of the death of Carte- ( Buck) Lindsay on nrcember 24, 1977. He was
buried in Plainview, -xas, December 26. ar heartfelt sympathy

Solomon when he presides
at a joint hearing next
week for a man charged
with rape and the victim's

The husband, Earl
Patterson, 33, was
released Tuesday night on
$2,500 bail after being
charged with kidnaping,
felonious restraint,
aggravated and simple
assault, terroristic
threatening and possession
of offensive weapons.
Carl Butler, 34, was held
in lieu of $5,000 bond on
charges of rape, robbery,
theft, assault and indecent
assault, police said.
The men will appear
together next Wednesday
before Common Pleas
Court Judge Thomas
Shiomos.
Patterson's wife,
Maxim, 35, was robbed and
raped in her driveway last
January. She reported the
attack to police, but they
failed to solve the case.
In October, Mrs. Pat-
terson told her husband
she had seen the rapist
getting off a bus in the
neighborhood, and the
couple began cruising the
streets by car looking for
him.
Patterson said his wife
spotted Butler on Monday,
repairing a driveway drain
behind his home.
Patterson, a social
worker, said he crept up
behind Butler and made
what he considered a
citizen's arrest. But in-
stead of taking Butler to a
police station, he took him
to the Patterson home and
"interrogated" him for 21/2
hours in the basement until
he extracted a confession,
police said.
By the time Patterson
brought Butler to the
police station, handcuffed
and ready for booking,
police and FBI agents had

Torrey was licensed to
practice by the Supreme

Caperton named
municipal judge
Atty. Kent A. Caperton will become municipal court judge
in Bryan Jan. 1.
The new appointment by the Bryan City Council was made
public today by Mayor Lloyd Joyce in a morning news
conference at the Bryan Utilities Building.
Caperton replaces Judge William B. Langford who retires
on Dec. 31. Langford has been municipal court judge since
Nov. 20, 1961. Langford is retiring effective Dec. 31 because
he's reaching the mandatory retirement age of 70.
"The Bryan City Council commends Judge Langford for
the truly meritorious service he has provided our com- (N,
munity," said Mayor Joyce. "During his years as an at- _�
torney at law he has made many outstanding contributions to A
his profession. He is well known and respected by all for his
fair and impartial treatment of those who come in contact fst
with him."
Of the new judge, Joyce said, "The city is very fortunate to
have a man with such excellent qualifications for the position
of municipal court judge."
Caperton is currently an attorney in Bryan. He served as
assistant attorney general for the state of Texas and worked
as an administrative assistant in the Texas House. Prior to
entering law school, he was assistant to Dr. Jack Williams at
Texas A &M.
Caperton graduated from Texas A&M in 1971 with a BBA
degree in finance. He attended the University of Texas Law
School and obtained his law degree in 1975. He was admitted
to the state bar of Texas that year.
Judge Langford attended Bryan schools and received his
bachelor's begree from Texas A&M.
He is a retired lieutenant colonel and a veteran of World
War II. He received his law degree from St. Mary's
University School of Law and was admitted to the bar in 1953.
Municipal court judges handle minor misdemeanor cases
which carry a penalty of a fine not to exceed $200. These
cases include traffic violations, simple assault, petty theft,
public intoxication and disorderly conduct.

• DECEMBER 8, 1975
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A. M. on Monday, December 8, 1975, with the following present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The minutes of the previously held meetings were examined
and approve without change.
The Court received, approved and ordered filed as submitted
the following reports for

Judge Vance recognized Mr. Ray Abbott and Ms. Susan Frisbee
with South /West Planning Associates as Brazos County's consultants
relating to the second year Community Development Grant and publicly
announced Brazos County's intent to submit a Pre - application for
$101,000 block grant from DHUD for Community Development Program.
On motion by Commissioner Sims, seconded by Commissioner Wilcox
the Court unanimously voted to adopt a Citizens Participation Plan
for the Second Action Year of the Community Development Program.
A copy of such plan is attached to and made a part of these minutes.
The Court next considered a request by Sheriff J. W. Hamilton -
to appoint Reserve Deputies. The Court was informed that the
Sheriff's Department now had Auxilliary Deputies but that they must
be designated at Reserve Deputies. On motion by Commissioner
Stasny, seconded by Commissioner Sims, the Court unanimously voted
to authorize the Sheriff to appoint these deputies. Mr. Ira Lewis
Capt. of the Reserve Deputies appeared to request financial
assistance with the cost of uniforms for the Reserve Deputies.
After some discussion and on motion by Commissioner Wilcox, seconded
by Commissioner Cooley, the Court unanimously voted to authorize
the expenditure up to $1,200.00.
Next to be considered was a request for financial support of
the M.A.S.T. radio system. This money would be matched with federal
•
funds for radios and maintenance of radios for the helicopters.
After some discussion, the request was deferred until more infor-
mation could be obtained.
The Court next considered a maintenance agreement with Honeywell,
Inc. covering the temperature controls for the Courthouse annex at
a cost of $269.00 semi - annually. This matter was deferred until a
later meeting.
Sheriff Hamilton requested permission to hire extra help for
record keeping. Judge Vance advised the Sheriff that no action
could be taken at this time and deferred the matter to a later
meeting.

On motion by Commissioner Wilcox, seconded by Commissioner Sims,
the Court unanimously voted to pay the County's 1976 membership dues
to.the Texas Association of Counties in the amount of $850.00.
The Court next received the order of the District Judge for the
appointment of Sheri Wilson to serve as Assistant County Auditor, .
effective November 1, 1975. A copy of such order is attached to
and made a part of these minutes.
On motion by Commissioner Cooley, seconded by Commissioner Wilcox
the Court unanimously voted to pay $3,175.00 to the City of College
Station for fires calls for the month of November.
The Court next received a recommendation from the Auditor's Office
that each elected official or department head be designated as the
inventory control officer for his office. Commissioner Sims moved
that the appointments be made according to the recommendations of
the County Auditor. Motic,n was seconded by Commissioner Cooley and
carried unanimously. A copy of such recommendation is attached to
these minutes.
On motion by Commissioner Stasny, seconded by Commissioner Cooley
the Court voted unanimously to approve the VILLA MARIA EXTENSION,
ROAD DEDICATION PLAT.
The Court next discussed the possibility of leasing the Patterson
property adjacent to the BLD Building for parking purposed to the
law firm of Lawrence, Thornton, Payne and Watson. After a discussion
Commissioner Stasny moved that the County lease the property for
such purposes on a yearly basis at $900.00 per year. Motion was
seconded by Commissioner Cooley with Commissioners Sims, Stasny,
Cooley and the County Judge voting AYE. Commissioner Wilcox voted
NO. County Judge announced the motion carried.
