Minutes of Special Meeting
April 12, 1961
Members present: Mayor Langford; Councilmen Anderson, Boyett, Landiss,
Orr, Rosprim and Sorrels; City Attorney Dillon; City
Engineer Benson; City Manger Boswell
Visitors present: C. B. Thames, J. M. McLain, J. G. Hanover and D. J. Ballard
Purpose of the meeting was to discuss accepting Minute Order No.
48973, passed by the State Highway Commission on January 31, 1961, and to
accept a request for the re -zoning of certain lots in West Park Addition.
On motion by Councilman Orr, seconded by Councilman Landiss, all voting
aye except Councilman Boyett, who asked to be marked present but not voting,
the council approved the Minute Order and instructed the city manager to
file with the State Highway Commission the necessary copies when certified
by the city secretary.
On motion by Councilman Orr, seconded by Councilman Landiss, the
request for the re -zoning of lots 11 - 15, inclusive in block 1 of West
Park Addition was referred to the Planning and Zoning Commission.
Council adjourned subject to call.

RESOLUTION ACCEPTING THE PROVISIONS OF
STATE HIGHWAY COMMISSION MINUTE ORDER
THE STATE OF TEXAS I
COUNTY OF BRAZOS I
COLLEGE STATION, TEXAS
April 12, 1961
MOTION was made by Councilman Orr, and seconded by Councilman Landiss, that
the College Station City Council accept the provisions contained in Minute
Order No. 48973 passed by the State Highway Commission on January 31, 1961,
for the improvement by the Texas Highway Department, on FARM TO MARKET ROAD
60 at the crossing of tracks of the Texas and New Orleans Railroad and the
Missouri Pacific Railroad near the northwest corner of the campus of the
Agricultural and Mechanical College of Texas, as described by said Minute,
and that the City of College Station will:
Furnish at no cost to the State and free of all encumbrances and
including all necessary utility adjustments, all right of way
needed for the construction of the said railroad grade separation
within the city limits but outside the property of A. & M. College.
VOTE on the motion was as follows:
All aye except Councilman Boyett present and not voting.
WHEREUPON the motion was declared carried.

WHEREAS, IN BRAZOS COUNTY on FARM TO MARKET ROAD 60 at the crossing of
tracks of the Texas and New Orleans Railroad and the Missouri Pacific Railroad
near the northwest corner of the campus of the Agricultural and Mechanical
College of Texas, the present and anticipated highway and railroad traffic in-
dicates the need for the construction of a railroad grade separation; and
WHEREAS, by Commission Minute Order No. 36929, dated October 26, 1954,
the State Highway Engineer was directed to proceed with necessary negotiations
with all agencies involved, furnish the local authorities with the right of
way requirements, and complete surveys and plans required for the construction
of a four lane railroad grade separation and approaches at an estimated cost of
$375,000.00; and
WHEREAS, subsequent engineering studies have indicated that the cost of
said grade separation will be materially increased over the above estimate; and
WHEREAS, benefits will accrue to the railroad companies, and A. & M.
College, and the local governments due to the construction of said grade sepa
ration.
NOW, THEREFORE, it is ordered that Minute Order No. 36929 shall be
modified to authorize the State Highway Engineer to tender to Brazos County,
the City of College Station, and Agricultural and Mechanical College of Texas,
the Texas and New Orleans Railroad Company, and the Missouri Pacific Railroad
Company the following proposal:
Provided that Brazos County will:
1. Furnish, at no cost to the State and free of all encumbrances and
including all necessary utility adjustments, all right of way needed
for the construction of the said railroad grade separation outsi.dc
the limits of the City of College Station, the property of A. & M.
College, and the railroad rights of way, and
2. Arrange, at no cost to the State, for the removal or adjustment of
Southwestern Bell Telephone lines and other utility lines, except
Western Union lines, on the railroad rights of way required for the
construction of the grade separation; and
Provided that the City of College Station will:
1. Furnish, at no cost to the State and free of all encumbrances and
including all necessary utility adjustments, all right of way needed
for the construction of the said railroad grade separation within
the limits of the City but outside the property of A. & M. College;
and
Provided that the Agricultural and Mechanical College of Texas will:
1. Furnish, at no cost to the State and free of all encumbrances and
including all necessary utility adjustments, all right of way needed
for the construction of the said railroad grade reparation within
the limits of the College property; and
Provided that the Texas and New Orleans Railroad Company and the Missouri
Pacific Railroad Company will:
1. Agree to contribute to the cost of construction of the said rail-
road grade separation in accordance with the rules of the U. S.
Bureau of Public Roads contained in Policy and Procedure Memorandum
No. 21-10, except for rreliminary engineering performed by the
State, and the cost of right of way and utility adjustments as
otherwise provided for herein, and
2. Agree to enter into the customary agreements with the State for the
granting of licenses, construction, maintenance, and contribution of
costs of the grade separation,
3. Agree to prepare detail plans for any underpass structure required
to be included in the general plans for the project,
The Texas Highway Department will:
1. Make all surveys and plans, except as otherwise provided for here-
in, and cause to be constructed the proposed four lane grade sepa-
ration and roadway approaches, including the necessary at grade
connections with Farm to Market Road 2154, and
2. Defray all engineering and construction costs of the proposed
railroad grade separation and roadway approaches, estimated to be
$720,000 less the contribution by the railroad companies, a.Q here-
inbefore described.
FURTHER, it is ordered that this Minute shall be automatically cancelled
if the conditions of this tender are not accepted by the Brazos County, the City
of College Station, the Agricultural and Mechanical College of Texas, the Texas
and New Orleans Railroad Company, and the Missouri Pacific Railroad Company,
within a period of 90 days after the date of this order.
