HomeMy WebLinkAbout1992-1959 - Ordinance - 06/11/1992ORDINANCE NO. 1959 AN ORDINANCE AMENDING CHAPTER 1, SECTION 29, SUBSECTIONS G, H, AMD K, OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION RELATING TO CEMETERY RULES AND REGULATIONS. WHEREAS, the City Council of the City of College Station hav- ing'met in regular session on the 11th day of June, 1992; and WHEREAS, the City Council received a report from the Cemetery Committee making recommendations pertaining to cemetery rules and regulations; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION THAT: Chapter 1, Section 29, Subsection G, of the Code of Ordinances of the City of College Station relating to perpetual care is hereby amended to read as follows: The sale of lots includes Perpetual Care Service, specifically the grading of roads, the mowing of all lots, pruning or removal of all trees or shrubs as needed, the general policing of the grounds, the control of any insect or animal that may cause damage, the free use of available water, and such other maintenance and control work as may be neces- sary to keep the cemetery presentable at all times. (2) Perpetual Care does not include the purchase, erec- tion, repair, or replacing of any object which may have an authorized place on a lot." II. Chapter 1, Section 29, Subsection H, of the Code of Ordinances of the City of College Station relating to plantings is hereby amended to read as follows: "H. PLANTINGS (1) The planting of grass, flowers, shrubs, trees, or other type of vegetation shall be made only by or at the direction of the City. Such plantings at the ORDINANCE NO. 1959 PAGE 2 discretion of the purchaser are prohibited and will be removed in accordance with the Rules Infractions Procedures. (2) Planting of trees, shrubs or flowers that existed prior to adoption of this ordinance are considered grandfathered. These plantings will be subjected to pruning as needed for perpetual care. The replace- ment of grandfathered plantings is not allowed, as it would vlolate this ordinance. (3) An option available to property owners is a Memorial Fund. Money from this fund would be used for plant- ings within the cemetery according to an established landscaping plan. Planting and maintenance will be the responsibility of the City." III. Chapter 1, Section 29, Subsection K, of the Code of Ordinances of the City of College Station relating to monuments, head- stones, and markers is hereby amended to read as follows: "K. MONUMENTS, HF~DSTONES. AND MARKERS Monuments, headstones, and markers shall be of such design, size, material, finish, and location as may be approved by the City Council. (2) Generally, family or ~ou~le monuments (one per family .in a plot contalnln~ at least 100 square feet) will be approved, provlded that such monuments shall not exceed thirty inches (30") in height nor seventy-two inches (72") in length. These maximum dimensions shall also pertain to any design that incorporates a base. If a base is included, it can be set flush with ground level or must have a min- imum of four (4) inches above ground level. The back of an approved monument shall be flush with the rear lot line and equidistant from the side bound- aries, and the monument shall be located on undis- turbed ground. (3) Monuments for single grave spaces (50 square feet) shall not exceed thirty inches (30") in height nor forty-eight inches (48") in length. These maxi- mum dimensions shall also pertain to any design that incorporates a base. If a base is included, it can be set flush with ground level or must have a ORDINANCE NO. 1959 PAGE 3 minimum of four (4) inches above ground level. No more than one single grave marker shall be permitted per space. (4) Monuments for single baby spaces (20 square feet) shall not exceed twenty-two inches (22") in height nor twenty-one inches (21") in length. These maxi- mum dimensions shall also pertain to any design that incorporates a base. If a base is included, it can be set flush with ground level or must have a mini- mum of three (3) inches above ground level. Monu- ments for more than one spaoe in the baby ares (at least 40 square feet ) shall not exceed twenty-two inches (22") in height nor forty-eight inches (48") in length. These maximum dimensions shall also pertain to any design that incorporates a base. If a base is included, it can be set flush with ground level or must have a minimum of three (3) inches above ground level. (5) Any ornaments or vases incorporated into any design must be permanently affixed to the monument and shall not extend beyond the maximum dimensions allowed for the monument. (6) Foot markers shall not exceed twelve inches (12") in width nor twenty-four inches (24") in length. Corner markers shall not exceed eight inches (8") by eight inches (8") and must be set flush with the ground level." IV. This ordinance shall become effective and be in full force and effect from and after its passage and approval by the City Council and duly attested by the Mayor and City Secretary.
