HomeMy WebLinkAbout1994-2053 - Ordinance - 03/24/1994ORDINANCE NO. 2053 AN ORDINANCE VACATING AND ABANDONING A PUBLIC UTILI'I'Y EASE- MENT WHICH CROSSES AND LIES WITHIN LOTS 12 AND 13, WINDWOOD PHASE SEVEN, IN THE CITY OF COLLEGE STATION, TEXAS WHEREAS, the City of College Station has received an Apphcetion for the Abandonment of a Public Uflhty Easement which crosses and lies within Lots 12 and 13, Windwood Phase Seven, in the City of College Station, more particularly described in Exhibit "A" attached hereto; and WHEREAS, on March 24, 1994 the City Councd of the C~ty of College Station, Texas heard the app icatlon of Vaughn & Clark, Joint Venture, for the vacation and abandonment of the public utility easement which crosses and lies w th n Lots 12 and 13, Windwood Phase Seven, in the City of College Station, accord- ing to the plat recorded in Volume 1895, Page 193, of the Deed Records of Brazos County, Texas, NOW, THEREFORE, be it ordained by the City Council of the City of College Station, Texas, that a twenty foot (20') w~de str~p of land prewously platted, as a, public utility easement which crosses and lies within Lots 12 and 13, Winowooo Phase Seven, in the City of College Station, be abandoned and vacated PASSED, ADOPTED and APPROVED this 24th day of March, 1994. Brazos County, Texas and being a part of Lots 12 and 13 of WINDWOOD - PHASE SEVEN according to the Plat recorded in Volume 1985 page 193, Official Records of Brazos County, Texas and being described as follows: BEGINNING: at a 1/2" iron rod found at the most westerly common comer of said Lots 12 and 13, same being in the southeast right-of-way line of Wlngate Court; THENCE: N 57*56'44" E - 10.00 feet along said Wmgate Court line and corner; THENCE: S 32°03'16.. E - 112.00 feet along a line l0 00 feet From and parallel to the common line between said Lots 12 and 13 and corner, THENCE: S 57056'44" W - 20.00 feet along a line 10.00 feet from and parallel to the rear lot lines of said Lots 12 and 13 and corner; THENCE: N 32°03'16" W - 112.00 feet along a line 10.00 feet from and parallel to said Lots 12 and 13 common line and corner In said Wmgate Court line; THENCE: N 57056'44.. E - 10.00 feet along said Wlngate Court line to the PLACE OF BEGINNING; and containing 0.05 acres of land, more or less. according to a survey made on the ground under the supervision of Donald D. Garrett, Registered Professional Land Surveyor, No. 2972 on March 4. 1994.
