HomeMy WebLinkAbout1994-2083 - Ordinance - 08/25/1994ORDINANCE NO. 2083 AN ORDINANCE REZONING A 1.776 ACRE TRACT OR PARCEL OF LAND, LYING AND BEING SITUATED IN THE RICHARD CARTER LEAGUE, ABSTRACT NO 8, COLLEGE STATION, BRAZOS COUNTY, TEXAS, AND BEING A PORTION OUT OF THAT SAME 6.24 ACRE TRACT, CONVEYED FROM BANKUNITED OF TEXAS, FSB, TO SUDHIR PATEL, AS DESCRIBED BY DEED RECORDED IN VOLUME 1969, PAGE 131, OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS, FROM C-1 GENERAL COMMER- CIAL TO C-2 COMMERCIAL-INDUSTRIAL WHEREAS, on August 25, 1994, the City Council of the City of College Station convened and pursuant to notices pro.scnbed by law, held a public heanng with regard to the application for the rezonlng of a 1.776 acre tract or parcel of land lying and being situated in the R~chard Carter League, Abstract No 8, College Station, Brazos County, Texas, and being a portion out of that same 6 24 acre tract, conveyed from BankUnited of Texas, FSB, to Sudh~r Patel, as described by deed recorded ~n Volume 1969, Page 131, of the Official Records of Brazos County, Texas, said 1 776 acre tract being more particularly described as follows' BEGINNING at a 1/2' amn rod found markang the west comer of sa~d 6.24 acre tract and being also the north comer of Lot 1, Harvey Road East Subdiws~on (Amendin{[I Plat), as depicted by plat recorded in VOLUME 1123, PAGE 813 ,,o.f said Official Records, said comer lying also in the southeast line of Sams Subdivision, as depicted by plat recorded ~n VOLUME 1275, PAGE 13 of said Official Records THENCE N 42° 10' 37" E - 170 00 feet w~th the northwest I~ne of said 6.24 acre tract and said southeast line of Sam's Subd~wsion to a 1/2" iron red set for comer THENCE $ 33° 13' 01" E - 470 00 feet across said 6 24 acre tract to a 112" ~ron rod set for comer. THENCE S 42' 18' 37" W - 170.00 feet across sa~d 6 24 acre tract to a 1/2" iron rod found for comer, and being the east comer of said Lot 1, Harvey Road East Subdivision (Amending Plat). THENCE N 33' 13' 01" W - 470 00 feet with the northeast line of sa~d Lot 1 to the PLACE OF BEGINNING, and containing 1 776 acres of land WHEREAS, the above-described property is currently zoned C-1 General Commercial and the current use is vacant land, WHEREAS, the owners of the above-described property, Sudhir D. Patel, M D and Alfred A. Mart~n, d/bla/H;ghway 30 Partnership, have appl;ed for the rezon- ing of the above-descnbed property to Co2 Commercial - Industnal zomng; WHEREAS the C~ty Council of the City of College Station, Texas, heard ev dence as to the location of the property d~rectly adjacent and to the rear of Furrow Building Materials at 1501 East By-Pass, WHEREAS, evidence was presented that Furrow Building Materials ~s seeking to expand ~ts operation, J = ' ~ r~--O~tl~a .t,less Ordinance No. 2083 Page 2 WHEREAS, evidence was presented that the proposed use of the property will be for additional employee parking and for storage of lumber and other building materials; WHEREAS, evidence was presented that the proposed zoning change is in accordance with the Comprehensive Plan, and WHEREAS, the City Council of the City of College Station, Texas has concluded that the development taking place ~n this area is a changed condition that makes the subJeCt property more suited to Commercial - Industrial use; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the above-described property is hereby rezoned from C-1 General Commercial to C-2 Commercia - Industrial, effeCtive mmediately.
