HomeMy WebLinkAbout1993-1994 - Ordinance - 01/14/1993ORDINANCE NO. 1994 AN ORDINANCE AMENDING CHAPTER 1, GENERAL PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, BY ADDING A SECTION 30 PROHIBITING OFF-PREMISE COMMERCIAL SIGNS AND PORTABLE SIGNS IN THE EXTRATERRITORIAL JURISDICTION. WHEREAS, the City Council of the City of College Station, Texas, held a public hearing in the City Hall at 7:00 p.m. on Thursday, December 10, 1992, on the question of prohibiting off-premise and portable signage in the extraterritorial jurisdiction of the City; WHEREAS, Local Government Code Chapter 216 provides for local regulation of outdoor signs in extraterritorial jurisdiction areas; WHEREAS, the City Council has found that entrances to the City should be protected from the proliferation of signage; and WHEREAS, the City Council has determined that certain provi- sions regarding signage are necessary to avoid unusual clut- ter, to preserve and improve the appearance of the community, and to avoid traffic problems caused by distracting signs or structures; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION THAT: Chapter 1, of the Code of Ordinances of the City of College Station, Texas, is hereby amended by adding a section, to be numbered Section 30, which said section shall read as follows: "SECTION 30: OFF-PREMISE AND PORTABLE SIGNS WITHIN THE EXTRATERRITORIAL JURISDICTION Off-premise commercial signs and portable signs shall be prohibited within the extraterritorial jurisdiction of the city of College Station. B. Definitions. "Sign" means an outdoor structure, sign, display, light device, figure, painting, drawing, message, plaque, poster, billboard, or other thing that is designed, intended, or used to advertise or inform. "Off-premise commercial sign" means a sign display- ing advertising copy that pertains to a business, person, organization, activity, event, place, Je/c/ordlnen/e~lgn8 Ordinance No. 1994 Page service, or product not principally located or pri- marily manufactured or sold on the premises on which the sign is located. "Portable sign" means a sign which is not affixed or attached to real property by poles, stakes or other members which are placed into the ground, or upon some other type of permanent foundation; including trailer signs, any sign with wheels or skids, and any sign which is constructed so as to sit upon the surface of the ground, without subsurface attachment or extension. Penalty Provision The general penalty provision of Chapter 1, Section 5, of the College Station Code of Ordinances shall apply to violations of this ordinance." II. This ordinance shall become effective from and after its passage in accordance with the City Charter of the City of College Station. PASSED, ADOPTED, and APPROVED this 14th day of January, 1993.
