RE: Relocation of Graves 4
DATE: December 20, 1988
I cannot support a decision to seek a "court order" from Munici-
pal Court to relocate the graves. The Municipal Court only has
criminal jurisdiction. Any attempt to utilize it for a civil
court order would be indefensible, particularly politically.
Both Mr. McQuaide's attorney, Head Davis, and I have concluded
that the grave site is not a cemetery under the statutory defini-
tion. I feel much more comfortable defending an honest legal
opinion. I recommend that you either simply relocate the graves
or we ask council permission to seek a court order from state
district court. If we want to treat the grave site as a ceme-
tery, we should use the proper statutory procedure for obtaining
authorization.

Authorities are investigating the mystery_of the desecrated grave of Richard , '
Carter, one of the founding fathers of Brazos County. The shovel shows the
depth of a hok dug into the grave. The bole was recently discovered by .
amateur historians. Workers dug down about six feet without finding evi- •
dence of the remains or coffin. Apparently part of the iron fence on the right
had been removed for the culprits to gain access to the grave. (Eagle Photo

Dear Mr. Williams:
The College Station Historical Preservation Committee along with the College Station
Parks and Recreation Department is hoping to get approval to erect a State Marker
directional sign at or near the intersection of Brazoswood and the west frontage road of
the east bypass. The sign would help our patrons and citizens find the "Richard
Carter Park and Homesite ".
The purpose of this letter is to ask the procedures we need to follow in securing this
sign, as well as the probability of approval and approximated cost of the sign.
I have some questions about this endeavor such as sign dimensions, color (green,
brown, blue) and quality of the sign, and what the sign will be made of (wood /metal).
What will be the exact location of the sign? Do you pay for and install the sign, do we,
or do we each contribute to some part of this project?
In closing, I am sure that I forgot to ask some question, but if you could call me or
send me your standards, I will be more than happy to explain this request in greater
detail. Enclosed you will find an example of the type of sign we are thinking about, as
well as the location we are looking at.

Dear Mr. Gerling:
I am in receipt of your November 24, 1992 request to sign for the
Richard Carter Park and Homesite at the intersection of Brazoswood
and SH 6 West Frontage Road / and guidelines for the fabrication and
erection of the sign.
The Texas Department of Transportation has no objections for the City
of College Station to erect the sign. In the past signs have been
fabricated and installed on State right of way by City forces for
guiding traffic to city parks. For consistency, I suggest the City
do the same at the Richard Carter Park and Homesite. The sign should
follow the guidelines of the Texas Manual on Uniform Traffic Control
Devices and can be patterned to the similar signs placed by the City
at other park locations.
