HomeMy WebLinkAbout2012-3412 - Ordinance - 04/26/2012 ORDINANCE NO. 2012-34/1.2, AN ORDINANCE AMENDING CHAPTER 4, "BUSINESS REGULATIONS" BY AMENDING SECTION 4 "CARNIVALS, CIRCUSES, MENAGERIES, SIDESHOWS, CONCESSION, AND SPECIAL EVENTS ", SECTIONS C AND D OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That CHAPTER 4, "BUSINESS REGULATIONS" be amended BY AMENDING SECTION 4 "CARNIVALS, CIRCUSES, MENAGERIES, SIDESHOWS, CONCESSION, AND SPECIAL EVENTS ", SECTIONS C AND D of the Code of Ordinances of the City of College Station, Texas, as set out in Exhibit "A ", attached hereto and made a part of this ordinance for all purposes. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. tkir PART 3: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not less than Twenty -Five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. IgR Mayor AT ' ..T: City Secre APPROVED: City Attorney NG Special Event Ordinance Amendment 2 EXHIBIT "A" That CHAPTER 4, "BUSINESS REGULATIONS" be amended BY AMENDING SECTION 4 "CARNIVALS, CIRCUSES, MENAGERIES, SIDESHOWS, CONCESSION, AND SPECIAL EVENTS ", SECTIONS C AND D, of the Code of Ordinances of the City of College Station, Texas and is to read as follows: SECTION 4 CARNIVALS, CIRCUSES, MENAGERIES, SIDESHOWS, CONCESSION, AND SPECIAL EVENTS C. Fifteen -day operation. (1) No event shall be operated under a permit authorized herein for more than the greater of fifteen (15) calendar days or one hundred fifty (150) hours during a calendar year, with the exception of businesses permitted through Code of Ordinance Chapter 4 "Business Regulations" Section 21 "Northgate Outdoor Dining and Entertainment" (2) Operation of such an event for more than the referenced length of time shall be considered a permanent business for which site plan approval is required under the City of College Station Unified Development Ordinance. If the event is not operated on consecutive calendar days, an inspection as provided under subsection H. herein shall be required each time before the event resumes. D. Northgate Central Business District. (1) An event in the Northgate Central Business District providing for alcohol sales or consumption shall have a valid permit or license to sell or serve alcoholic beverages issued by the Texas Alcoholic Beverage Commission. (2) An event in the Northgate Central Business District involving the sale or consumption of alcohol shall not be operated under a permit authorized herein for more than three (3) consecutive days.
