E•01 CITY OF COLLEGE STATION 611)))1.° PARKS AND RECREATION DEPARTMENT Post Office Box 9960 College Station, Texas 77842 -0960 (409) 764 -3773 December 13, 1988 MEMORANDUM TO: Cathy Locke, City Attorney / FROM: teve Beachy SUBJECT: RELOCATION OF GRAVES The descendants of Richard Carter have forwarded a petition requesting relocation of the remains of Richard Carter, Elizabeth Carter, and any children or slaves that are buried north of the RICHARD CARTER PARK site. The original cemetery was heavily vandalized in 1964. No visible sign of the cemetery exists today, although, its location is known. The current property owner is Mr. Hank McQuaide and he is in agree- ment with the request. Also, the park site plan includes a location for the new cemetery. After consultation with Mr. William Zieren, he recommended that we get a court order from the Municipal Court authorizing the move. Also, he further recommended that the new location be designated as being part of the original site to avoid any future problems dealing with the establishment of a "new" cemetery within the city limits. I have included a copy of the petition, a news article relating to the original vandalism problem and a site plan depicting the current and proposed cemetery locations. Why is this request of such an emergency nature that it must be made immediately? The gravesites of the Carter Cemetery need permenent markers soon to prevent misidentification of the bodies. 2. Why was the item not budgeted in the normal budgetary process? The moving of the Richard Carter Family Cemetery was not expected in this budget. We received the cemetery from private property after the budget had begun. The bodies werelocated and moved in the time span of one week. 3. Justification as to why the transfer can not be made within the division or department? No funds are available without the removal of or cutting of an activity. Council Approval Required?
