HomeMy WebLinkAbout6-24-2004-11.10 - Resolution - 06/24/2004RESOLUTION NO. 6-24-2004-11.10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, AUTHORIZING THE MAYOR TO SIGN A STANDARD UTILITY AGREEMENT, UTILITY JOINT USE AGREEMENT, STATEMENT COVERING CONTRACT WORK AND AFFIDAVIT OF PROPERTY INTEREST AS REQUIRED TO OBTAIN STATE REIMBURSEMENT FOR THE UTILITY RELOCATION COST TO FACILITATE THE CONSTRUCT[ON OF THE TEXAS AVENUE WIDENING PROJECT WHEREAS, the State of Texas, acting by and through the Texas Department of Transportation (hereinafter reft'red to as "TxDOT"), proposes to make certaw highway improvements generally described as the utility relocation cost to facthtal~ thc construction of the Texas Avenue Widening Project; and WHEREAS, the C~ty of College Station retains a utility easement over property that falls within the proposed highway nght-of-way, the purpose of such easement being the location of utility facthties; and WHEREAS, the proposed highway improvements will neccssttate the relocation of satd utilihes; and WHEREAS, TxDOT, pursuant to TEXAS ADMINISTRATIVE CODE, Title 43, Chapter 21, Subehapter B, may reimburse to the City of College Station the cost for relocation of utility fac[hr[es on a state lughway syslem in accordance with a written agreement belween the State and the Cily, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS- That the Mayor is authonzed to sign a Standard Utility Agreement, Utility Joint Use Agreement, Statement Coverulg Contract Work, and Affidavit of Property Interest, as required to obtain siate reunbursemont for the utility relocation cost to facilitate the construction of the Texas Avenue Widening Project ADOPTED this 24th day of June , A D 2004.
