A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, AUTHORIZING THE MAYOR TO SIGN A STANDARD UTILITY
AGREEMENT, UTILITY JOINT USE AGREEMENT, STATEMENT COVERING
CONTRACT WORK AND AFFIDAVIT, AS REQUIRED TO OBTAIN STATE
REIMBURSEMENT FOR RELOCATION COSTS FOR CITY OF COLLEGE
STATION UTILITY FACILITIES LOCATED ALONG FM 158 IN BRAZOS
COUNTY, TEXAS FROM FM 1179 AND SH 30.
WHEREAS, the State of Texas, acting by and through the Texas Department of
Transportation (hereinafter referred to as "TxDOT "), proposes to make certain highway
improvements generally described as the widening of FM 158 in Brazos County, Texas,
from FM 60 to SH 30; and
WHEREAS, the City of College Station retains a utility easement over property that falls
within the proposed highway right -of -way, the purpose of such easements being the
location of utility facilities; and
WHEREAS, the proposed highway improvements will necessitate the relocation of said
utility facilities; and
WHEREAS, TxDOT, pursuant to TEXAS ADMINISTRATIVE CODE, Title 43,
Chapter 21, Subchapter B, may reimburse to the City of College Station the cost for
relocation of utility facilities on a state highway system in accordance with a written
agreement between the State and the City;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
That the Mayor is authorized to sign a Standard Utility Agreement, Utility Joint use
Agreement, Statement Covering Contract Work and Affidavit, as required to obtain state
reimbursement for the relocation costs for utility facilities located along FM 158 in
Brazos County, Texas from FM 60 and SH 30.
ADOPTED this 11 day of April, A.D. 2002.
