HomeMy WebLinkAbout1988-1779 - Ordinance - 09/22/1988ORDINANCE NO. 1779 AN ORDINANCE AMENDING CHAPTER 11, OF THE CODE OF ORDINANCES, OF THE CITY OF COLLEGE STATION, TEXAS BY AMENDING SECTION 7 ESTABLISHING THE PURPOSE OF THE DRAINAGE MAINTENANCE PROGRAM, SETTING AN ASSESSMENT, PROVIDING A SAVINGS CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION THAT: I. That Chapter 11, of the Code of Ordinances of the City of College Station is hereby amended by adding a section, to be numbered Section 7, which said section shall read as follows: "SECTION 7: MINOR DRAINAGE MAINTENANCE PROGRAM A. PURPOSE To provide clean and properly maintained City drainage easements within the municipality's minor tributary collection system. B. SURCHARGE TO COVER COST Implementation of a drainage program shall be funded through an assessment to be levied on a monthly basis and to be billed to utility customers of the City. This surcharge shall be in the following amount: Each unit, per month - $0.70 C. EFFECTIVE DATE OF MONTHLY ASSESSMENT FOR DRAINAGE PROGRAM The assessment as set forth in this section shall be effective on all invoices submitted by the City of College Station to users on or after October 1, 1988. D. DRAINAGE ASSESSMENT CHARGE The drainage assessment will be shown as a separate item charge on the utility bill." II. Should any section, paragraph, sentence, clause, phrase, or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. 005419 ORDINANCE NO. 1779 PAGE 2 That all ordinances or parts of ordinances, in conflict herewith are superseded to the extent of the conflict only. IV. And, it is ordained that this Ordinance shall be come effective from and after its passage in accordance with the City Charter of the City of College Station.
