HomeMy WebLinkAbout2014-3558 - Ordinance - 03/13/2014ORDINANCE NO. 2014-3558 AN ORDINANCE AMENDING CHAPTER 1, SECTION 1-23, "CREATION OF A HISTORIC PRESERVATION COMMITTEE", OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Chapter 1, Section 1-23, "Creation of a Historic Preservation Committee", of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 3: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. ORDINANCE NO. 2014-3558 Page 2 EXHIBIT "A" That Chapter 1, Section 1-23, "Creation of a Historic Preservation Committee", of the Code of Ordinances of the City of College Station, Texas, is hereby amended in its entirety as set out hereafter to read as follows: A. Purpose. Although the City of College Station, Texas, does not have a long history, it is important that it be collected and preserved. By acting in a timely manner, the City will be able to capture information before it otherwise would become irretrievable. B. Membership. The committee shall consist of nine (9) members, and where practical may include representation from the Brazos County Historical Society, Texas A&M University, and the College Station City Council. Oversight. The committee shall report directly to the Parks and Recreation Board. The Parks and Recreation Board shall appoint members to the committee. C. Term of office. The term of office shall be for two (2) years, and the Parks and Recreation Board shall appoint members on a staggered basis with five (5) terms expiring in even -numbered years and four (4) terms expiring in odd -numbered years. If a position becomes vacant before the expiration of the position's term, the new appointee shall serve for the balance of the term of his or her predecessor. The Parks and Recreation Board shall appoint all members to fill vacancies. The Parks and Recreation Board shall appoint a chairman during the annual appointment process. If a vacancy occurs in the chairman position, the Parks and Recreation Board shall appoint a replacement to serve as Chairman. D. Duties and Responsibilities. The duties of this committee shall be to aid in the collection and preservation of the history of the City of College Station and its environs, and to provide for education of citizens on the history of this City. The duties and responsibilities of the committee may be expanded, reduced or otherwise modified only as determined by the City Council upon recommendation of the Parks and Recreation Board. The committee shall semi-annually submit a report to the Parks and Recreation Board. ORDINANCE NO.2014-3558 Page 3 E. Meetings. The College Station Historic Preservation Committee shall provide for regular and special meetings as necessary to carry on its business, and is authorized to establish its own rules and by- laws subject to ratification by the Parks and Recreation Board.
