CITY COUNCIL MEETING
CITY OF COLLEGE STATION, TEXAS
November 23, 1970
7:00 p. m.
Members Present: Mayor D. A. Anderson; Councilmen Cecil B. Ryan, Joseph
J. McGraw, Dan R. Davis, Bill J. Cooley, James H. Dozier,
and C. H. Ransdell; City Manager Ran Boswell; City Planner

Mayor Anderson called the meeting to order at 7:00 p.m. in the Council Room at the
City Hall.
On motion by Councilman Ryan, seconded by Councilman McGraw, the Minutes of
the October 21 and October 30 meetings were approved as written. Motion carried.
Councilman McGraw asked to be recorded in the Minutes of this meeting as being in full
accord with the Resolution as passed at the Emergency Special Council Meeting on
October 30, 1970.
Mayor Anderson briefly reviewed the Agenda items for the benefit of citizens
present. He opened the floor for discussion relative to Agenda items. There being no
comments, he closed the floor.
Mayor Anderson asked for the pleasure of the City Council in setting a date for the
December Council Meeting. He suggested December 18, 1970 at 5:15 p.m. Councilman
McGraw moved that the date of December 18, 1970 at 5:15 p.m. be accepted as the date
for the December Council meeting. Motion was seconded by Councilman Dozier. Motion
carried. In connection with this date, it was agreed that the Annual Christmas Open House
would be from 3:00 to 5:15 p.m., preceeding the Council Meeting.
Mayor Anderson called for a public hearing on the question of rezoning Reserve E, a
5.881 acre tract in the Plantation Oaks Subdivision in the Richard Carter League, located
near the intersection of Highway 30 and the East By-pass of Highway 6 from District No. 1,
first dwelling house district and District No. 3, apartment house district to District No. 4,
first business district. The City Planner pointed this area. out on the map. There being no
comments, concerning this request for rezoning, the Mayor closed the hearing.
Councilman McGraw moved that Ordinance No. 707 be adopted, which is an ordinance
rezoning a 5.881 acre tract (Reserve E ) in the Plantation Oaks Subdivision in the Richard
Carter League, located near the intersection of Highway 30 and the East By-pass of Highway 6
from District No. 1, first dwelling house district and District No. 3, apartment house district,
to District No. 4, first business district. Councilman McGraw asked that this ordinance
be adopted to conform to the Planning & Zoning City Development Policy as may be adopted.
Motion was seconded by Councilman Cooley. There was some discussion by councilmen
concerning this motion. Councilman Dozier stated that he felt the developer would be

paying higher taxes because his property was being zoned commercial and that the property
would no doubt be developed as soon as was possible. Mayor Anderson stated that the
Council has the authority to change the zoning if no development occurs. Councilman McGraw
and Councilman Cooley then amended their motions to adopt Ordinance No. 707, as described
herein, with no stipulations. Motion carried.
Mayor Anderson called for a public hearing on the question of rezoning Reserve C,
a 15.375 acre tract and Reserve D, a 5. 591 acre tract in the Richard Carter League,
Plantation Oaks Subdivision, from District No. 1, first dwelling house district to District
No. 3, apartment house district. There being no comments, he closed the hearing.
Councilman Dozier moved that Ordinance No. 708 be adopted, an ordinance rezoning
a 15.375 acre tract ( Reserve C ) and a 5.591 acre tract ( Reserve D) in the Plantation Oaks
Subdivision in the Richard Carter League, from District No. 1, first dwelling house district
to District No. 3, apartment house district. Motion was seconded by Councilman Davis.
Motion carried.
Mayor Anderson called for a public hearing on the question of rezoning Block 5,
Lots 1 through 25 of the University Oaks Subdivision, Section 2, from District No. 3,
Apartment House District to District No. 2, Second Dwelling House District ( this property
is located behind lots in the Southeast side of Kyle and Gilchrist Streets between Munson
Avenue and James Parkway. City Planner Eby pointed this area out on the map. Councilman
Dozier stated that this zoning had been an agreement that had basically been worked out by
the developers and the property owners in this area and these duplexes were to be a "buffer
zone". Mayor Anderson then closed the public hearing.
Councilman Dozier moved that Ordinance No. 709 be adopted, an ordinance rezoning
Block 5, Lots 1 through 25 of the University Oaks Subdivision, Section 2, from District No. 3,
Apartment House District to District No. 2, Second Dwelling House District ( this property
is located behind lots on the Southeast side of Kyle and Gilchrist Streets between Munson
Avenue and James Parkway). Motion was seconded by Councilman McGraw. Motion carried.
Councilman McGraw moved that Ordinance No. 710 be adopted, an ordinance officially
naming a street of which a part is in the City of College Station, Brazos County, Texas, and is
filed in the Brazos County Court Records, Volume 286, Page 165 to "Bank of A&M Street"
and declaring an emergency. Motion was seconded by Councilman Ryan. There was some
discussion among councilmen on the name selected for this street. Motion carried.
Mayor Anderson read Ordinance No. 711, an ordinance regulating garage sales for
the benefit of citizens present, stating that it had been reviewed by the City Attorney. He
explained that this matter of regulating garage sales had been under consideration by the
council for a month and the ordinance was based on those presently being used by many
other cities in Texas. There was some discussion concerning the fact that persons holding
garage sales should be permitted to sell merchandise other than used and discarded items of
personal property belonging to the occupant. After considerable discussion among councilmen
and some citizens present, Councilman McGraw moved that Ordinance No. 711, an ordinance
regulating garage sales, be adopted, with the deletion of the wording under Section I - (d):
"belonging to occupant". Motion was seconded by Councilman Davis. Motion carried.
Councilman Dozier abstained from voting.

Mayor Anderson explained that for the last seven months, he had been gathering
material for the Personnel Manual Policies for the City of College Station. He stated that
a copy had been earlier sent to councilmen for their review. He asked for the pleasure of
the Council in adopting Ordinance No. 712, which is an ordinance establishing these
personnel policies for the City of College Station. Councilman McGraw suggested that on
Page 5, under Section 6, "Dismissal", the wording "just cause" should be deleted and
that on Page 18, under Section 7, "Grievance Procedure", the second paragraph should
read as follows: "In presenting complaints or grievances, in no case shall any employee
by-pass the chain of command. An employee may present a grievance to the City Council
in personnel session if the matter cannot be reconciled at the lower level. " Councilman
Ransdell moved that"Ordinance No. 712, an ordinance establishing personnel policies
for the City of College Station, be adopted, and that the Personnel Manual reflect the
changes as outlined herein as recommended by Councilman McGraw. Motion was seconded
by Councilman Davis. Motion carried.
Councilman McGraw moved that the City Development Policy for the City of College
Station, as recommended by the Planning and Zoning Commission in the form of a Resolution,
be tabled until the Planning and Zoning Commission and the City Council could meet jointly
to discuss the proposed policy. Motion was seconded by Councilman Ryan. Motion carried.
City Manager Boswell reported on the proposed Regulations, Rates and Schedules
for the Sanitary Landfill. A copy of these Regulations, Rates and Schedules is attached
hereto and made a part of these Minutes as "ATTACHMENT All. There was some dis-
cussion among councilmen about this matter. Councilman Dozier suggested that the
wording in number 6 be changed to read: "This shall not be construed to prohibit the
dumping of rubble* by private citizens who are engaged in the remodeling of their
personal residence. Councilman Ransdell moved that the Regulations, Rates and
Schedules for the Sanitary Landfill with the correction as noted above, be adopted.
Motion was seconded by Councilman Dozier. Motion carried.
In presenting the matter of the contract with the City of Bryan for water, electrical,
and sewer services, Mayor Anderson expressed concern over the three year contract and
the rate on water, stating it was obvious that the city needed to study a source of future water
supply since we couldn't wait for Millican Dam.
City Manager Boswell reviewed briefly the contract proposed between the Cities of
Bryan and College Station for water, electrical and sewerage services, which is up on
November 29, 1970. Mr. Boswell explained that the rates had gone up and the City of Bryan
would not renew the contract for five years, but only for three because the City of Bryan
could not project items such as debt service and other financial obligations that might come
up. There was some discussion among councilmen concerning this matter. Councilman
Ransdell moved that the City Council authorize the Mayor to sign and enter into this
contract but at the same time, the city launch out with a feasibility study of our developing
a water operation of our own. Motion was seconded by Councilman McGraw. Motion
carried.
Mayor Anderson explained that at the last meeting, the Council had requested the City
Manager contact the City Attorney relative to expediting zoning requests. The City Attorney
did answer this question by letter and his conclusion was that the procedure presently used
was the most effective. 0.

City Engineer James gave his recommendations on the University Oaks Storm Sewer
Drainage. After some discussion, Councilman Ransdell moved that the City Council accept
the recommendations of the City Engineer as follows: (a) that the developer of University
Oaks Subdivision and Plantation Oaks Subdivision and the City participate in constructing a
storm sewer line to relieve the intersection of Dominik and Munson and (b) that the City
Engineer consider the widening of the existing concrete portion of Munson Street to match
the proposed street width on the new section of Munson. ( The approximate cost estimate
for the storm sewer is $9,500 and the estimate to widen Munson is to be determined by
the City Engineer and reported to the City Manager). Motion was seconded by Councilman
Davis. Motion carried.
The City Engineer gave a report on the dedicated street construction in the Oak
Forest Mobile Home Park, which had been submitted to the City Manager in the form of a
memorandum. The recommendation of the City Engineer is as follows: (1) that the
developer be allowed to construct a twenty-four (24) foot wide street (2) that the
centerline of the twenty-four (24) foot street be offset in the right-of-way so that one curb line
will be in proper location for the ultimate street width, and (3) that an agreement be made
between the city and developer, whereas, when the street is ultimately widened, he will be
charged for a curb and gutter and paving on one side only. Councilman Cooley moved that
the recommendation of the City Engineer as stated herein be accepted. Motion was seconded
by Councilman Davis. Motion carried.
City Manager Boswell reported that a letter had been received from the Governor's
Office in Austin concerning local planning assistance for the City of College Station
through the Department of Housing and Urban Development and that a representative would
be sent to interview local officials upon a notice of grant approval by the Department of
Housing & Urban Development.
Councilman Dozier reported on recycling plants for newspapers. He stated that his
wife, the City Manager, and Mrs. Neelley (Director of Finance) had written several plants
in Houston for information on what type of paper they will accept and what they pay for this
paper. He said that the prices do seem to fluctuate. Most of the plants accept only newsprint,
card -board boxes and "mix paper" but all of this has to be segregated when it is delivered
to the plant. The price is 20 to 30� per 100 pounds of weight. He stated that he had figured
that his family had approximately ten and one-half pounds of newspapers per week, and that
if there are about 3, 500 residences in College Station on the utility rolls and about 1, 500 of
them were to cooperate in saving their newspapers, it would average out to about 15, 000 pounds
of newspaper per week. There was considerable discussion among councilmen and citizens
present concerning this matter, including the matter of economics. Councilman Dozier stated
he felt it would be necessary to determine how much paper could be loaded on a truck and
taken to one of these plants in Houston. It was the concurrence of the council members
that possibly a "trial" run would be given this idea in a selected section of the city and see
what could be done on the basis of cooperation by the citizens. Further study is to be given
to this matter.
Mayor Anderson asked how many of the councilmen would be available to ride in
the Christmas Parade on December 3, at 6:30 p. m. It was decided that one car would be
enough.

Mayor Anderson asked for the Council's recommendation in naming two additional
persons to the Electrical Examining Board, who are practicing electricians in the city.
They are George Carroll and Gene Patterson. He stated that because of the reciprocal
agreement he was trying to get worked out with the City of Bryan and City of College Station
on licensing of electricians, he felt this would be a beginning. He stated that the present
Board is a group of highly qualified people and he felt the addition of these two people
would add to the qualification of the board members. He stated that the City of Bryan
had criticized the City of College Station for not having a licensed electrician on the
Electrical Examining Board. Councilman Ransdell moved these two men named above
be appointed to the Electrical Examining Board. Councilman Davis seconded the motion.
Motion carried.
The Councilmen were advised of the meeting with Ernest Brown, Financial Advisor,
on Friday, December 4, 1970.
On motion by Councilman Dozier, seconded by Councilman McGraw, the meeting
was adjourned, subject to call.
