Mayor Silvia opened the meeting at 7:00 pm. All Council members present. Mayor Silvia, Mayor Pro Tern
John Happ, Council members Ron Gay, Chris Scotti, Ben White, Lynn McIlhaney, Dave Ruesink.
Also present Acting City Manager Mark Smith, City Attorney Harvey Cargill, Jr., City Secretary Connie
Hooks and members of the Management Team, staff from Administration, Information Technology, Public
Relations, and Development Services
Mayor Silvia announced the meeting procedures.
Agenda Item No. I - Public hearing, presentation, possible action, and discussion on an ordinance rezoning
49.39 acres, generally located on the southeast comer of SH 6 and Rock Prairie Road, from A-O Agricultural
Open, R-4 Multi-Family Residential, and C-2 Commercial Industrial to C-I General Commercial.
Lance Simms, Acting Director of Planning and Development Services presented the staff report.
The proposed rezoning would consist of approximately 60 acres of land, C-I General Commercial for a retail
super center. Planning and Zoning Commission heard the request on July 6, 2006 meeting and
recommended denial. Staff recommended approval of the rezoning request. The request is in compliance
with the City's comprehensive plan, specifically the Greens Prairie/Rock Prairie Small Area Plan.
Mr. Simms described numerous points of concern by citizens expressed to Staff, Weingarten and P&Z
focused on traffic, congestion, noise, lighting, landscaping, and the proximity of the development to the
neighboring subdivisions. He continued his presentation by outlining the positive factors contained in the
Non residential Architectural Standards in the UDO. These mandates will be applied to the maximum
extent, including but not limited to; double landscaping points, larger caliper trees and required public
spaces. Additionally, neighborhood protection standards will be applied, such as streetscaping, outdoor
lighting standards, and buffering to mitigate noise and the visual effect of outdoor storage areas.
Ken Fogle, Transportation Planner, described the purpose of a traffic impact analysis that would be expected
during the platting stage, and an update oftraffic projects in the immediate area.
City Attorney Harvey Cargill, Jr. cited case law and statutes as a response to a letter submitted to the City
Council by Weingarten legal counsel.
The applicant's representative, Chuck Ellison of 2902 Camille Drive introduced individuals with various
technical backgrounds to address the City Council on the Weingarten proposal.

Council took a break at 8:55 pm. Mayor Silvia resumed the meeting at 9:05 pm.
Chuck Ellison presented positive points about the land use plan and its consistent status of regional retail for
such a proposed development.
Numerous speakers came forward to address the City Council on the pros and cons of the proposed rezoning
request. Opponents expressed their viewpoints on issues such as traffic congestion, traffic patterns, safety,
land adjacency, and environmental concerns.

Mayor Silvia closed the public hearing at 12:06 am on Friday, July 21,2006.
Police Chief Michael Clancey and Fire ChiefR.B. Alley addressed the City Council about the public safety
responses within the entire City in heavy traffic flow with the quickest response possible.
Staff and the developer answered questions by the City Council. City Councilmembers presented comments
about the proposed rezoning and development.
Mayor Pro Tern Happ made a motion to table this item and request legal counsel to discuss options with the
City Council and solicit Council support for this motion. Motion seconded by Councilmember Gay failed
2-5.

AGAINST: Silvia, McIlhaney, White, Scotti, Ruesink
Councilmember McIlhaney made a motion to accept the Planning and Zoning Commission recommendation
to deny the rezoning request by Weingarten Realty Investors for 49.39 acres generally located at the
southeast corner of SH 6 and Rock Prairie Road from A-a Agricultural Open, R-4 Multi-Family Residential,
and C-2 Commercial Industrial to C-I General Commercial without prejudice and to direct staff to begin the
traffic impact analysis for this area. The motion stated was based on the health, safety and welfare, and
particularly traffic safety for the residents. Her motion was seconded by Councilmember White.
Councilmembers emphasized the importance for a traffic impact analysis in the subject corridor.
Councilmember Scotti made a motion to table this item until further review of the corridor and traffic studies
conducted. Motion seconded by Councilmember Gay and failed 3-4.

AGAINST: Silvia, McIlhaney, White, Ruesink
The motion made by Councilmember McIlhaney and seconded by Councilmember White passed by a vote of
4-3.

Mayor Silvia thanked the audience for their participation.
Hearing no objections, the meeting was adjourned at I :04 am, Friday, July 21,2006.
