RESOLUTION NO. 06-09-11-2f
RESOLUTION DETERMINING NEED
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, RELATING TO: (1) THE AUTHORITY OF THE CITY TO INITIATE, COMPLETE,
AND ACQUIRE, BY PURCHASE OR CONDEMNATION, EASEMENT INTEREST IN
CERTAIN PROPERTY FOR AN AUTHORIZED PUBLIC PURPOSE AND USE, SAME
BEING THE CONSTRUCTION, MAINTENANCE AND OPERATION OF THE LINCOLN
AVENUE SIDEWALK PROJECT; (2) A DECLARATION THAT PUBLIC NECESSITY
EXISTS FOR THE CITY TO ACQUIRE SUCH INTEREST, THROUGH PURCHASE OR
CONDEMNATION; AND (3) ESTABLISHING PROCEDURES FOR THE ACQUISITION
OF SUCH INTEREST IN THE PROPERTY.
WHEREAS, the City of College Station, Texas ("City") is a home rule municipality duly
incorporated and chartered under the Constitution and laws of Texas; and
WHEREAS, the City owns, operates, constructs, repairs and maintains a sidewalk system as a
public service; and
WHEREAS, the City's ownership, operation, construction, repair, and maintenance of the
sidewalk system is a benefit to the public; and
WHEREAS, the City, through a condemnation proceeding, may exercise the power of eminent
domain to acquire property in order to carry out the ownership, operation, construction, repair,
and maintenance of its sidewalk system pursuant to Chapter 251 of the Texas Local Government
Code, Chapter 21 of the Texas Property Code, and Article II of the City's Charter; and
WHEREAS, the City is engaged in the following project regarding improvements to Lincoln
Avenue, west of Avenue A to the west of Munson Avenue, including construction of a sidewalk
and retaining walls, Lincoln Avenue Sidewalk Project no. ST-0910 (the "Project"); and
WHEREAS, the City determines that the best interests and needs of the public, including the
health, safety and welfare of the public, require that the City complete the Project, through the
City's acquisition, by purchase or condemnation proceeding, of the easements as provided in
Exhibit "A", attached hereto and incorporated herein by reference for all purposes (the
"Easements"); now, therefore;
BE IT RESOLVED by the City Council of the City of College Station, Texas:
PART l: That the City Council of the City of College Station, Texas, hereby officially
determines that there is a public necessity for the Easements, and the public
welfare and convenience will be served by the acquisition of the Easements.

PART 2: That the City Manager is hereby authorized to contract, on behalf of the City of
College Station, with a professional appraiser for the appraisal services, with a
professional real estate agent to act as a Land Agent for the City and with
attorneys for preparation of title opinions needed by the City from time to time in
connection with acquisition of the Easements.
PART 3: That the City's Land Agent or other staff appraiser is hereby authorized and
directed to examine the independent appraisal reports as they are submitted to the
City to determine whether said appraisal reports are supported by sufficient data.
Based upon such examination of said appraisal reports, the Land Agent or other
staff appraiser shall make a recommendation to the City Manager as to the
establishment and approval of the amount of the just compensation for the
Easements.
PART 4: After consideration of said recommendation, the City Manager shall establish and
approve the amount determined for acquisition of the Easements.
PART 5: Upon establishment and approval by the City Manager of the amount of just
compensation for the acquisition of the Easements, the City's Land Agent or other
staff appraiser is authorized to communicate a written offer to the property owners
for the acquisition of such interest at the full amount determined and established
to be just compensation therefore and to negotiate with said owners on behalf of
the City.
PART 6: That the Mayor after approval by City Council, or the City Manager as delegated,
is hereby authorized to execute all documents necessary to acquire said
Easements for the Project, on behalf of the City of College Station.
PART 7: That, if necessary, and should a property owner fail to accept a bona fide, good
faith offer from the City to purchase the required Easements, City representatives
shall have the authority to initiate and complete condemnation proceedings
against said owner, in order to acquire through condemnation all required
property interests and title regarding such property.
PART 8: That the City Manager be and is hereby authorized to sell any such surplus
improvements, or order the demolition thereof, if any, located on the real property
acquired in connection with this Project.
PART 9: That this resolution shall take effect immediately from and after its passage.

All that certain tract or parcel of land lying and being situated in the Richard Carter League,
Abstract No. 8, in College Station, Brazos County, Texas, being a part of Lot 5-1 of the D.A.
Smith Subdivision as described by plat recorded in Volume 4586, Page 78 of the Official Public
Records of Brazos County, Texas, being the southeast ten feet (10') of said Lot 5-1, adjoining the
right-of-way of Lincoln Avenue, and being more particularly described as follows:
Beginning at the most easterly corner of said Lot 5-1, in the southwest right-of-way line of
Avenue A and northwest line of Lincoln Avenue, falling within a concrete gutter, from where the
City of College Station 1994 GPS control monument no. 122 bears N 6° 30' 4T' W - 2286.2 feet.
Thence S 41° 30' 03" W - 149.77 feet along southeast line of said Lot 5-1, also being the
northwest line of Lincoln Avenue, to the most southerly corner of said Lot 5-1;
Thence N 48° 39' 38" W -10.00 feet, along the southwest line of said Lot 5-1, passing an' X" on
concrete marking the east corner of that 1.22 acre tract conveyed to the City of College Station by
deed recorded in Volume 8841, Page 232 of the Official Public Records of Brazos County, Texas
at 0.4 feet, and passing a '/z" iron rod found at 3.4 feet, to the most westerly corner of this
easement tract;
Thence N 41 ° 30' 03" E -149.79 feet, through said Lot 5-1, parallel to and ten (10') feet from the
southeast line of same, to the said southwest line of Avenue A;
Thence S 48° 30' 28" E - 10.00 feet, to the Point of Beginning and containing 1498 square feet of
land more or less.

Records of Brazos County, Texas, being the southeast portion of said Lot 6-11, adjoining the
right-of-way of Lincoln Avenue, and being more particularly described as follows:
Beginning at the most southerly corner of said Lot 6-11, at a 5/8" iron rod with a yellow plastic
stamped "KERR RPLS 4502" found in the northwest right-of-way line of Lincoln Avenue, from
where the City of College Station 1994 GPS control monument no. 122 beats N 8° 18' 57" W -
2219.3 feet.
Thence N 48° 29' 57" W - 10.00 feet, along the common line of said Lot 6-11 and Lot 6-12 as
described by plat recorded in Volume 3011, Page 91 of the Official Public Records of Brazos
County, Texas, to the most westerly comer of this easement tract;
Thence N 41° 30' 03" E - 35.93 feet, through the said Lot 6-11, to the most northerly corner of
this easement tract in the west right-of-way line (arc) of Nimitz Street;
Thence along the said right-of-way, an arc to the right (clockwise) with a radius of 28.00 feet,
through a central angle of 401 35' 20", the chord of which bears S 9° 58' 41" W - 19.42 feet, to
the end of said curve in the said northwest line of Lincoln Avenue;
Thence S 41° 57' 36" W -19.38 feet, along the southeast line of said Lot 6-11 and northwest line
of Lincoln Avenue, to the Point of Beginning and containing 302 square feet of land more or less.

All that certain tract or parcel of land lying and being situated in the Richard Carter League,
Abstract No. 8, in College Station, Brazos County, Texas, being a part of Lot 1 of Joe Pasler's
Subdivision as described by plat recorded in Volume 91, Page 583 of the Deed Records of Brazos
County, Texas, being the southeast portion of said Lot 1, adjoining the right-of-way of Lincoln
Avenue, and being more particularly described as follows:
Beginning at the most northerly corner of this easement tract, in the occupied common line of the
said Pasler's Subdivision and the Lauterstein Addition as described by plat recorded in Volume 6,
Page 128-A of the Mechanic's Lien Records of Brazos County, Texas, at a point from where a
wood fence corner post bears N 48° W -1.0 foot, a 3/8" iron rod was found S 221 05' E - 4.0 feet,
and the City of College Station 1994 GPS control monument no. 122 bears N 29° 34' 03" W -
1785.9 feet.
