HomeMy WebLinkAbout1991-1917 - Ordinance - 10/10/1991ORDINANCE NO. 1917 AN ORDINANCE AMENDING CHAPTER 4 OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY ADDING A SECTION 18 PERTAINING TO THE REGULATION OF SOLICITATION BY COERCION; PROVIDING DEFINI- TIONS; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. EE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STA- TION, TEXAS: That Chapter 4 of the Code of Ordinances of the City of College Station, Texas, pertaining to Business Regulations, is hereby amended to read as follows: "SECTION 18: SOLICITATION BY COERCION A. DEFINITIONS (1) Solicitation shall mean to ask, beg, solicit, or plead, whether orally or in a written or printed manner, for the purpose of receiving alms, charity, or gifts of items of value for oneself or another person. (2) Coercion shall mean: (a) to approach or speak to a person in such a manner as would cause a reasonable person to believe that the person is being threatened with: (i) imminent bodily injury; or (ii) the commission of a criminal act upon the person or another person, or upon property in the person's immediate possession; (b) to persist in a solicitation after the person solicited has given a negative response; (c) to block, either individually or as part of a group of persons, the passage of a solicited per- son; or (d) to engage in conduct that would reasonably be con- strued as intended to compel or force a solicited person to accede to demands. B. SOLICITATION BY COERCION A person commits an offense if he conducts a solicitation by coercion. PENALTY FOR VIOLATION Any person who violates any section of this ordinance is guilty of a misdemeanor and upon conviction is punishable in accordance with Chapter 1, Section 5 of the Code of Ordi- nances, City of College Station, Texas." Should any section, paragraph, sentence, clause, phrase, or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. Ail ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. This section shall be and become effective and be in full force and effect from and after its passage and approval by the City Council and duly attested by the Mayor and city Secretary. As used herein, a specification of the masculine gender includes the feminine, and the singular includes the plural. And, it is ordained that this ordinance shall become effec- tive from and after its passage in accordance with the city char- ter of the city of College Station.
