AN ORDINANCE AMENDING CHAPTER 7 OF THE CODE OF ORDINANCES OF THE
CITY OF COLLEGE STATION, TEXAS BY RENUMBERING SECTION 6(B)(2) TO
BE SECTION 6(B) (2) (a), AND ADDING SECTION 6(B) (2) (b), WHICH WILL
PERMIT CHARGING A LATE FEE FOR RENEWAL OF SOFT SERVE PERMIT
APPLICATIONS NOT RECEIVED BY FEBRUARY 1 OF THE YEAR FOR WHICH THE
PERMIT IS SOUGHT, AND PROVIDING AN EFFECTIVE DATE.

That Chapter 7 of the Code of Ordinances, City of College
Station, Texas, Section 6(B)(2) is hereby renumbered as Section
6(B) (2)(i), and Section 6(B)(2)(ii) is hereby added, which
section will permit charging of a late fee for the renewal of a
soft serve permit on applications no received by February 1 of
the year for which the permit is sought, which said renumbered
section and new section shall read as follows:
"(2) APPlication for Permit
(a)
A person desiring to operate a soft serve estab-
lishment shall file an application for a permit
with the Health Department. The issuance of all
permits is subject to procedural rules adopted by
the Texas Board of Health. Permits are valid only
for the purpose and use as stated on the applica-
tion. Permits are not transferable. Permits
shall be renewed annually on or before January 1st
of each year. The applicant or holder of a soft
serve permit must also have a valid "Food Service
Establishment" permit issued by the Health Depart-
ment.
(b)
The aDnlication for a renewal Permit and the
accomnanvina fee must be received by the Health
Department on or before February 1 of the calendar
year for which the Permit is souaht. If such
application and fee are not received bv the date
herein specified, the Health Department may charae
the soft serve Permit applicant UD to an addi-
tional 20% of the fee due and owina as a late
penalty for failure to comPlY with the reauire-
ments of subsection fa~. above. The charaina of
such late fee will have no effect on the City's
riaht to seek criminal penalties nermitted by the
enforcement provision of this ordinance."

And, it is ordained that this ordinance shall become effec-
tive from and after its passage in accordance with the City
Charter of the City of College Station.
