxehensive Plan, Utility Goal # 9 that states "College Station should continue to pYOVide the quantity and quality of utilities needed to assure public health, safety, and accommodation of growth"; and WHEREAS, The City Council of the City of College Starion adopted, as paxt of the Comprehensive Plan, Utility Objective 2.1 that states "Water service should be extended to undeveloped areas outside the city limits only as a condition of annexation"; and WHEREAS, The City Council of the City of College Starion adopted, as part of the Comprehensive Plan, Utility Objective 3.1. that states "Sewer service should be extended to undeveloped axeas outside the city limits only as a condition of annexation"; and WHEREAS, The City Council of the City of College Station views the extension of services outside the city limits as a disincenrive for annexation, thus making this growth strategy difficult to implement; and WHEREAS, The City Council of the City of College Station views the extension of services outside the city limits as resulting in utility provision to low density rural ETJ areas being subsidized by urban areas within the city limits; and WHEREAS, Overall, the City Council of the City of College Station does not deem it in the best interest of the citizens of College Station and the comxnunity to extend services outside it's city limits under ordinary circumstances; now, therefoxe, BE IT RESOLVED BY THE CIT'Y COUNCIL OF THE CIT'Y OF COLLEGE STATION, TEXAS: PART 1: That the City Council hereby appxoves this resolution stating that water and sewer utility services will not, as a matter of policy, be pxovided to properties within the extraterritorial jurisdiction without a petition for annexation from said properties meeting the legal requirements of such petitions. PART 2: That the City Council hereby agtees that it may grant exceprions as it deems necessary to the best interests of the City of College Station in the following cases: • for other governmental agencies through an inter-local agxeement, • for the purpose of economic development; or • for health and safety reasons PART 3: That this resolution shall take effect iminediately fxom and after its passage.
