AN ORDINANCE AMENDING CHAPTER 13, SECTIONS 2, 3.C.1, 4.B.5,
4.B.9, 5.G.2, 5.H.1, 5.H.2(a) AND 5.H.3 AND ADDING PARAGRAPHS
5.E.9 AND 5.G.4 TO THE CODE OF ORDINANCES OF THE CITY OF COLLEGE
STATION PROVIDING FOR A STORMWATER MANAGEMENT PLAN AND
INCORPORATING REQUIREMENTS OF THE FEDERAL INSURANCE
ADMINISTRATION FOR PARTICIPATION IN THE NATIONAL FLOOD INSURANCE
PROGRAM.
WHEREAS, the City Council of the City of College Station
recognizes the need to continue the city's participation in the
National Flood Insurance Program; and
WHEREAS, the City must maintain regulations consistent with the
current regulations of the National Flood Insurance Program in
order to continue participating.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
I
That Chapter 13, Section 2 of the Code of Ordinances of the City
of College Station, Texas is hereby amended by revising the
definitions of DEVELOPMENT and ELEVATED BUILDING to read as
follows:
"DEVELOPMENT - means any man-made change to improved or
unimproved real estate, including but not limited to
buildings or other structures, mining, dredging, filling,
grading, paving, excavation, clearing or drilling
operations."
"ELEVATED BUILDING - means a non -basement building (i)
built, incase of a building in Zones Al-A3O, AE, A, A99, AO,
AH, B, C, X and D, to have the top of the elevated floor, or
in the cases of a building in Zones V1-30, VE or V, to have
the bottom of the lowest horizontal structural member of the
elevated floor elevated above the ground level by means of
pilings, columns (posts and piers), or shear wall parallel
to the flow of the water and (ii) adequately anchored so as
not to impair the structural integrity of the building
during a flood of up to the magnitude of the base flood. in
the case of Zones Al-A30, AE, A, A99, AO, AH, B, C, X and D,
"elevated building" also includes a building elevated by
means of fill or solid foundation perimeter walls with
openings sufficient to facilitate the unimpeded movement of
floodwaters. In the case of Zones V1-30, VE, or V,
"elevated Building" also includes a building otherwise
meeting the definition of "elevated building", even though
the lower area is enclosed by means of breakaway walls if
the breakaway walls meet the applicable standards of the
National Flood Insurance Program regulations."

That Chapter 13, Section 3., subsection C., paragraph 1. of the
Code of Ordinances of the City of College Station, Texas is
hereby amended to read as follows:
111. Exception - The following uses shall be exempt from the
permitting requirements of the ordinance but must otherwise meet
all of the requirements of the ordinance and the Drainage Policy
and Design Standards:
(a) Customary and incidental grounds maintenance,
landscaping and gardening.
(b) Improvements by a homeowner on property used as their
principal residence where that property lies outside of the
designated Area of Special Flood Hazard.
(c) Uses by a landowner of their property for bona fide
agricultural purposes where that property lies outside of
the designated Area of Special Flood Hazard."

That Chapter 13, Section 4., subsection B., item 5. of the Code
of Ordinances of the City of College Station, Texas is hereby
amended to read as follows:
115) assure that adequate maintenance of drainage pathways
including altered or relocated waterways is provided such
that capacity for carrying stormwater and flood flows is
maintained;"

That Chapter 13, Section 4., subsection B., item 9. of the Code
of Ordinances of the City of College Station, Texas is hereby
amended to read as follows:
119) notify adjacent communities and the Texas Water Commission
prior to any alteration or relocation of a watercourse, and
submit evidence of notification to the Federal Insurance
Administration, and"

That Chapter 13, Section 5., subsection G., paragraph 2. of the
Code of Ordinances of the City of College Station, Texas is
hereby amended to read as follows:

02. Exemptions from the requirements of Section 5-G may be made
In the following cases:
(a) Customary and incidental routine grounds maintenance,
landscaping and home gardening which does not require a
building permit, zone change request, or variance from the
provisions of the Zoning Ordinance;
(b) Emergency repairs of a temporary nature made on public
or private property which are deemed necessary for the
preservation of life, health or property, and which are made
under such circumstances where it would be impossible or
impracticable to obtain a development permit.
(c) Temporary excavation for the purpose of maintaining, or
repairing any public street, public utility facility, or any
service lines related thereto;"

That Chapter 13, Section 5., subsection H., paragraph 1. of the
Code of Ordinances of the City of College Station, Texas is
hereby amended to read as follows:
111. All new construction or any substantial improvement of any
residential structure shall have the lowest floor, including
basements, elevated at least one foot above the depth number
specified on the community's FIRM."

That Chapter 13, Section 5., subsection H., paragraph 2.,
subparagraph (a). of the Code of Ordinances of the City of
College Station, Texas is hereby amended to read as follows:
"(a) Have the lowest floor, including basements, elevated
at least one foot above the depth number specified on the
community's FIRM; or"

That Chapter 13, Section 5., subsection H., paragraph 3. of the
Code of Ordinances of the City of College Station, Texas is
hereby amended to read as follows:
113. Adequate drainage paths to guide floodwaters around and away
from proposed structures shall be provided for all proposed
structures on slopes in Zones AH or AO."

That Chapter 13, Section 5., subsection E., of the Code of
Ordinances of the City of College Station, Texas is hereby
amended to include the following:
"9. I areas of special flood hazard where base flood elevations
have not been established, base flood elevation data shall be
generated for subdivision proposals and other proposed
development including manufactured home parks and subdivisions
which is greater than 50 lots or 5 acres, whichever is less."

That Chapter 13, Section 5., subsection G., of the Code of
Ordinances of the City of College Station, Texas is hereby
amended to include the following:
119. When a regulatory floodway has not been designated, no new
construction, substantial improvements, or other development
including fill shall be permitted within zones designated Al-A30
and AE on the community's FIRM, unless it is demonstrated that
the cumulative effect of the proposed development, when combined
with all other existing and anticipated development, will not
increase the water surface elevation of the base flood more than
one foot at any point within the community.

This ordinance shall become effective from and after its passage
in accordance with the City Charter of the City of College
Station.
