HomeMy WebLinkAbout1989-1814 - Ordinance - 07/13/1989ORDINANCE NO. 1814 AN ORDINANCE AMENDING CHAPTER 4 OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION BY AMENDING SECTIONS 10-B(4), 10-C(2), 10-C(3), AND 10-D, AND BY ADDING A SECTION 10-G(5), RELATING TO WRECKER BUSINESS REGULATIONS. WHEREAS, on the 13th day of July, 1989, the City Council of the City of College Station met and found that the granting of a wrecker permit to tow within the City of College Station is a privilege; and WHEREAS, the Council further concluded that the fees charged to obtain a certificate and permit to operate a wrecker and, fur- ther, to be placed upon the "Rotation List" as defined in this chapter should be a reasonable fee; and WHEREAS, the Council further concluded that it was in the inter- est of the public safety and welfare, that provision be made for the revocation or rejection of a permit upon determination that the applicant has provided outdated or inaccurate information within the applicant's permit application; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: I. That Chapter 4, Section 10-B(4) of the Code of Ordinances of the City of College Station is hereby amended to read as follows: "(4) Fee: The fee charged the wrecker company by the College Station Police Department shall be set by Resolution of the College Station City Council from time to time as deemed appropriate by said Council and shall be of an amount to cover the cost of licensing and maintain- ing records." II. That Chapter 4, Section 10-C(2) of the Code of Ordinances of the City of College Station is hereby amended to read as follows: "(2) Rejections and Revocations: (a) In the event the Chief of Police determines any of the information contained in the application is nc r inaccurate or not current, he shall reject such ap- plication, or if a certificate or permit has been issued, it shall be revoked. (b) In the event a permit holder, or any of his em- ployees, is convicted of a violation pertaining to the operation of a wrecker, as set forth within this Chapter, the Chief of Police shall revoke the permit or certificate." That Chapter 4, Section 10-C(3) of the Code of Ordinances of the City of College Station is hereby amended to read as follows: "(3) Application Form The permit application that any applicant shall submit will be supplied by the College Station Police Depart- ment in the form that follows: WRECKER PERMIT NO. 1. True name of wrecker company: 2. Trade name of wrecker company: 3. Address: 4. Storage yard location: 5. Twenty-four hour telephone number of wrecker company: 6. Owner of wrecker company: 7. Names and addresses of owners of the wrecker to be used: 2 r,r:;6$6 B. Vehicle Information:* Make: Year: Model: Color: License Number: Year: State: Vehicle Identification Number: 9. Attach a verified statement that there are no outstanding final civil judgments against the wrecker company or the owners thereof in connection with the operation of the wrecker business. 10. Insurance Policy Number:** Attach a certificate of public liability and property damage insurance issued to a company authorized to transact business in the State of Texas and such policy shall contain limits of not less that $100,000.00 for each injury or death of one (1) person in any one (1) accident or occasion of treatment or care and limits of not less than $300,000.00 per occurrence of treatment or care, or injured or killed in the same accident or occasion of treatment or care and $10,000.00 for damage, destruction and/or loss of property as a result of one (1) accident. Liability insurance shall contain limits of not less than $100,000.00 for garage. 11. List below the name(s) of any wrecker company with which the applicant has previously been associated, merged, or become a successor in interest.*** I attest that the information above and attached to this form is true and correct to the best of my knowledge. IV. That Chapter 4, Section 10-D of the Code of Ordinances of the City of College Station is hereby amended to read as follows: "D. Inspection of Vehicles Every vehicle to be used by the applicant in the wrecker business shall be inspected by the Chief of Police or his delegate prior to the issuance of a permit to ascertain if it has the following: 4 �r� 88 (1) Current safety inspection certificate. (2) Title or registration number. (3) Current State tow truck license number. (4) One (1) fire extinguisher, type ABC dry chemical, at least 10+ or equivalent. (5) Three (3) portable red emergency reflectors, orange safety cones, or flares. (6) Light set sufficient to provide brake light and tail light maximum towed load (load lights). (7) Broom and scoop. (8) Approved emergency overhead flashing beacons. V. That Chapter 4, Section 10-G of the Code of Ordinances of the City of College Station is hereby amended by adding the follow- ing Section 10-G(5): "(5) Fee for Being on Rotation List: In addition to the fee charged to obtain a permit, any wrecker company desiring to be placed upon the 'Rota- tion List' as defined by this Chapter shall pay an ad- ditional fee to cover the cost of maintaining the Rota- tion List. This fee shall be set by Resolution of the City Council from time to time and in such amount as deemed appropriate by the City Council. This fee shall be collected annually at the same time the permit fees are renewed. This fee shall not be prorated." VI. This ordinance shall become effective and be in full force and effect from August 1, 1989. PASSED, ADOPTED and APPROVED this 13th day of July 1989.
