HomeMy WebLinkAbout1987-1729 - Ordinance - 10/22/1987ORDINANCE NO. 1729 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY REVISING CHAPTER 4, SECTION 17.B and 17.C, REGULATING SEXUALLY ORIENTED COMMERCIAL ACTIVITY. WHEREAS, Article 2372w, Texas Revised Civil Statutes, was amended to allow regulation of sexually oriented busanesses that sell or serve alcoholic beverages; and WHEREAS, the City Council of the City of College Station believes that such establishments are lnjuraous to the health, safety and welfare of this communlty, partlcularly when located near each other, churches and/or schools; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: That Chapter 4, Section 17.B, EXCEPTIONS TO REGULATIONS, ~s here- by amended to read as follows: "B. EXCEPTIONS TO REGULATIONS These regulations do not apply to the following: (1) Any business operated by or employing licensed psychologists, licensed physical therapists, licensed athletic trainers, licensed cosmetolo- gists, or licensed barbers performing functions authorlzed under the licenses held. (2) Any businesses operated by or employing licensed physicians, licensed practical nurses, or li- censed chiropractors engaged an practlclng the heallng arts." II. That Chapter 4, Section 17.C, PERMIT REQUIRED, is hereby amended by adding a new paragraph, to be numbered Section 17.C(5), which said paragraph shall read as follows: "(5) A bus~ness Is not exempt from regulation under th~s ordinance because at holds a l~cense or permit under the Alcoholic Beverage Code autho- rizing the sale or service of alcoholic bever- ages.'' 005193 III. It is ordained that this ordinance shall become effective In accordance with laws of the State of Texas and the City Charter of the City of College Station.
