HomeMy WebLinkAbout5-24-2007-2r - Resolution - 05/24/2007 • RESOLUTION NO. 5-24-2007-2r A RESOLUTION AUTHORIZING THE MAYOR TO SIGN THE NOTICE OF ELECTION FOR THE RUNOFF ELECTION TO BE HELD ON JUNE 23, 2007 IN THE CITY OF COLLEGE STATION, TEXAS FOR THE PURPOSE OF ELECTING ONE CITY OF COLLEGE STATION COUNCILMEMBER, PLACE 1 TO FILL AN UNEXPIRED TERM; DESIGNATING ELECTION PRECINCTS; APPOINTING ELECTION OFFICIALS; ESTABLISHING PAY RATES FOR ELECTION WORKERS; PROVIDING FOR THE USE OF VOTING MACHINES; PROVIDING FOR EARLY VOTING; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: Part 1. A runoff election was ordered by the College Station City Council at its regular meeting on February 8, 2007 for the purpose of designating a date if a majority of votes cast was not received by a candidate on the ballot for City Council Place 1 at the special municipal election held on May 12, 2007. Part 2. The polls for said runoff election shall be open from 7:00 a.m. until 7:00 p.m. Part 3. The City Secretary is expressly authorized to obtain election supplies and equipment required by law and necessary to conduct said election. Part 4. The Office of the City Secretary shall perform all duties normally performed by the County Clerk in iik general elections with respect to early voting, giving notice of the election, and preparing the official ballots. Part 5. Ringer Library Steve Milam, Presiding Judge 1818 Harvey Mitchell Parkway Dolores Turincio, Alternate Judge 2B, 39, 80 Cypress Grove Intermediate School Terri Stewart, Presiding Judge 900 Graham Road Melissa Johnson, Alternate Judge 40 / Aldersgate Methodist Church Jean Hall, Presiding Judge 2202 Earl Rudder Freeway S Bill Donaldson, Alternate Judge 41, 68 Pebble Creek Elementary School Al Postelwaite, Presiding Judge • 200 Parkway Carol Postelwaite, Alternate Judge Resolution for Notice of Election Page 2 T he early voting polling place by personal appearance shall be in the City Hall Council Chambers, 1101 exas Avenue, College Station, Texas and at College Station Utilities in the Information Services Training Room at 310 Krenek Tap Road, College Station, Texas. 8:00 am to 5:00 pm June 11 -15, 2007 7:00 am to 7:00 pm June 18 -19, 2007 Part 6. In addition to the presiding judge and alternate judge for each precinct herein above designated, the respective presiding judge for each precinct and the Early Ballot Board, as herein provided, shall be authorized to appoint a sufficient number of clerks as they may deem necessary to assist them in said election, provided, however, that the number of clerks appointed by said presiding judge for each polling place shall not be less than two, including the alternate judge also serving as a clerk. Part 7. The judges and clerks shall be compensated at the rate of eight dollars ($8.00) per hour. No judge or clerk shall be paid for more than one hour of work before the polls open and no period of time subsequent to two hours after voting is concluded by all voters offering themselves for voting during regular voting hours, whichever is later. The presiding judge who delivers the returns of the election shall be paid an additional twenty -five dollars ($25.00). Part 8. Direct recording electronic voting devices shall be used for voting at the foregoing election precincts and electronic counting devices and equipment shall be used for counting the ballots at said election. Optical scan balloting materials shall be used for mail balloting. W art 9. Early voting shall be conducted by the Office of the City Secretary in the College Station City Hall, College Station, Texas, and optical scan balloting shall be used for early voting by mail and direct recording electronic voting devices shall be used for early voting by personal appearance. Early voting by personal appearance for the runoff election shall commence on June 11, 2007, at 8:00 a.m. and end at 7:00 p.m. on June 19, 2007. Part 10. An Early Ballot Board is hereby designated to canvass the early votes cast by mail and by personal appearance. Kay Parker is duly appointed as Presiding Judge of said Board, and she shall appoint such other members as provided in the Texas Election Code, Section 87.002(b). Part 11. The following slate of officials and other designated persons are hereby authorized to be present at the Central Counting Station to observe the election counting process: Presiding Judge Kay Parker and appointed clerks College Station City Secretary Connie Hooks Data Processing Manager and Tabulation Supervisor Representatives of the Secretary of State's Office, Hart Intercivic and Texas Voting Systems, Inc. Part 12. The Council Chambers located in the College Station City Hall at 1101 Texas Avenue, College Station, Texas is hereby established as the Central Counting Station to receive and tabulate votes and ballots cast in said election. • Resolution for Notice of Election Page 3 O P art 13. The following persons are hereby authorized and approved as persons employed and designated to handle the ballots, operate the tabulating equipment, count the ballots, and be present in the Central Counting Station: a. Central Counting Station Presiding Judge — Kay Parker b. Central Counting Station Manager - City Secretary Connie Hooks c. Tabulation Supervisor — Tracy Price d. Data Processing Manager — Tim Clark e. Clerks - to be named by Presiding Judge. f. Consultant for Texas Voting Systems, Inc., and Hart Intercivic Part 14. A committee is hereby established of the following persons to hold three computer accuracy tests. The first test shall be conducted at least 48 hours before the count of voted ballots. The second test shall be conducted immediately prior to the start and the third test immediately subsequent to the count of voted ballots to ascertain that the computer will accurately count the votes cast for the offices to be voted upon in said election: a. Kay Parker b. Connie Hooks c. Tracy Price d. Consultant for Texas Voting Systems, Inc., and/or Hart Intercivic Part 15. All residents, qualified voters of the City of College Station shall be permitted to vote for City Councilmember Place 1 to fill an unexpired term. In addition, the election materials as outlined in Section 272.005, Texas Election Code, shall be printed in both English and Spanish for use at the polling places and •for early voting for said election. Part 16. The Mayor is authorized to sign a Notice of Municipal General Runoff Election as prescribed by the State of Texas. The Notice of Municipal General Runoff Election shall be published in accordance with the provisions of the Texas Election Code and the City Charter. Part 17. Should any part, section, subsection, paragraph, sentence, clause or phrase contained in this resolution be held to be unconstitutional or of no force and effect, such holding shall not affect the validity of the remaining portion of this resolution, but in all respects said remaining portion shall be and remain in full force and effect. Notice is hereby given that the polling places listed below will be open from 7:00 a.m. to 7:00 p.m. on Saturday, June 23, 2007 for voting in a runoff election to elect a College Station City Councilmember Place 1 to fill an unexpired term. The period for early voting by personal appearance shall commence on Monday, June 11, 2007 and conclude on June 19, 2007. Optical scan ballots shall be used for early voting by mail and direct recording electronic voting machines shall be used for early voting by personal appearance. The Early Voting Clerk for said election shall be the City Secretary. She shall determine the number of election workers to hire and their assignments at the main polling location.
