II. The home at 1009 Walton Drive, College Station has a significant history:
On November 1, 1938,the chairman of the original incorporation committee, John Henry
Binney, bought this home site from J.C. Culpepper. Binney, a math professor at Texas
A&M, was elected the first mayor of the new city a few weeks later on November 28,
1938. On December 28, 1938, Dr. Binney and wife Ludie contracted with R.C. "Clint"
Cloud to build a home on the property. The Brazos Valley Appraisal District lists the
year built as 1938, so it was one of the first in the neighborhood. For more detail, see
below:
IV. Supporting Documentation:
A. Alterations:
This section describes the alterations and additions to the property at 1009
Walton Dr. undertaken by Bill and Layne Averyt from 1991 through 2010.
Livable space in the home was increased from 2091 to 3000 square feet. Great
care was taken to retain the character and charm of the original home, while
updating and modernizing to make it more energy efficient.
1991-1993:
Anchor foundation added new piers extensively for stability of the pier and
beam foundation.
Removed unstable chimney and fireplace; replaced it with a new double sided
fireplace unit with gas logs.
Removed cracked front porch. Removed original front door and bumped out
entry area adding 2 glass side lights and double glass front doors for more
natural light.
New front porch with double columns, brick edging and hanging lantern porch
light.
Removed wall between first floor sun porch and small study to make one large
room. Removed metal windows in sun room and framed in matching
windows.
Enclosed second story space above sun porch/study to allow finished exterior.
It became 2 stories, more like a salt box or Cape Sod style.
Removed original front entry closet and original pantry, opening a hallway for
better flow from front to back.
Added decorative rail to bottom of newly visible stairwell.
Removed small bathroom at end of hallway; this became the new pantry.
Added 14' deep rooms downstairs and upstairs at back of house (interior not
finished at this time.
Added new downstairs bath near back door(tile floors, cultured marble tub
surround and countertop, new cabinets).
Demolition on exterior including roof shingles, decking, removal of all
windows.
Added architectural vinyl siding, new roof decking, asphalt shingles and new
wood windows.

Addition of skylight in upstairs addition(interior unfinished).
New sheetrock in existing living room ceiling and pantry.
Rear porch overhang installed.
Taped, floated, and textured new sheetrock in sunroom/study room and new
bath.
Added and patched in wood flooring in new hallway& den.
New rain gutters on house exterior.
Moved electric meter loop to a remote pole away from house. Installed
underground electric, telephone and cable wires.
Home completely re-wired and re-plumbed.
New air conditioner installed for downstairs with ducting in crawl space.
Installed underground piping for rain gutter water removal.
New slate hearth floor in living room.
New carpet in sunroom/study; ceiling fans added.
New reworked mantle in living room and new mantle in sunroom/study.
Crown molding installed in living, dining and entry area; oak floors refinished.
New insulation and drywall added in new family room area; new pocket doors
for new bath and pantry.
Enlarged concrete driveway to allow for more parking.
1994:
Demolished 2 closets in 2 upstairs bedrooms (back-to-back kids rooms) and
moved entry doorway in one room. Added to closets.
Finished second story end room addition: became 2 separate bath areas with
shared shower and closet(tile floor and shower). Two closets added. New
chest of drawers and dressing table added
New carpet in upstairs area.
Added air conditioned attic area for storage.
Demolished upstairs hallway bathroom.
Moved laundry facilities to unfinished upstairs area.
1996:
Demolished original kitchen and wall between it and new den.
Constructed new enclosure for refrigerator for support wall.
Installed new cabinets in both kitchen and den and a new island in between.
New kitchen appliances and complete kitchen redo.
New wood floors in kitchen and den and added to old floors.
Refinish all downstairs floors.
New Avonite countertop in kitchen.
New matching crown molding throughout.
Installed checkered tile kitchen backsplash.
New paint in kitchen and den.
1998:
Installed a swimming pool with cool decking walkways.

Removed original broken sidewalks in front of house and added new ones,
plus circular planter.
Landscape lighting added in trees front and back.
Lawn sprinkler system added.
New flower beds added and extensive landscaping front and back.
New wooden deck in back and wood bench by pool.
New cyclone fence around back of lot and new stainless steel fence near house
for pool security.
2000:
Added a carport with shingled roof to match house roof pitch. Included
recessed lighting for security.
2002:
Demolished stairway and small attic room above garage.
Tore out old concrete garage floor.
Poured new concrete floor in garage and removed garage doors.
Framed in and installed a new French door unit to make a new room.
Put in ceiling, insulation and sheet rock in new room.
Installed a closet for water heater and air conditioner.
Installed a closet for refrigerator and freezer; new crown molding.
2005:
Suffered fire damage while remodeling the master bath area. Some
smoke/water damage repair required. During this time we decided to finish the
entire project while fire damage was being repaired.
Demolished 2 small master bedroom closets.
Created new master bedroom closet.
Made new hallway from old master bath.
New laundry room created from one old master closet space plus old hall bath
area.
Added a small hall closet in new master bath.
Finished out space enclosed in 1991 making a new master bath with shower,
tub,dressing table, Corian counters,tile floor and tile shower surround.
Finished other part of 1991 addition making a guest bedroom with a small
closet.
Added insulation to all exterior walls in the house.
New upstairs air conditioner in attic.
Replaced all windows in the house again with new energy efficient windows.
New paint throughout and new carpet. Refinished wood floors.
Matching crown molding added in new areas.
2009:
New roof shingles
Installed closed cell foam insulation in attic area and under floor in crawl
space.

2010:
Removed wooden deck in back and installed a new concrete patio with brick
edge to match pool. Drilled piers were installed to support concrete patio.
Removed carpet from old garage room and polished/stained concrete floor.
B. Prominent Historical Figures:
The first owner of this home was John Henry Binney, chair of the original
incorporation committee, and first mayor of College Station. Dr. Binney was
elected on November 28, 1938 and served until April of 1940.
Note by Layne Averyt: In doing research on Dr. Binney, I was
distracted by a discrepancy in information about his resignation. The
book Colleae Station 1938-1988_by Deborah Ann Balliew documented
that he resigned due to injuries sustained in a car accident. In an article
dated 2/17/1940 in the Battalion,the headline read`Kinney Resigns As
Mayor". He stated his reason as the crush of responsibilities in his life.
He was asked to stay on until an appropriate replacement was found,
and his resignation was accepted as of April, 1940.
According to Mr. Joe Callaway(1003 Puryear Dr.) in his application
for a city marker, he interviewed Binney's daughter Sue Anna, and she
said he resigned for health reasons. I spoke with Mr. Calloway on
February 26, 2011 and he confirmed this to me. Dr. Binney was
actually killed in a car accident on May 29, 1950, thus the confusion.
At the time of his death he lived in the home at 1003 Puryear and his
viewing and visitation were held there. The reasons for his resignation
do not really matter, except in the interest of accuracy.

D. Tenant History:
We heard over the years that the Burns may have rented a small garage attic
room to A&M students. We could get no confirmation of this. The Averyt
family leased the home in August of 1991 to move in before closing so the
kids could start school, otherwise the homeowners lived in the house for the
entire history.
E. Narrative History:
The original tract of land that would become College Hills Estates was bought
from Mrs. Minnie Dansby by J.C. Culpepper, president of College Hills
Estates Company on August 10, 1937. The company's development of the
area began shortly before the citizens of College Station voted to incorporate
on October 19, 193 8.
On Novemberl, 1938, the chairman of the original incorporation committee,
John Henry Binney, bought this lot from J.C. Culpepper. Binney, a math
professor at Texas A&M, was elected the first mayor of the new city a few
weeks later on November 28, 1938. On December 28, 1938, Dr. Binney and
wife Ludie contracted with R.C. "Clint" Cloud to build a home on the
property. The Brazos Valley Appraisal District lists the year built as 1938, so
it was one of the first in the neighborhood.
The Binney family lived in the house nearly three years and sold it to Patton
W. and wife Julia Burns on September 1, 1941. Dr. Burns was head of the
Department of Veterinary Physiology and Pharmacology at the Texas A&M
Vet school from 1935 to 1966. The Burns family owned the home for fifty
years plus 3 weeks. After leasing the home for one month, on September23,
1991, Bill and Layne Averyt purchased the home from Julia Burns. At this
writing,the Averyts have lived in the home for 20 years.
The lot at 1009 Walton Drive is 2.6 acres, making it one of the largest in the
development. The frame house, built in 1938, is a Georgian/Colonial Style,
popular at that time. The foundation is pier and beam, considered the best
choice for the heavy clay soil. The original configuration of the house was a
central two story with garage on one side, one-story sun porch with Widow's
Walk on the other. After additions and alterations, it is now a two-story
throughout, with the exception of a one-story room where the garage once was.
All alterations and additions have been documented in the appropriate section
of this application.
