HomeMy WebLinkAbout1988-1785 - Ordinance - 11/10/1988ORDINANCE NO. 1785 AN ORDINANCE AMENDING CHAPTER 11, SECTION 5, OF THE CODE OF ORDI- NANCES OF THE CITY OF COLLEGE STATION PERTAINING TO ASSESSMENT AND CHARGE FOR GARBAGE DISPOSAL IN THE CITY OF COLLEGE STATION, AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STA- TION, TEXAS THAT: I. That Chapter 11, Section 5-I, CHARGES; PAYMENT OF, is hereby amended to read as follows: I. CHARGES; PAYMENT OF (1) There shall be assessed and collected from each person, firm or corporation within the city limits the following assessment charges for garbage disposal as follows: Each residential dwelling unit (single family, multi -family not utilizing semi -automated, or automated commercial -type refuse containers). . . . . . . . . . . . $ 5.25 per month Each residential dwelling unit utilizing semi -automated or automated commercial -type refuse containers . . . . . . . . . . . . $ 4.20 per month Places of business that can best be serviced by twice per week handcrew collection, utilizing disposable refuse bags, without causing a health, sanitation, or litter nuisance . . . . . . . . $ 25.60 per month Places of business that can best be serviced by the utilization of a semi -automated or automated commercial -type refuse container: 3 cubic yard container. . . . . $ 72.00 per month 6 cubic yard container. . . . . $116.75 per month n05428 Places of business that utilize any commercial -type refuse container/compactor: Three collections per week. . . $116.75 per month More than three collections per week. . . . . . . . . . . . $233.50 per month (2) Payments must be received by the utility office of the City of College Station, on or before the due date to avoid late charges. Payment received after the due date will be assessed a penalty equaling ten percent (10%) of the current month's charges with a minimum charge of Three Dollars ($3.00). (3) A Sanitary Landfill disposal fee shall be collected for tipping at the Sanitary Landfill. The tipping fee shall be $10.10 for the first ton. Thereafter, each 1,000 pound increment or less shall result in an additional $5.05 fee. The following shall have specific charges: All roll -off container service . . . . . . . . . . . $50.00 per load plus $10.10 per ton land- fill charge. There- after, each 1000 pounds increment or less shall result in an additional $5.05 fee. Grease trap waste, municipally registered haulers only, transported in vacuum trucks. . . - 2 - $50.00 per load for processing plus $10.10 per ton landfill charge. Thereafter, each 1000 pounds in- crement or less shall result in an addition- al $5.05 fee. n05429 II. That Chapter 11, Section 5-K, TERMS OF COLLECTION, is hereby amended to read as follows: "K. TERMS OF COLLECTION (1) The city sanitation department will not make collection of garbage where same is not prepared for collection and placed as designated by the terms of this section. (2) The Solid -Waste Superintendent, or his representative, shall be notified of any new service locations, or changes in service levels and will designate the appropriate service level and/or size(s) of the container(s) to be utilized. The Superintendent shall be authorized to require changes in service levels at any location when the current service level is inadequate and is creating a health, sanitation, or litter nuisance." That Chapter 11, Section 5-N, USE OF SANITARY LANDFILL, is hereby amended to read as follows: "N. USE OF CITY SANITARY LANDFILL The City of College Station Landfill shall be available for the disposal of garbage to the following: - Entities authorized by intergovernmental agreements. - College Station utility customers --residential, commercial and industrial. - Contractors working on projects within the city limits. (1) Citizen Haulers Residential utility customers presenting proof of resi- dency to the satisfaction of the landfill operator shall not be charged for dumping residential waste, which waste was generated at the site of the utility charge. (2) Private Haulers Private haulers in the business of hauling or disposing of garbage for a profit shall not be entitled to use the City Sanitary Landfill, except as provided in Chapter 11, Section S.R. - 3 - 005430 (3) Unlawful Dumping No person shall dump any refuse at the City Sanitary Landfill at any place other than a place designated by the landfill attendant for dumping." IV. That Chapter 11, Section 5-U, is hereby amended, EFFECTIVE DATE OF CHARGES FOR GARBAGE DISPOSAL, as follows: "U. EFFECTIVE DATE OF CHARGES FOR GARBAGE DISPOSAL These rates shall be effective on all invoices submitted by the City of College Station to users on or after October 1, 1988." V. Should any section, paragraph, sentence, clause, phrase, or word in this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. VI. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. VII. And it is ordained that this ordinance shall become effective from and after its passaqe in accordance with the City Charter of the City of College Station.
