AN ORDINANCE REZONING A 10.15 ACRE TRACT OR PARCEL OF LAND, LYING AND
BEING SITUATED IN THE J. E. SCOTT SURVEY, ABSTRACT NO. 50, BRAZOS
COUNTY, COLLEGE STATION, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED
IN THE BODY OF THIS ORDINANCE, FROM SINGLE FAMILY RESIDENTIAL DISTRICT
R-1 TO GENERAL COMMERCIAL DISTRICT C-1.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
WHEREAS, the City Council held a public hearing in the City Hall at
7:00 P.M. on Thursday, January 26, 1989, on the question of rezoning
certain areas within the City Limits:
AND, WHEREAS, the City Council has determined the following:
To rezone or change the classification of a 10.15 acre tract or parcel
of land, lying and being situated in the J. E. Scott Survey, Abstract
No. 50, Brazos County, College Station, Texas, being all of the First
Tract (1.38 acres), part of the Second Tract (11.62 acres) and all of
the Third Tract (0.62 acres), described in the deed from Norris S.
Burt and wife, Hazel Burt, to Robert W. Toler and wife, Barbara M.
Toler, recorded in Volume 261, Page 200 of the Deed Records of Brazos
County, Texas; part of the 20' strip of land described in the deed
from John H. Stockton and wife, Inez M. Stockton, to Robert W. Toler
and wife, Barbara M. Toler, recorded in Volume 262, Page 26 of the
Deed Records of Brazos County, Texas; all of the 20' strip of land
described in the deed from John H. Stockton and wife, Inez M.
Stockton, to Robert E. Toler, recorded in Volume 274, Page 887, of the
Deed Records of Brazos County, Texas; all of the 20' strip of land
(erroneous beginning point) described in the deed from John H.
Stockton to Robert W. Toler and wife, Barbara M. Toler, recorded in
Volume 381, Page 523, of the Deed Records of Brazos County, Texas, and
being more particularly described as follows:
BEGINNING at the iron rod found marking the west corner of the said R.
W. Toler First Tract (1.38 acres), said iron rod being in the
southeast line of F.& B. Road (formerly named Jones Bridge Road);
THENCE N 45009'50" E along the northwest line of the beforementioned
R. W. Toler First Tract (1.38 acres) and Second Tract (11.62 acres),
same being the southeast line of the beforementioned F. & B. Road for
a distance of 267.75 feet to a concrete right-of-way marker found
marking the southwest right-of-way line of F.M.Road No. 2818 (West By-
pass);
THENCE along the southwest right-of-way line of the beforementioned
F.M.Road No. 2818 (West By -Pass) as follows:
N 89051140" E for a distance of 67.72 feet to a concrete right-
of-way marker,
S 41"43'45" E for a distance of 190.19 feet to a concrete
right-of-way marker,

S 43*44105" E for a distance of 500.04 feet to a concrete right-
of-way marker,
S 41"59'00" E for a distance of 400.09 feet to a concrete right-
of-way marker,
S 40"33'00" E for a distance of 414.08 feet to an iron rod set at
the intersection of the southwest right-of-way line
of F.M. Road No. 2816, (West By -Pass) and the fence
found marking the southeast line of the
beforementioned Robert W. Toler 20' wide strip of
land (Volume 262, Page 27);
THENCE S 44049'25" W along the fence found marking the southeast line
of the beforementioned R. W. Toler 20' wide strip of land (Volume 262,
Page 26), the R. W. Toler 20' wide strip of land (Volume 274, Page
887), and the R. W. Toler 20' wide strip of land (Volume 381, Page
523), for a distance of 647.31 feet to a cross -tie fence corner found
marking the south corner of the said R. W. Toler 20' wide strip of
land (Volume 381, Page 523);
THENCE N 45023'20" W along the fence found marking the southwest line
of the beforementioned R. W. Toler 20' wide strip of land (Volume 381,
Page 523), same being the northeast line of the Einman tract for a
distance of 20.00 feet and corner;
THENCE N 44049'25" E along the northwest line of the beforementioned
R. W. Toler 20' wide strip of land (Volume 381, Page 523) and the
beforementioned R. W. Toler 20' wide strip of land (Volume 274, Page
887), adjacent to a fence for a distance of 417.16 feet and corner at
the south corner of the beforementioned R. W. Toler Third Tract (0.62
acres), said corner being N 45*23120" W 20 feet from the cross -tie
found marking the south corner of the said R. W. Toler 20' wide strip
of land (Volume 262, Page 26);
THENCE N 45023'20" W along the fence found marking the southwest line
of the beforementioned R. W. Toler Third Tract (0.62 acres) and the
beforementioned R. W. Toler First Tract (1.38 acres) for a distance of
1531.44 feet to the PLACE OF BEGINNING, containing 10.15 acres of
land, more or less, from Single Family Residential District R-1 to
General Commercial District C-1.
And, it is ordained that said change shall become effective
immediately.
