HomeMy WebLinkAbout1988-1742 - Ordinance - 03/10/1988ORDINANCE NO. 1742 AN ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS AMENDING CHAPTER 13, SECTION 1301.1.2 OF THE CODE OF ORDINANCES, CITY OF COLLEGE STATION, TEXAS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council held a ppublic hearing in the City Hall at 7:00 p.m. on Thursday, the 10_th of March __1 1988, on the question of amending Chapter 3, Section 1, of the Code of Ordinances, City of College Station relating to building regulations, AND WHEREAS, the City Council has determined the following: I. That Chapter 3, Building Regulations, Section 1B: Amendments to the Standard Building Code College Station, Texas is hereby amended to read as follows: O T) SECTION 1301.1.2 TRENCH SAFETY. On all construction projects, public or private, within the boundaries of the City of College Station, or within the extraterritorial jurisdiction, the bid document and the contract shall contain: 1. Detailed plans and specifications for adequate safety systems that meet OSHA standards, and 2. A pay item for those safety systems. 3. This requirement shall not apply to persons subject to safety standards adopted under Article 6053-1, V.T.C.S., and subject to the administrative penalty provisions of Article 6053-2, V.T.C.S. 4. Violations will be reported to OSHA and the job superintendent. III. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. n05228 IV. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only, including but not limited to Ordinance No. 1398, Ordinance No. 1442, Ordinance No, 1567 and Ordinance No. 1629. V. "Any violation of this ordinance" is punishable by a fine not to exceed $1,000 as provided for by Article 4.14 of the Texas Code of Criminal Procedure, as amended. In the event that a fine not to exceed $1,000 is greater than the intended jurisdictional limit, then the fine imposed shall not exceed $200.00. WHEREAS, the preservation of the general welfare of the public necessitates immediate action, this Ordinance shall be effective from and after the date of this passage as provided by the Charter of the City of College Station.
