Mayor Council Members .ion Silvia Ben White Mayor Pro Tempore Ron Gay John 1--Iapp Susan .Lancaster Interim City Manager Chris Scotti Glenn Brown Nancy Berry MINUTES COLLEGE STATION CITY COUNCIL SPECIAL MEETING Tuesday, October 18, 2005 at 9:00 am Brazos County Courthouse 85th District Court, Suite 225 300 E. 26th Street Bryan, Texas 77803 Agenda Item No. 1 -- Presentation, discussion and possible action concerning legal action related to the July 14th City Council Meeting and the Open Meetings Act, including possible authorization of and official vote to approve Agreed Judgment and Settlement of the issues. Mayor Silvia called the meeting to order at 8:51 am with a quorum of the City Council present. PRESENT: Mayor Silvia, Mayor Pro Tem Happ, Council members Gay, White, Berry, Scotti, Lancaster Mayor Pro Tem Happ made a motion to approve the agreed judgment and settlement of the issues. Motion seconded by Councilmember White. Each Councilmember present signed the document. Council member Berry arrived to the meeting at 8:55 a.m. She signed the agreed judgment. The City Council continued the meeting and again concurred and agreed to the judgment. Councilmembers Scotti and Lancaster arrived at 9:08 am. Each signed the agreed judgment. District Judge J.D. Langley presided over the court proceedings. District Attorney Bill Turner summarized the case between the State of Texas vs. the Mayor and City Councilmembers. On behalf of the Plaintiff, he requested Judge Langley grant a permanent, mandatory injunction for the Defendants requiring adherence to the Open Meetings Act, and requiring specific additional steps. That the Mayor, Mayor Pro Tem and City Council Members not discuss the following positions in a Council meeting unless specifically listed on the City Council agenda: (1) City Manager (2) Municipal Court Judge (3) City Secretary (4) City Attorney B. That the Mayor, Mayor Pro Tem and each member of the City Council is ordered to refrain from participating in any city council meeting in which notice has not been properly given in compliance with the Texas Open Meetings Act and this order. C. That the City Council shall audio record all non -litigation executive session to ensure compliance with the Open Meetings Act. That the City Attorney or his/her representative shall be physically present in all executive sessions regarding litigation. D. That while on the City Council the Mayor, Mayor Pro Tem and each member of the City Council is ordered to attend mandatory training on open meetings of not less than one hour every year regarding the responsibility of the governmental body and its members that the first of such training take place not less than six months from entry of judgment in this matter. Councilmembers agreed to the provisions stated above. Judge Langley granted the mandatory injunction. Hearing no objection, the City Council unanimously adjourned the meeting at 9:15 am on Tuesday, October 18, 2005. PASSED AND APPROVED this 22nd day of November 2005.
