Home My WebLink About2012-3452 - Ordinance - 10/11/2012 • ORDINANCE NO. 20 12 -3 )4 5 2, AN ORDINANCE MAKING CERTAIN AFFIRMATIVE FINDINGS AND VACATING AND ABANDONING A 4,809 SQUARE FOOT PORTION OF THE BARRACKS II PARKLAND TRACTS 3 AND 4 FOR USE AS NEEDED PUBLIC RIGHT OF WAY, SAID PORTION BEING A PART OF THE BARRACKS II SUBDIVISION, ACCORDING TO THE PLAT RECORDED IN VOLUME 10570, PAGE 293 OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS. WHEREAS, the City of College Station, Texas, has received an application for the vacation and abandonment of portions of the Barracks II Parkland Tracts 3 and 4 for use as additional needed public right -of -way, said portion being a part of the Barracks II Subdivision, according to the plat recorded in Volume 10570, Page 293, of the Official Records of Brazos County, Texas, as described in Exhibit "A" attached hereto (such portion hereinafter referred to as the "Parkland "); and WHEREAS, in accordance with applicable law, a notice and a public hearing was held where anyone who wanted to speak on the subject matter did so; and WHEREAS, in order for the Parkland to be vacated, abandoned and used for a different • public purpose the City Council must make certain affirmative findings in accordance with Chapter 26 of the Texas Parks and Wildlife Code; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That the facts and recitations set forth in the preamble of this ordinance are hereby declared true and correct. PART 2: The City Council finds the following pertaining to the vacating and abandoning of the Parkland for use as additional needed public right -of- way: 1. There is no feasible and prudent alternative to the use or taking of the Parkland for right -of -way; and 2. That all reasonable planning to minimize harm to the land, as a park, recreation area, scientific area, wildlife refuge, or historic site, resulting from the use or taking for right -of -way has occurred.
