HomeMy WebLinkAbout1994-2092 - Ordinance - 09/22/1994ORDINANCE NO. 2092 AN ORDINANCE REZONING LOTS 1, 2 AND 3, TIMBER RIDGE THIRD INSTALL- MENT, COLLEGE STATION, BRAZOS COUNTY, TEXAS, A 3 09 ACRE TRACT OF LAND, FROM C-N NEIGHBORHOOD BUSINESS (LOTS 1 AND 2) AND APARTMENT BUILDINGS/HIGH DENSITY (LOT 3) TO C-3 PLANNI::D COMMER- CIAL WHEREAS, on September 22, 1994, the City Council of the City of College Station convened and pursuant to notices prescribed by law, held a public hearing with regard to the application for the rezomng of Lots 1, 2 and 3, Timber Ridge Third Installment, College Station, Brazos County, Texas, a 3 09 acre tract of land located on the northwest corner of Harvey Road and Rhett Butler Drive, College Station, Brazos County, Texas, WHEREAS, Lots 1 and 2 of the above-described property are currently zoned C-N Neighborhood Business, and Lot 3 of the above-described property is currently zoned R-6 Apartment Buildings/High Density, and the current use is vacant land, WHEREAS, the owner of the above-described property, Flagship Development, has applied for the rezoning of the above-descnbed property to C-3 Planned Commer- cial, WHEREAS, the City Council of the C~ty of College Stahon, Texas, heard evidence as to the Iocabon of the property on the northwest corner of the ~ntersectlon of Harvey Road and Rhett Butler Drive, WHEREAS, evidence was presented on retail trade in the area, WHEREAS, evidence was presented concerning the general development m the area over the last several years, WHEREAS, the C~ty Council of the C~ty of College Stabon, Texas, has concluded that there are changed conditions that justify the rezonmg of the subJect property to commercial use, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that Lots 1, 2 and 3 of the above-described property is hereby rezoned from C-N Neighborhood Business (Lots 1 and 2) and R-6 Apart- ment Bu~ld~ngs/High Density (Lot 3) to C-3 Planned Commercial, effective immed~- ately PASSED and APPROVED th~s 22nd day of September, 1994 APPROVED Lynffl~lcilhanby, Mayor ~re Tem W2 WKWMMM�%r POST OAK MALL W MUNSON Timber Ridge Subdivision Lots 1, 2, & 3 3 lots (Total — 3.09 AC) Appl: Paul J.
