1. Call to Order and Announce a Ouorum is Present
With a quorum present, the Special Meeting of the College Station City Council was called to
order by Mayor Nancy Berry at 6:10 p.m. on Wednesday, October 6, 2010 in the Council
Chambers of the City of College Station City Hall, 1101 Texas Avenue, College Station, Texas
77842.
2. Presentation, possible action and discussion resardins approval of a real estate contract
between the City of College Station and the College Station Independent School District for
the purchase of approximately 30.30 acres in the Thomas Carruthers League Survey
Abstract 9.
MOTION: Upon a motion made by Councilmember Crompton and a second by
Councilmember Ruesink, the City Council voted six (6) for and none (0) opposed, to approve the
real estate contract between the City of College Station and the College Station Independent
School District for the purchase of approximately 30.30 acres in the Thomas Carruthers League
Survey Abstract 9. The motion carried unanimously.

3. Executive Session
In accordance with the Texas Government Code §551.071-Consultation with Attorney and
§551.074-Personnel, the College Station City Council convened into Executive Session at 6:14
p.m. on Wednesday, October 6, 2010 in order to continue discussing matters pertaining to:
Litigation Consultation with Attorney {Gov't Code Section 551.0711; possible action
a. City of Bryan's application with TCEQ for water & sewer permits in
Westside/Highway 60 area, near Brushy Water Supply Corporation to decertify City
of College Station and certify City of Bryan
b. Water CCN / 2002 Annexation / Wellborn Water Supply Corporation
c. Weingarten Realty Investors v. College Station, Ron Silvia, David Ruesink, Lynn
McIlhaney, and Ben White
d. Chavers et al v. Tyrone Morrow, Michael Ikner, City of Bryan, City of College
Station, et al
e. Clancey v. College Station, Glenn Brown, and Kathy Merrill
f. Rachel Rahn v. Alma Martinez; The Arkitex Studio, Inc.; Charles Burris, AIA; Dr.
Elton Abbott, AIA; and City of College Station, Texas: Cause No. 09-000656-CV-
361, In the District Court of Brazos County Texas, 361st Judicial District
Legal Advice Consultation with Attorney 1Gov't Code Section 551.0711; possible action
a. Discussion of Legal Issues Regarding: Wellborn Incorporation Request
b. Contemplated Litigation, Legal remedies available to abate weeds, rubbish, brush and
i" other unsanitary matter from a lot in the College Hills residential area.
Personnel {Gov't Code Section 551.0741; possible action
The City Council may deliberate the appointment, employment, evaluation, reassignment, duties,
discipline, or dismissal of a public officer. After executive session discussion, any final
action or vote taken will be in public. The following public officer(s) may be discussed:
a. City Secretary
b. City Manager
C. City Attorney
The Executive Session adjourned at 9:43 p.m. on Wednesday, October 6, 2010.
4. Action on Executive Session.
No action was required from Executive Session.
5. Adiournment
MOTION: Upon a motion made by Councilmember Maloney and a second by Councilmember
Fields, Mayor Berry adjourned the Special Meeting of the College Station City Council at 9:45
p.m. on Wednesday, October 6, 2010. The motion carried unanimously.
