ORDINANCE NO. 2011- 33U I
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD ON NOVEMBER 8, 2011 FOR
THE PURPOSE OF SUBMITTING PROPOSED AMENDMENTS TO THE CITY CHARTER
TO THE VOTERS; ESTABLISHING EARLY VOTING LOCATIONS AND POLLING
PLACES FOR THIS ELECTION; AND MAKING PROVISIONS FOR CONDUCTING THE
ELECTION.
WHEREAS, Section 9.004 of the TEXAS LOCAL GOVERNMENT CODE provides that the
ordinance ordering a charter amendment election shall provide for the election to be held on the
first authorized uniform election date prescribed by the Election Code or on the earlier of the
date of the next municipal general election or presidential general election; and
WHEREAS, pursuant to Section 41.001 of the TEXAS ELECTION CODE November 8, 2011,
is the next prescribed uniform election date; and
WHEREAS, the City Council of the City of College Station, Texas, desires to submit to the
qualified voters of the City at a special election to be held on November 8, 2011, the proposed
amendments to the City Charter set out herein; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
SECTION 1. The above and foregoing premises are true and correct and are
incorporated herein and made a part hereof for all purposes.
SECTION 2. A special election is ordered to be held by the City of College Station (the
"City") at the various polling places and election precincts within the corporate limits of the City,
as hereinafter designated, on November 8, 2011 from the hours of 7:00 a.m. to 7:00 p.m. This
special City election will be conducted jointly with Brazos County and will be administered for
the City by the Brazos County Elections Official, but this special City election is not a county-
wide election. At this election, ballot propositions will be submitted to the qualified voters of the
City for proposed amendments to the City Charter, in accordance with applicable provisions of
the City Charter and State law.
SECTION 3. The following proposed Charter text amendments will be submitted to the
qualified voters of the City at the election, in accordance with Section 9.004 of the Texas Local
Government Code and Sections 131 of the College Station City Charter and other applicable

AMENDMENT NO. 1
SHALL SECTION 17 OF THE CITY CHARTER RELATING TO THE NUMBER,
SELECTION, TERM OF THE CITY COUNCIL BE AMENDED TO READ AS FOLLOWS:
Number, Selection, Term
Section 17. The City Council shall be composed of the Mayor and six (6) Councilmen and be
known as the "City Council of the City of College Station."
(a) The Mayor and other members of the City Council shall be elected from the City at large.
(b) The Mayor shall be the presiding officer of the City Council and shall be recognized as the
head of the City government for all ceremonial purposes and by the Governor for purposes
of military law, but shall have no regular administrative duties. The Mayor shall be entitled
to vote on all matters under consideration by the City Council.
(c) Each Councilman, unless sooner removed under the provisions of this Charter, shall serve
for a term of four 4 three-(3) years, beginning with the first meeting of the Council
following his election, and ending with the first meeting of the Council four 4 three+3)
years later, or until his successor has been elected and duly qualified. The Mayor, unless
sooner removed under the provisions of this Charter, shall serve for a term of four (4 )three
(4) years, beginning with the first meeting of the Council following his election and ending
with the first meeting of the Council four 4 three-(3) years later, or until his successor has
been elected and duly qualified.
(d) No person shall be deemed elected to an office unless that person receives a majority of all
the votes cast for such office. The Council shall, upon declaring the official results of the
election, order a run-off election for each office to which no one was elected. In the run-
off election, the two candidates who received, in the preceding election, the highest number
of votes for each office to which no one was elected, shall be voted on again by the
qualified voters, and the candidate who receives the majority of the votes cast for such
office in the run-off election shall be elected to such office.

serve their terms until May 2015. Beginning with the election in 2015, Places 1, 3 and 5
shall serve for a term of four (4 years.
(f) Be ifmi g i ' °O°, *There shall be no limit to the total number of terms served by the
Mayor or Councilmen; however, no person shall be eligible to be elected to serve in the
capacity of the Councilman for consecutive regular terms totaling more than eight 8 six

(6) years; nor shall any person be eligible to be elected to serve in the capacity of Mayor
for consecutive regular terms totaling more than eight M six-(6) years.
AMENDMENT NO. 2
SHALL SECTION 77 OF THE CITY CHARTER, RELATING TO MUNICIPAL ELECTIONS
BE AMENDED TO READ AS FOLLOWS:
Municipal Elections
Section 77. The regular city election shall be held enin May of odd-numbered _years
date set by ordinance by the City Council, or as otherwise provided by law, at which time
members of the Council shall be elected to fill those offices that become vacant that year. The
City Council shall fix the hours and the place for holding such special election. The City Council
may by resolution, order a special election, fix the time and place for holding same, and provide
all means for holding such special election. In the order, ordinance, or resolution of the City
Council calling any election at which more than one Councilman shall be elected, the City
Council shall in calling such election provide for a separate place on the ballot for each vacant
seat to be filled at such election, designating the Mayor, and such Places as Place No. 1, 2, 3, 4,
5, or 6. If an unexpired term is to be filled at such election, the Place for the unexpired term shall
be so designated.
SECTION 4. The ballots for the City election will conform to the requirements of the
Texas Election Code, and will have the measures described in Section 3 of this Ordinance stated
as propositions as follows:
PROPOSITION NO. 1
FOR/AGAINST Shall the Charter of the City of College Station be amended to provide for
the regular election of the Mayor and City Council to be held in May of odd-numbered years
with the Mayor and City Council serving four (4) year term lengths for no more than eight (8)
consecutive years?
SECTION 5. The polling places for each precinct for this election shall be designated for
each election precinct as determined by the Brazos County Clerk, to be named at a later date.
This ordinance shall be amended at that time to reflect the locations of such polling places.
SECTION 6. Joint early voting shall be conducted by personal appearance and by mail.
The period for early voting by personal appearance for the special election shall be October 24
through November 4, 2011. Optical scan ballots shall be used for early voting by mail and direct
recording electronic voting machines shall be used for early voting by personal appearance. The
Early Voting Clerk for said elections shall be the County Clerk. She shall determine the number
of election workers to hired and arrange for training of all election workers. Early voting by

personal appearance for the special election shall be conducted jointly at the locations and on the
dates and times specified by the Brazos County Clerk, to be named at a later date. This
ordinance shall be amended at that time to reflect such locations and dates and times of early
voting by personal appearance.
SECTION 7. Early voting by mail ballot shall be conducted in accordance with
applicable provisions of the Texas Election Code. The address of 300 E. 26th Street, Suite 120,
Bryan, Texas 77803, shall be the early voting clerk's mailing address to which ballot applications
and ballots voted by mail may be sent for the City.
SECTION 8. All early votes and other votes to be processed in accordance with early
voting procedures pursuant to the Texas Election Code shall be delivered to the Early Voting
Ballot Board at the Brazos County Clerk's office. Early votes shall be counted at the central
counting station. The Early Voting Ballot Board shall perform in accordance with applicable
provisions of the Election Code.
SECTION 9. A Direct Record Electronic ("DRE") System, as the term is defined in the
Texas Election Code, shall be utilized in connection with the election. This system shall be
utilized for all early voting as well as for all precinct voting conducted on election day. The
Brazos County Clerk will appoint a programmer, who shall prepare a program for the automatic
tabulating equipment. Ample voting equipment shall be provided for early voting and in each of
the various precincts on election day. The central counting station is established as the Brazos
Center, 3232 Briarcrest Drive, Bryan, Texas.
SECTION 10.. The Brazos County Clerk will appoint the Early Voting Ballot Board, a
Presiding Judge of the Central Counting Station, a Tabulation Supervisor of the Central Counting
Station, and a Central Counting Station Manager.
SECTION 11. The election will be held in accordance with the provisions of the Charter
and Ordinances of the City of College Station and the laws of the State of Texas.
SECTION 12. An executed copy of this Ordinance will serve as proper notice of the
election.
SECTION 13. Notice of the election, including a Spanish translation thereof, will be
published at least once in a newspaper published in College Station on or after October 9, 2011
and on or before October 31, 2011, and will be posted on the bulletin board at City Hall on or
before October 17, 2011.
SECTION 14. A writ of election as required by the Texas Election Code will be delivered
on or before October 24, 2011 by the Brazos County Clerk to the presiding and alternate judges
of each election precinct in which the election is ordered to be held.
SECTION 15. Testing of the automatic tabulating equipment will be performed and
notice thereof will be given in accordance with Subchapter D of Chapter 127 of the Texas
Election Code.
SECTION 16. The rate of compensation to be paid judges, clerks, and assistants to the
Central Counting Station Presiding Judge and Tabulation Supervisor for services rendered during
the election will be compensated at the rate of no more than $9.00 per hour.
SECTION 17. The additional compensation to be paid judges who deliver returns of the
election is established at $25.00.
SECTION 18. If any portion of this Ordinance is held invalid by a court of competent
jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect.
SECTION 19. That this ordinance shall be effective immediately upon adoption.

ORDENA ELECCIONES ESPECIALES PARA CELEBRARSE EL 8 DE NOVIEMBRE DE
2011 CON EL PROPOSITO DE PRESENTARLE A LOS VOTANTES LAS ENMIENDAS A
LOS ESTATUTOS DE LA CIUDAD; ESTABLECER LOS SITIOS DONDE SE
CELEBRARAN LAS VOTACIONES TEMPRANAS Y LOS CENTROS DE VOTACIONES
PARA ESTAS ELECCIONES; Y PRESENTAR LOS ARREGLOS NECESARIOS PARA
REALIZAR LAS ELECCIONES.
CONSIDERANDO, Que la Seccion 9.004 del CODIGO DEL GOBIERNO LOCAL DE TEXAS
estipula que la ordenanza que ordena elecciones de enmiendas a los estatutos se celebrard en la
primera fecha regular senalada por el Codigo de Elecciones o en la fecha mds temprana de las
proximas elecciones generales municipales o elecciones generales presidenciales; y
CONSIDERANDO, segun la Seccion 41.001 del CODIGO DE ELECCIONES DE TEXAS, el 8
de noviembre de 2011, es la fecha senalada como las siguientes elecciones regulares; y
CONSIDERANDO, que el Consejo de la Ciudad de College Station, Texas, desea presentarle a
los residentes de la Ciudad que cumplen los requisitos para votar en las elecciones especiales
celebradas el 8 de noviembre de 2011, las enmiendas propuestas a los Estatutos de la Ciudad
mencionadas en este documento; ahora, por tanto,
QUE SE ORDENE POR EL CONSEJO DE LA CIUDAD DE COLLEGE STATION,
TEXAS:
SECCI6N 1. Las premisas anteriores son verdaderas y correctas y se encuentran en el
presente documento y son parte de el para todo proposito.
SECCI6N 2. Se ordenan elecciones especiales a celebrarse por la Ciudad de College
Station (la "Ciudad") en los diferentes centros de votaciones y distritos electorales dentro de los
limites corporativos de la Ciudad, como se designa en este documento, el 8 de noviembre de
2011 de las 7:00 a.m. a las 7:00 p.m. Estas elecciones especiales de la Ciudad se celebraran
conjuntamente con el Condado de Brazos y sera administrado para la Ciudad por el Oficial de las
Elecciones del Condado de Brazos, pero estas elecciones especiales de la Ciudad no serdn
elecciones para todo el condado. En estas elecciones, las propuestas en las boletas serdn

los estatutos de la Ciudad, de acuerdo con las provisioner aplicables de los Estatutos de la
Ciudad y de la ley Estatal.

calificados para votar en las elecciones de la Ciudad, de acuerdo con la Seccion 9.004 del C6digo
del Gobierno Local de Texas y con las Secciones 131 de los Estatutos de la Ciudad de College

ENMIENDA NO. 1
LA SECCION 17 DE LOS ESTATUTOS DE LA CIUDAD RELACIONADOS AL NOMERO,
SELECCION, Y TERMINO DEL CONSEJO DE LA CIUDAD SERA ENMENDADA DE LA
SIGUIENTE MANERA:

Secci6n 17. El Consejo de la Ciudad estard compuesto por el Alcalde y seis (6) Consejeros; y se
conocerdn como el "el Consejo de la Ciudad de College Station."
(a) El Alcalde y otros miembros del Consejo de la Ciudad serdn electos por todos los
residentes calificados de la Ciudad.
(b) El Alcalde sera el oficial que presidird el Consejo de la Ciudad y se le reconocerd como la
mdxima autoridad del gobierno de la Ciudad para los propositos ceremoniales y por el
gobernador, para propositos militares; pero no tendrd a su cargo tareas administrativas
regulares. El Alcalde podrd votar en todos los asuntos considerados en el Consejo de la
Ciudad.
(c) Cada Consejero, a menos que sea removido bajo las provisioner de estos Estatutos, servird

despues de las elecciones, y terminando con la primera reunion del Consejo cuatro 4 -tres
(3) anos despues, o hasta que su sucesor sea electo y complete todos los requisitos debidos.
El Alcalde, a menos que sea removido bajo las provisiones de estos Estatutos, servird un
periodo de cuatro 4 ) anos, comenzando con la primera reuni6n del Consejo

oficiales, deberd ordenar elecciones de segunda vuelta para cada puesto al cual ningun
miembro fue electo. En elecciones de segunda vuelta, los dos candidatos para cada puesto
que recibieron el mayor numero de votos en las elecciones anteriores donde ninguna
persona fue electa, entrardn en las elecciones nuevamente, y el candidato que reciba la
mayoria de votos emitidos para dicho puesto en las elecciones de segunda vuelta, sera
electo para dicho puesto.

En el ano 2012, el Alcalde y los Puestos 2, 4 y 6 completardn sus
cargos hasta el mes de mayo de 2013. Comenzando con las elecciones del ano 2013, el
Alcalde y los Puestos 2 4 y 6 servirdnpor un periodo de cuatro (4) anos. En el ano 2012,
los Puestos 1 3 y 5 completardn sus cargos hasta el mes de mayo de 2015. Comenzando
con las elecciones del ano 2015, los Puestos 1 3 y 5 servirdn por un periodo de cuatro (4)
anos.
(f) Comenzande en el aAe ' °°O, _no habrd limite del numero total de periodos servidos por el
Alcalde o los Consejeros; sin embargo, ninguna persona podrd ser electa para servir como
Consejero por periodos consecutivos regulares que sumen mds de ocho 8 Deis-(6) anos; ni

ENMIENDA NO. 2
LA SECCION 77 DE LOS ESTATUTOS DE LA CIUDAD, RELACIONADOS CON LAS
ELECCIONES MUNICIPALES SERA ENMENDADA DE LA SIGUIENTE MANERA:
Elecciones Municipales
Seccion 77. Las elecciones regulares de la ciudad serdn celebradas en en el mes de mayo de
anos impares n feeh s anuales seg6n to establecido como reglamento por el Consejo de la
Ciudad, o de otra manera requerido por ley, en el cual se eligirdn a aquellos miembros del
Consejo para ocupar los puestos vacantes de ese ano. El Consejo de la Ciudad fijard el horario y
el lugar donde se realizaran dichas elecciones especiales. El Consejo de la Ciudad podrd ordenar
elecciones especiales por resoluci6n, fijar la hora y el lugar para realizarlas, y proporcionar todos
los medios para celebrar dichas elecciones especiales. En la orden, la ordenanza [reglamento], o
la resoluci6n del Consejo de la Ciudad convocando cualquier tipo de elecciones en el cual mds
de un Consejero serd electo, el Consejo de la Ciudad proporcionard, al convocar dichas
elecciones, una pane de la boleta para cada puesto vacante a ocupar en dichas elecciones,
designando al Alcalde, y los Puestos No. 1, 2, 3, 4, 5, 6 6. Si se tiene que ocupar un puesto en
dichas elecciones con periodo sin expirar, el Puesto para el periodo sin expirar sera designado.

SECCION 4. Las boletas electorales de la Ciudad seran ajustadas para cumplir con los
requisitos del C6digo Electoral de Texas, y tendrd las medidas descritas en la Secci6n 3 de este
Reglamento, descritas como propuestas siguientes:
PROPOSITION NO. 1
~VOTAR POR/EN CONTRA DE que los Estatutos de la Ciudad of College Station sean
enmendados para convocar elecciones regulares para elegir al Alcalde y al Consejo de la Ciudad
para celebrarse en mayo de los anos impares donde el Alcalde y el Consejo de la Ciudad sirvan
periodos de cuatro (4) anos y no mds de ocho (8) anos consecutivos?
SECCION 5. Los centros de votaciones de cada distrito en estas elecciones seran
asignados para cada distrito electoral como to determine el Oficial del Condado de
Brazos, el cual se nombrard en una fecha posterior. Esta ordenanza sera enmendada en
ese momento para reflejar los lugares de dichos centros de votaciones.
SECCION 6. Las elecciones tempranas conjuntas seran en persona y por correo. El
periodo para las votaciones tempranas en persona y por correo para elecciones especiales sera del
24 de octubre al 4 de noviembre de 2011. Las boletas electorales de escaneo 6ptico seran
utilizadas para las votaciones tempranas en persona. El Oficial de las Votaciones Tempranas para
dichas elecciones sera el Oficial del Condado. Ella determinard el numero de personas a
contratar y hard los arreglos necesarios para la capacitaci6n de todas las personas contratadas
para trabajar en las elecciones. Las votaciones tempranas en persona para las elecciones
especiales seran conducidas conjuntamente en los lugares y en las fechas y horarios
especificados por el Oficial del Condado de Brazos, a nombrarse en una fecha posterior. Este
reglamento serd enmendado en ese momento para reflejar los lugares de dichos centros de
votaciones.
SECCION 7. Las boletas de votaciones tempranas por correo seran organizadas de
acuerdo a las provisiones aplicables del C6digo de Elecciones de Texas. La siguiente direcci6n
300 E. 26'" Street, Suite 120, Bryan, Texas 77803, serd la direcci6n de correo del oficial de las
votaciones tempranas donde se podran enviar a la Ciudad las solicitudes de boletas y boletas
emitidas por correo.
SECCION 8. Todas las votaciones tempranas y otras votaciones a ser procesadas de
acuerdo con los procedimientos de las votaciones tempranas segun el C6digo de Elecciones de
Texas, seran entregadas a la Junta de Boletas de Votaciones Tempranas en la oficina del Oficial
del Condado de Brazos. Las votaciones tempranas seran contadas en la estaci6n central de

conteo. La Junta de Boletas de Votaciones Tempranas se conducird de acuerdo a las provisiones
aplicables del Codigo de Elecciones.
SECCION 9. Un Sistema de Registro Electronico Directo ("DRE, por sus siglas en el
idioma ingles"), como se define el termino en el Codigo de Elecciones de Texas, se utilizard en
conexion con las elecciones. Este sistema se utilizard para todas las votaciones tempranas asi
como tambien para todos los distritos electorales donde se realizardn las votaciones en el dia de
las elecciones. El Oficial del Condado de Brazos nombrard a un programador, quien preparard un
programa para el equipo de tabulacion automdtica. Estardn disponibles suficientes mdquinas para
las votaciones tempranas y tambien en cada uno de los distritos electorales el dia de las
elecciones. La estacion central de conteo se establecerd en la direccion siguiente: The Brazos
Center, 3232 Briarcrest Drive, Bryan, Texas.
SECCION 10.. E1 Oficial del Condado de Brazos nombrard a la Junta de Boletas de
Votaciones Tempranas, a un Juez que presidird la Estacion Central de Conteo, a un Supervisor
de Tabulacion para la Estacion Central de Conteo, y a un Encargado de la Estacion Central de
Conteo.
SECCION 11. Las elecciones se celebrardn de acuerdo a las provisiones de los Estatutos
y Ordenanzas de la Ciudad of College Station y de las leyes del Estado de Texas.
SECCION 12. Una copia suscrita de esta Ordenanza servird como notificacion apropiada
de las elecciones.
SECCION 13. Una notificacion de las elecciones, incluyendo una traduccion de ella al
idioma espanol, sera publicada en por to menos un periodico editado en College Station el dia 9
de octubre de 2011 o despues de esa fecha y antes de o el dia 31 de octubre de 2011, y se pondrd
una copia en el boletin informativo de la Municipalidad de la Ciudad el dia 17 de octubre de
2011 o antes.
SECCION 14. El Oficial del Condado de Brazos, el dia 24 de octubre de 2011 o antes,
les entregard una orden de elecciones, requerida por el Codigo de Elecciones de Texas, al juez
que preside y a los jueces alternos de cada distrito electoral donde se ordenan elecciones.

SECCION 15. Se probard el equipo de tabulaci6n automdtica y su respectiva notificaci6n
se hard de acuerdo al Subcapitulo D del Capitulo 127 del C6digo de Elecciones de Texas.
SECCION 16. La tasa de compensaci6n de pago a los jueces, oficiales, y asistentes al
Supervisor de Tabulaci6n y al Juez que Preside la Estaci6n Central de Conteo, por servicios
proporcionados durante las elecciones sera de no mds de $9.00 la hora.
SECCION 17. La compensaci6n adicional pagada a los jueces que entregan los
resultados de las elecciones se fija en $25.00.
SECCION 18. Si alguna parte de esta Ordenanza se declara invdlida por una corte
competente con jurisdicci6n, las provisioner restantes de esta Ordenanza permanecerdn en
vigencia.
SECCION 19. Que esta Ordenanza entrard en efecto inmediatamente despu6s de adoptada.
APROBADA Y ADOPTADA por el Consejo de la Ciudad de College Station este I Iv' dia
