HomeMy WebLinkAbout1988-1745 - Ordinance - 03/25/1988ORDINANCE NO. 1745 AN ORDINANCE ORDERING AN ELECTION TO BE HELD ON THE QUESTION OF LEGALIZING BINGO GAMES IN COLLEGE STATION, TEXAS FOR CHARITABLE PURPOSES AS AUTHORIZED BY THE BINGO ENABLING ACT. WHEREAS, in accordance with the provisions of Article 179d, known as the Bingo Enabling Act of the State of Texas, a municipality is authorized to submit to its voters a proposition to determine whether the holding of Bingo games within the city limits shall be legalized; and, WHEREAS, a petition has been delivered to the Mayor of College Station, Texas, to request that an election be held to consider the question of legalizing Bingo games within the city boundaries of College Station; and, WHEREAS, said petition having been prepared and submitted in accordance with provisions set forth by law; has been certified as sufficient by the City Secretary; and, WHEREAS, in accordance with provisions of Article 179d, and the Charter of the City of College Station, and in response to the petition brought by qualified electors in the City of College Station, the City Council has determined, and hereby determines, that a proposition shall be submitted to the electorate of the City of College Station, Texas for the purpose of determining whether Bingo shall be legalized within the city limits; and, WHEREAS, the City Council of the City of College Station, Texas has previously ordered that a general election shall be held on the first Saturday in May, 1988, the same being May 7, 1988. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: I. That, at the election to be held on May 7, 1988 there shall be submitted to the duly qualified resident electors within the City of College Station, Texas for their action upon, the following proposition, to wit: 005243 Ordinance No. 1745 Page 2 PROPOSITION NO. 1 "Legalizing Bingo games in College Station, Texas for charitable purposes as authorized by the Bingo Enabling Act." And the ballot for said election shall have printed thereon the following question, which may be abbreviated to the extent necessary, but a verbatim statement of the proposition shall be displayed at each polling place. PROPOSITION NO. 1 FOR Legalizing Bingo games in College Station, Texas for charitable purposes as authorized by the Bingo AGAINST Enabling Act. II. That, if a majority of the qualified voters voting on the question vote in favor of legalization, the holding of Bingo games as authorized by the Bingo Enabling Act shall be legalized throughout the City of College Station, Texas, effective the loth day after the date that the canvass of ballots is held, and the result of the election is declared official, except that the legalization does not apply to any part of the City of College Station for which Section 10 of Article 179d requires a contrary status.
