HomeMy WebLinkAbout05-24-01-12.08 - Resolution - 05/24/2001RESOLUTION DETERMINING NEED RESOLUTION NO. 05-24-01-12.08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, DETERMINING A PUBLIC NECESSITY TO ACQUIRE FEE SIMPLE INTEREST IN CERTAIN PROPERTY; GIVING NOTICE OF AN OFFICIAL DETERMINATION TO ACQUIRE FEE SIMPLE INTEREST IN PROPERTY FOR THREE SEPARATE ELECTRIC SUBSTATION PROJECTS, BEING THE NORTHGATE SUBSTATION, THE WEST LUTHER STREET SUBSTATION AND THE SHENANDOAH SUBSTATION, AND FOR ALL OTHER UTILITIES, HEREIN REFERED TO AS "ELECTRIC SUBSTATION PROJECTS", TO SERVICE THE CITIZENS AND THE CUSTOMERS OF THE CITY OF COLLEGE STATION; AND ESTABLISHING PROCEDURES FOR THE ACQUISITION OF FEE SIMPLE INTEREST IN THE PROPERTY. WHEREAS, it is necessary to establish procedures for determining the establishment and approval of just compensation for each of the parcels in which to acquire FEE SIMPLE interest for the ELECTRIC SUBSTATION PROJECTS and WHEREAS, there may be improvements located on some of the real property in which FEE SIMPLE interest is acquired for this ELECTRIC SUBSTATION PROJECTS, and such improvements may be required to be moved or demolished prior to the beginning of the Project; NOW THEREFORE BE IT RESOLVED by the City Council of the City of College Station, Texas: PART 1: That the City Council of the City of College Station, Texas, hereby officially determines that there is a public necessity for the ELECTRIC SUBSTATION PROJECTS, and the public welfare and convenience will be served by the acquisition of FEE SIMPLE interest in properties referenced in Numbers 1, 2 and 3 in Exhibit "A" attached hereto and made a part hereof for all purposes as part of the ELECTRIC SUBSTATION PROJECTS, for the purpose of expanding the city's electric production, transmission and distribution and to expand the production, transmission and distribution of all other utilities in order to meet present and future system demands and for present and future demands for all other utility services for the citizens and customers of College Station. PART 2: That the City Manager is hereby authorized to contract, on behalf of the City of College Station, with a professional appraiser for the appraisal services, with a professional real estate agent to act as a land agent for the City and with attorneys for preparation of title opinions needed by the City from time to time in connection with acquisition of a FEE SIMPLE interest in property for the ELECTRIC SUBSTATION PROJECTS. PART 3: That the City's Land Agent or other staff appraiser is hereby authorized and directed to examine the independent appraisal reports as they are submitted to the City to determine whether said appraisal reports are supported by sufficient data. Based upon such examination of said appraisal reports, the Land Agent or other appraiser shall make a recommendation to the City Manager as to the establishment and approval of the amount of the just compensation for a FEE SIMPLE interest in said parcels. PART 4: PART 5: PART 6: PART 7: PART 8: After consideration of said recommendation, the City Manager shall establish and approve the amount determined for acquisition of a FEE SIMPLE interest in the parcels. Upon establishment and approval by the City Manager of the amount of just compensation for the acquisition of a FEE SIMPLE fee simple interest, the City's Land Agent is authorized to communicate a written offer to the owners of said parcels for the acquisition of a FEE SIMPLE interest in said parcels at the full amount determined and established to be just compensation therefore and to negotiate with said owners on behalf of the City. That the Mayor after approval by City Council or, if the purchase price is less than $50,000.00, the City Manager is hereby authorized to execute all documents necessary to acquire a FEE SIMPLE interest in each of the parcels needed for said ELECTRIC SUBSTATION PROJECTS, on behalf of the City of College Station. That the City Manager be and is hereby authorized to sell any such surplus improvements, or order the demolition thereof, if any, located on the real property acquired in connection with this Project. That this resolution shall take effect immediately from and after its passage. ADOPTED this 24ch day of Say , A.D. 2001. Said tract to be more particularly described with field notes and a plat prepared by a Registered Professional Land Surveyor. Property Needed for the West Luther Street Substation: Being all of that certain 6.20 acre tract or parcel of land, more or less, lying and being situated in the Crawford Burnett League, Abstract No. 7 in College Station, Brazos County, Texas. Said tract being all of that 6.21 acre tract conveyed to Ervin M. Williams, Sr. and wife, Mildred Williams by Deed recorded in Volume 433, Page 39 of the Deed Records of Brazos County, Texas. Said tract has been more particularly described by Henry P. Mayo. RPLS with field notes and survey dated April 3, 2001. o Property Needed for the Shenandoah Substation: Being all of that certain 8.183 acre tract or parcel of land, more or less, lying and being situated in the Robert Stevenson League, Abstract No. 54, College Station. Brazos County, Texas. Said tract being part of a called 18.848 acre tract as described by a deed to K. T. H. Investments recorded in Volume 3899, Page 309 of the Official Public Records of Brazos County, Texas. Said tract known as Reserve Tract "A" on the "Master Development Plan - Not For Record" prepared by Brad Kerr, RPLS. Survey date 8-3-2000. Plat date: 4/21/2001. Said tract to be more particularly described with field notes and plat prepared by a Registered Professional Land Surveyor.
