HomeMy WebLinkAbout 1941 College Park Block 14 and 17 Why are lots 1, 2, 3, 4 and 5 of this crucial Block 14, so important to what will happen to deed restrictions in College Park, and more importantly, in all of College Station? The answer partly lies in what John Wallace did and did not do! First, he and his wife Lillie Wallace, either never built any residence on those five lots he 'bought' in 1923, and finally recorded in 1929, or the home was hauled off the property later! Wallace died leaving no will, as shown in the Deed Records of Brazos County. Lillie Wallace survived him. They had two children; both now live in California per my research. As a surviving widow, Lillie sold back those crucial lots 1, 2, 3, 4, and 5 of Block 14, in College Park, to the Oakwood Realty Company on November 15, 1949. Oakwood Realty Company, acting through H. E. Burgess, with Mrs. Terrell, the original owner of Mrs. Miller's home, as Secretary of Oakwood, never even owned property they subdivided for some nine years after they did all this! The most critical evidence as to why deed restrictions are so important to the preservation of neighborhoods and history is the phrase that was expressly included in that Wallace sale document to Oakwood, filed by Oakwood Realty Company in Volume 141, Page 83 and 84 of the Deed Records of Brazos County: "The deed is made subject to the restrictions against said land by written instrument recorded in the Deed Records of Brazos County." Oakwood Realty Company had thus expressly agreed to abide by and re -bound the Nagle land, to the old deed restrictions, at least for this parcel of land, that were in place against this exact parcel of land since 1923 until that day in 1949, as span of 26 years. They said so in writing! That is exactly why the Cashion deed, Red Cashion being Burgess' son -in -law, had the curious deed blanket deed restriction text in it. It was taken directly from the actual sale document to them, but more importantly, it also added the key word "conventions ", as I recall. That's also very important, because it is evidence of the fact that both forms of restrictions, the old convention and the new way, were binding in this neighborhood. It is crucial to note that during this roughly nine year span, the same Southside Development Company was still selling and recording fully qualified deed restricted property in the same area! After they sold the large quantity of land to Oakwood, which Oakwood improperly re- designated, there are some twenty -nine further sales in College Park which still carry the full formal older deed restrictions on them. Of those, nine are cross - contaminated in the same area as Oakwood re- designated! Then, most significantly, in the Deed Records of Brazos County, on August 25, 1947, in Volume 131, Page 272, the Southside Development Company filed 2 Articles of Dissolution & Distribution of undivided interest to C. W. Burchard, Elizabeth L. Scoates, R. R,. Lancaster and F. B. Clark, for all lots, streets, alleys and park sites. In them, it is recorded that these above people or their heirs have the right to waive or remove any & all restrictions for, as well as to enforce same, which may have been heretofore imposed against any of the properties henceforth or now. Three of these people have heirs and an executor or executrix of their estates whom are still here in College Station, Texas. W. C. Burchard had no children and that estate went to a sister in Alabama. I have discussed the issue with Bill Lancaster, who was the executor of the R. R. Lancaster estate. I asked him if, presented with a request to pass on the validity of the specific deed restriction to enforce the inability to change the basic shape of the lot, he would vote to uphold, void, or abstain? He noted the Burgess actions, the specific sentence in the sale of the property to Oakwood, and Nagle's obvious intent to subvert even the 75 foot requirement to put in the two original houses, plus the manipulation of the shape of the lot to gain even the one. That noted, Bill has promised me that he would have to vote to uphold the deed restrictions. He also agrees that we have no choice but to go forward as he now understands how this can not only affect this resubdivided area, but all of College Park, and ultimately, all of College Station. There are firmly now some 180 -odd property owners involved in the vote, not just the resubdivided area as Nagle suspects. We both think, at this time, that Bill Scoates and Carol, Clark's sole heir, would vote to affirm the restriction. I can visualize how to prepare such an affidavit, if desired, might be able to get them signed. The following is a matrix table of parcels in the College Park Area, the oldest subdivision in the City of College Station, Texas. This subdivision was dedicated in the year 1921, as a part of the City of College Station, which was not even formally there until 1938! The below matrix indicates each and every property I can find that was developed from the area, the entire portion of which initially wound up in the control of the Southside Development Company. The Southside Development Company was guided primarily by F. B. Clark, who served as the President and by others, of whom C. W. Burchard is most often found in the records, signing as Secretary of the organization. The exact text of the Deed Restrictions can be found to be of either or both of two specific types. Type 1 is that found in the very first parcel ever sold a non - company purchaser by Southside Development Company, hereinafter noted as SDC. The text of these restrictions, although not typed precisely the same form in each case in the deeds is the exact same text shown in each of the records below where the restriction column has a numeral one (1). I (h. The second, very much later, overlay -form of restriction was imposed by the Oakwood Realty. Oakwood never even owned much property it attempted to re- 3 • plot and restrict! Oakwood actually used the earlier form as well in a few i cases. As well, Oakwood never entered development operations in College Park until just about the time that the shift was taking place in the record format, so that is a confusion factor as well, but remember, even at that, there is word -play in the Deed Records that makes it clear that they new about such conventions! That key word is in the chain of accession for the Nagle deed in the specific case. The final column will indicate, to the best of my knowledge, if the shape of the lot and the current residence construction on that property, has ever changed to this date, from what was expected of the purchaser, by the developer, and all others, as related to the residence construction on a specific deed restricted parcel. It may be that a residence has been torn down and a new one constructed on it, or intensively modified, but if so, that doesn't change original intent or spirit of the restrictions. The statement "No" in the Corrupt column, means that whatever current construction is on the property that was at this position, still meets the restriction imposed on the original PURCHASER that the lot had to stay in- shape. Lastly, the property description shown below is only in the form of a lead entry to the actual description. There may be additional property that was bound by it to either side, a part of an adjoining lot that was bound to it as half a lot that went to this purchaser, half to another, or that property was sold on a description in metes and bounds. If half a lot was bound, it is, as I would expect, inconceivable that the other half would be exempt! In the below, the seller may be: SDC - Southside Development Company. F. B. Clark, the president and a director of said Corporation, C. W. durchard, secretary and treasurer and a director of said corporation, Mrs. Eleanor L. Scoates a di- rector of such corporation, were all present, constituting the entire etockholdere and the entire Board of Directors, and each of sa officere owning an equal amount of the capital • stock of said corporation, A Motion was unanimously passed that the corporation was dissolved and the written con -1 sent of such stockholders, as required by law, was signed. By the tarns of such motion the officers were instructed to file with the Secretary of State the Certificate as required by •, , law to perfect a dissolution. The term- of such motion further autaorized the above named president and secretary and treasurer to execute, acknowledge and deliver unto F. B. Clark, . C. W. Burchard, Eleanor L. Scoatee and R. R.
