AN ORDINANCE AUTHORIZING A GENERAL (REGULAR) MUNICIPAL ELECTION
TO BE HELD ON MAY 14, 2011, FOR THE PURPOSE OF ELECTING A CITY
COUNCILMEMBER, PLACE 1, A CITY COUNCILMEMBER, PLACE 3, AND A CITY
COUNCILMEMBER, PLACE 5, BY THE QUALIFIED VOTERS OF THE CITY OF
COLLEGE STATION; AUTHORIZING A JOINT ELECTION WITH THE COLLEGE
STATION INDEPENDENT SCHOOL DISTRICT TO BE HELD ON MAY 14, 2011;
AUTHORIZING THE CITY SECRETARY TO ARRANGE AN EQUITABLE BASIS FOR
SHARING THE COSTS OF THE JOINT ELECTION; DESIGNATING ELECTION
PRECINCTS; APPOINTING ELECTION OFFICIALS; ESTABLISHING PAY RATES FOR
ELECTION WORKERS; PROVIDING FOR NOTICE OF SAID ELECTION; PROVIDING
FOR THE USE OF DIRECT RECORDING ELECTRONIC VOTING MACHINES;
PROVIDING FOR EARLY VOTING; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION:
Section 1. That a general (regular) municipal election is hereby ordered to be held on the
14th day of May, 2011, for the purpose of electing a City Councilmember, Place 1, a City
Councilmember, Place 3, and a City Councilmember, Place 5, by the qualified voters of the City of
College Station, respectively.
Section 2. Should any candidate in the general municipal election fail to receive a majority
vote, then in that event a runoff election shall be ordered for every place in the regular municipal
election to which no one was elected as required by Section 17 (d) of the City Charter, as amended.
In the event it becomes necessary to conduct a runoff election, it shall be held on Saturday, June 25,
2011. Canvass of the returns of the runoff election, if necessary, shall be held no earlier than the 81h
day no later than the I 1 t" day following the date of the runoff election.
Section 3. That the election be held jointly with the College Station Independent School
District on May 14, 2011, pursuant to Section 271, Texas Election Code. The costs of said election
are to be shared by the two governmental entities and the City Secretary is authorized to arrange the
City's share of said costs on a fair and equitable basis.
Section 4. The polls for said election shall be open from 7:00 a.m. to 7:00 p.m.
Section 5. The City Secretary is expressly authorized to obtain election supplies and
equipment required by law and necessary to conduct said election.
Section 6. The Office of the City Secretary shall perform all duties normally performed by
the County Clerk in general elections with respect to early voting, giving notice of the election and
preparing the official ballots.

Section 8. In addition to the presiding judge and alternate judge for each precinct herein
above designated, the respective presiding judge for each precinct and the Early Ballot Board as
herein provided, shall be authorized to appoint a sufficient number of clerks as they may deem
necessary to assist them in said election, provided, however, that the number of clerks appointed by

said presiding judge for each polling place shall not be less than two, including the alternate judge
also serving as a clerk.
Section 9. That the City Council hereby authorizes the City Secretary to appoint
substitute elections judges in the event individuals appointed herein are unable to fulfill their
duties.
Section 10. The judges and clerks shall be compensated at the rate of nine dollars ($9.00) per
hour. No judge or clerk shall be paid for more than two hours of work before the polls open and no
period of time subsequent to two hours after voting is concluded by all voters offering themselves
for voting during regular voting hours, whichever is later. The judge who delivers the returns of the
election shall be paid an additional twenty-five dollars ($25.00) provided he/she also returns all
unused election supplies when he/she makes delivery of the returns of the election.
Section 11. Direct recording electronic voting machines shall be used for voting at the
foregoing election precincts and electronic counting devices and equipment shall be used for
counting the ballots at said election.
Section 12. Early voting shall be conducted by personal appearance and by mail. The
period for early voting for the general election shall be May 2, 2011 through May 10, 2011.
Optical scan ballots shall be used for early voting by mail and direct recording electronic voting
machines shall be used for early voting by personal appearance. The Early Voting Clerk for
said elections shall be the City Secretary. She shall appoint city employees and additional
assistance by qualified individuals of the community to serve as deputy early voting clerks to
assist her at the early voting polling places. The Election Coordinator for the College Station
Independent School District shall serve as Deputy Early Voting Clerk in said elections. The main
early voting polling place by personal appearance shall be in City Hall, 1101 Texas Avenue,
College Station, Texas. One branch early voting location shall be designated for these elections.

Section 13. An Early Ballot Board is hereby designated to canvass the early votes cast by
mail and by personal appearance. Kay Parker is duly appointed as Presiding Judge of said
Board, and she shall appoint two clerks or more to count the early ballots and perform other
duties as assigned by the Election Code.

Section 14. The following slate of officials and other designated persons are hereby
authorized to be present at the Central Counting Station to observe the election counting process:
a. The Mayor and members of the City Council of the City of College Station;
b. The President and members of the Board of Trustees of the College Station Independent
School District and/or authorized administrator;
c. Representatives of Hart Intercivic and Texas Voting Systems, Inc.;
d. The Secretary of State and/or her authorized representative;
e. Candidates for City Council of the City of College Station and the candidates for the Board
of Trustees of the College Station Independent School District;
f. The College Station City Secretary or her designated representative.
Section 15. The Council Chambers located in the College Station City Hall is hereby
established as the Central Counting Station to receive and tabulate votes and ballots cast in said
election.
Section 16. That the Council Chambers in the College Station City Hall is hereby
established as the Central Counting Station to receive ballots for said election. The ballots shall
be tabulated and returned to the office of the City Secretary for the required retention period.
The following persons are hereby authorized and appointed as persons employed and designated
to handle the ballots, operate the tabulating equipment, count the ballots, and be present in the
Central Counting Station.

Section 17. A committee is hereby established of the following persons to hold three
computer accuracy tests. The first test shall be conducted at least 48 hours before the count of voted
ballots. The second test shall be conducted immediately prior to the start and the third test
immediately subsequent to the count of voted ballots to ascertain that the computer will accurately
count the votes cast for the offices to be voted upon in said election:

Section 18. The Mayor is authorized to sign an Order of Election and a Notice of Regular
Municipal Election prescribed by the State of Texas on behalf of the City Council. The Notice of

Regular Municipal Election shall be published in accordance with the provisions of the Texas
Election Code and the City Charter.
Section 19. Should any part, section, subsection, paragraph, sentence, clause or phrase
contained in this resolution be held to be unconstitutional or of no force and effect, such holding
shall not affect the validity of the remaining portion of this resolution, but in all respects said
remaining portion shall be and remain in full force and effect.
Section 20. That this ordinance shall be effective immediately upon adoption.

EL CONSEJO DE LA CIUDAD DE COLLEGE STATION POR LO TANTO ORDENA:
Secci6n 1. Que se ordena que se celebren elecciones municipales generales (regulares) el 14a"° dfa de
mayo de 2011, para el prop6sito de elegir a un Miembro del Consejo Puesto n6mero 1, a un Miembro del
Consejo Puesto n6mero 3, y un Miembro del Consejo Puesto n6mero 5, por los votante calificados de la
Ciudad de College Station, respectivamente.
Secci6n 2. Si alg6n candidato en las elecciones generales municipales no recibiera una mayorfa de
votos, entonces en esa ocasi6n se ordenaran elecciones de segunda vuelta para cada puesto en las elecciones
regulares municipales en las cuales nadie fue elegido come se requiere en la Secci6n 17 (d) de los Estatutos
de la Ciudad, segun enmendada. En caso fuera necesario conducir elecciones de segunda vuelta, se
celebraran el sabado 25 dejunio de 2011. El escrutinio de los votos de las elecciones de segunda vuelta, si
fuera necesario, no se haran antes del 8"° dfa y a mas tardar el 11V0 dfa de la fecha de elecciones de segunda
vuelta.
Secci6n 3. Que las elecciones se celebraran conjuntamente con el Distrito EscolarIndependiente de
College Station el 14 de mayo de 2011, seg6n la Secci6n 271, C6digo Electoral de Texas. El costo de dichas
elecciones sera compartida entre las dos entidades gubemamentales y la Secretaria de la Ciudad esta
autorizada para hacer los arreglos necesarios de la parte de la Ciudad de dichos costos conforme bases
equitativos y justos.
Secci6n 4. Los Centros de Votaciones para dichas elecciones se abrirdn desde las 7:00 a.m. hasta las
7:00 p.m.
Secci6n 5. La Secretaria de la Ciudad esta expresamente autorizada para obtener los materiales y el
equipo requeridos por ley para las elecciones y necesarios para conducir dichas elecciones.
Secci6n 6. La Oficina de la Secretaria de la Ciudad realizara todas las operaciones realizadas
normalmente por el Funcionario del Condado en las elecciones generales en to que se relaciona a las

Secci6n 8. Ademas del juez que preside y el juez altemo para cada distrito designado anteriormente
en la presente ordenanza, el juez que preside respectivo de cada distrito y la Junta de Boletas Tempranas
come se determina en la presente, sera autorizado para nombrar al numero suficiente de empleados electorales
come crean necesario para asistirlos en dichas elecciones, siempre y cuando, no obstante, que el n6mero de
empleados electorales nombrados por dicho juez que preside cada distrito electoral no serA menos de dos,
incluyendo eljuez altemo sirviendo come, empleado.
Secci6n 9. Que el Consejo de la Ciudad per este medio autoriza a la Secretaria de la Ciudad a
nombrar jueces electorales sustitutos por si los individuos nombrados en este documento no puedan cumplir
con sus obligaciones.
Secci6n 10. Los jueces y los empleados electorales seran remunerados a una tasa de nueve d6lares
($9.00) la hora. A ningun juez o empleado electoral se le pagarA mas de dos horas de trabajo antes de que
abran los centros de votaciones y no mas de dos horas despuds de concluidas las votaciones por todos los
votantes que quieran votar durante el horario regular de votaciones, cualquiera sea mas tarde. El juez que
entrega las boletas de las elecciones se le pagara una cantidad adicional de veinticinco d6lares ($25.00)
siempre y cuando tambidn devuelva todos los materiales de las elecciones no utilizados cuando haga la
entrega de las boletas de las elecciones.
Secci6n 11. Las maquinas electorales electr6nicas de registro directo se utilizaran para las votaciones
en los distritos mencionados anteriormente y el equipo y las maquinas de conteo electr6nico se utilizaran para
contarlas boletas en dichas elecciones.
Seccion 12. Las Votaciones Tempranas seran conducidas en persona y per correo. El periodo de
votaciones tempranas para las elecciones generales serA del 2 de mayo de 2011 al 10 de mayo de 2011. Las
boletas de escaneo 6ptico se utilizaran para las votaciones tempranas per correo y las maquinas de registro
electr6nico directo se utilizaran paras las votaciones tempranas en persona. La Encargada de las Elecciones
Tempranas para dichas elecciones sera la Secretaria de la Ciudad. Ella denominarA a los empleados de la
ciudad y la asistencia adicional proporcionada por individuos calificados de la comunidad para servir como
asistentes de la Encargada en las votaciones tempranas en los centros de votaciones. El Coordinador de las
Elecciones para el Distrito Escolar Independiente de College Station servird como el Asistente de la
Encargada de las Elecciones Tempranas en dichas elecciones. El lugar principal para votar en persona sera la
Municipalidad, 1101 Texas Avenue, College Station, Texas. Una sucursal para las elecciones tempranas sera

Seccion 11. La Junta de Boletas Tempranas por este medio se encuentra designada para el escrutinio de las

que Preside dicha Junta, y nombrara a dos o mas empleados electorales para contar las boletas y realizar otras
responsabilidades como sean asignadas por el C6digo Electoral.

Secci6n 14. La siguiente lista de oficiales y otros individuos designados por este medio se encuentran
autorizados para estar presentes in la Estaci6n Central de Conteo para observar el proceso de conteo electoral:
a. El Alcalde y los miembros del Consejo de la Ciudad de College Station;
b. El Presidente y los miembros de la Junta Directiva del Distrito Escolar Independiente de College
Station y/o un administrador autorizado;
c. Representantes de las companias Hart Intercivic y Texas Voting Systems, Inc.;
d. El Secretario de Estado y/o su representante autorizado;
e. Candidates para el Consejo de la Ciudad de College Station y los candidates para la Junta Directiva
del Distrito Escolar Independiente de College Station;
f. La Secretaria de la Ciudad de College Station o su representante designado.
Secci6n 15. El sal6n de conferencias del Consejo localizado en la Municipalidad de College Station
per este medio queda designado como la Estaci6n Central de Conteo para recibir y tabular los votos y boletas
llenadas en dichas elecciones.
Secci6n 16. Por este medio se establece que el sal6n de conferencias del Consejo, localizado en la
Municipalidad de la Ciudad de College Station, sera la Estaci6n Central de Conteo para recibir boletas para
dichas elecciones. Las boletas se tabularan y seran retornadas a la oficina de la Secretaria de la Ciudad para el
periodo de retenci6n necesaria. Las siguientes personas por este medio se encuentran autorizadas y nombradas
como personas empleadas y designadas para manejar las boletas, operar el equipo de tabulaci6n, conteo de
boletas, y estar presente en la Estaci6n Central de Conteo.

Notificaci6n de Elecciones Municipales Regulates sera publicada de acuerdo con las provisioner del C6digo
Electoral de Texas y los Estatutos de la Ciudad.

Seccion 19. Si alguna parte, seccion, sub-seccion, parrafo, oracion, clausula o frase contenida en esta
resolucion se encuentra inconstitucional o sin efecto, entonces dicha parte no afectara la validez del resto de
esta resolucion, pero en todo respecto la parte que queda permanecera en efecto.
Seccidn 20. Esta ordenanza tomara efecto inmediatamente despues de adoptada.

I. Se celebraran elecciones generales el 14 de mayo de 2011 con el prop6sito de elegir a un
Miembro del Consejo de la Ciudad para el Puesto numero 1, a un Miembro del Consejo
de la Ciudad para el Puesto numero 3, y a un Miembro del Consejo de la Ciudad para el
Puesto niunero 5.
2. Se celebraran elecciones especiales el 14 de mayo de 2011 con el prop6sito de destituir al
Alcalde Nancy Berry, al Miembro del Consejo de la Ciudad Katy-Marie-Lyles, Puesto
numero 4, y al Miembro del Consejo de la Ciudad Dave Ruesink, Puesto niunero 6.

4. Los centros de votaciones estaran abiertos de 700 a.m. a 7:00 p.m. el dia de las
elecciones.
5. Las votaciones tempranas se realizaran en persona y por correo. El periodo de votaciones
tempranas para las elecciones generales sera del 2 de mayo de 2011 al 10 de mayo de 2011. Las
boletas de escaneo 6ptico se utilizaran para las votaciones tempranas por correo y las maquinas
de votar por registro electr6nico directo se utilizaran paras las votaciones tempranas en persona.
La Encargada de las Elecciones Tempranas para dichas elecciones sera la Secretaria de la Ciudad.
Ella nombrarA a los empleados de la ciudad para servir como asistentes de la Encargada en las
votaciones tempranas en los centros de votaciones y a Ins individuos calificados de la comunidad
para la asistencia adicional. El Coordinador de las Elecciones para el Distrito Escolar
Independiente de College Station servirA como el Asistente de la Encargada de las Elecciones
Tempranas en dichas elecciones. El lugar principal para votar en persona serA la Municipalidad
de la Ciudad, 1101 Texas Avenue, College Station, Texas. Una sucursal para las elecciones
tempranas serA designada para estas elecciones.
