Home My WebLink About3-14-2002-11.12 - Resolution - 03/14/2002 RESOLUTION DETERMINING NEED RESOLUTION NO. 3 -14- 2002 -11.12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, AMENDING RESOLUTION NO. 02 -08 -01 -9.10 DETERMINING A PUBLIC NECESSITY TO ACQUIRE A RIGHT -OF -WAY IN CERTAIN PROPERTY BY DETERMINING THAT THERE IS A PUBLIC NECESSITY TO ACQUIRE TEMPORARY CONSTRUCTION EASEMENTS IN CERTAIN PROPERTY IN ADDITION TO THE RIGHT - OF -WAY TO BE ACQUIRED; GIVING NOTICE OF AN OFFICIAL DETERMINATION TO ACQUIRE TEMPORARY CONSTRUCTION EASEMENTS FOR THE LONGMIRE EXTENSION PROJECT; AND ESTABLISHING PROCEDURES FOR THE ACQUISITION OF TEMPORARY CONSTRUCTION EASEMENTS. WHEREAS, on February 8, 2001 the City Council of the City of College Station, Texas, determined the need to acquire right -of -way in certain property for the Longmire Extension Project and authorized the acquisition of said property; and WHEREAS, it has been determined that it is necessary to acquire temporary construction easements in property in addition to the right -of -way acquisition for the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF COLLEGE STATION, TEXAS: PART 1: That the City Council of the City of College Station, Texas, hereby officially amends Resolution No. 02 -08 -01 -9.10 by determining that there is a public necessity to obtain temporary construction easements for the Project, and the public welfare and convenience will be served by the acquisition of temporary construction easements in the properties referenced in EXHIBIT "A" attached hereto and made a part hereof for all purposes. PART 2: That all of the terms, conditions, determinations and authorizations in the Resolution No. 02 -08 -01 -9.10 shall remain in full force and effect except that the Resolution shall be amended to include temporary construction easements in addition to the right -of -way for the project. PART 3: That this resolution shall take effect immediately from and after its passage. ADOPTED this 14th day of March, A.D. 2002.
