PHYSICAL FACILITIES ADVISORY COMMITTEE MEETING
MAY 2, 1979, 7:00 P.M. `
The County Judge opened the meeting and welcomed the
committee members. The duty of the committee is to assist
the Commissioners' Court in formulating a twenty year master
program of the physical facilities for Brazos County. The
meeting was then turned over to Jack Cumpton, Architect,
who made the following presentations:
The meeting goals are as follows:
1. May 2nd Meeting - Overview of physical facilities
and preview of possible concepts
2. Second Meeting - Explore in depth possible concepts
and space needs, to be furnished
by the Commissioners' Court
3. Third Meeting - Present finalized concept or con-
cepts and advise the Commissioners'

The inmates legal rights were defined as follows:
1. Personal safety and welfare
2. No cruel and unusual punishment
3. Healthful environment
4. Right to remain silent
5. Right to communicate with family and attorney
6. Presumption of innocence for prisoners awaiting trial
7. No racial segregation
8. Discipline consistent with due process
9. Procedure for imposing punishment
10. No discipline of prisoners by prisoners
11. Segreg. - ed confinement
12. Consult 'on with attorneys
13. Corr_espoi, nce with attorneys
14. Prisoner's right to prepare legal papers
15. Access to thy: Courts
16. Grievance procedures
17. Crimes committed in jail

These items are nonconforming to the Commission on Jail
Standards and must be met:
1. 5 cells don't provide enough square footage
2. Dayrooms not provided for each inmate
3. No emergency operation of cell door locks
4. No audible communication between cells and
jailors area
5. Inadequate lighting throughout cells and corridors
6. No excercise area
7. Temperature level can't be maintained between 65 ° -85°
8. No violent cell provided
9. No exhaust system for removal of smoke and fumes
The jail was inspected in 1977 and sixteen (16) nonconforming
items were found of varying magnitude. Four of the sixteen
can very possibly receive variance from the Jail Commission.
The following are existing Physical Facility Planning
Concepts arrived by the Commissioners:
oncept 1 - Renovate 4th floor jail to meet standards,
construct additional jail needed on 3rd
r 0 floor, construct a new judicial and office
4/concept wing using roof for jail excercise area.
2 - Move jail and associated aces to existing
t}QZ downtown Bryan structure. Renovate 4th
floor for judicial and office space needs.
Concept 3 - Jails to be removed from the Courthouse and
X6 5 built on new site. Renovate 4th floor for
judicial and office space needs.
Concept 4 - Remove juvenile jail from concept 1, 2, or
3 and build new juvenile facility on College

oe� 'r After the presentations the committee was asked to voice
any suggestions or questions. The following are the members
input:
1. Befor the next meeting, come up with total dollar
figur, zd break down into tax dollars.
2. Has the m 'mum jail concept been explored?
3. The present i.l is inadequate and an outrage.
Consideration Would be to build a humane jail.
4. Look at the 20 -25 year program and what is best
for this County ani then address the cost.
5. The present Courthouse facility was outdated when
opened.

6. The people with special interests in certain areas
of the Courthouse should meet more often and spend
more time than the full committee on the problems.
7. Mail out a brief agenda of next meeting to the
committee.
8. The committee will only give information and
concept ideas but the final decision is up to the
Commissioners' Court.
9. Can you estimate the difference of inmate population
now as opposed to the opening of the jail? In 1968
there were from 12 -25 and now from 52 -60.
10. Talk with all employees in the County offices.
Possibly have an inmate as an ex- offico member of
the committee.
11. With the anticipated growth has any thought been
given to additional parking?
12. While the jail problem is important, the need is
great all through the Courthouse. The judiciary
wing, County Clerk, District Clerk have people
working in very unoperational conditions. Some
functions that are associated with the Courthouse
which are not essential to the complex should be
moved to allow additional space. if
13. The jail is not that bad and only need to meet
the standards. Then move on to allow more
space for other working areas.
14. The committee should make a motion to eliminate
Concept 1.
15. Would it be feasible to add on to the building
with a new structure? Give some thought to a
Regional jail.
16. Many excellent ideas have been presented, now
give each one some thought and come back and
address these items at the second meeting.
The County Judge closed the meeting and invited all
members to tour tie complex or come by during office hours
and take a look at space problems in each office.

An additional 41,675 square feet of

73,100 square feet will be needed
according to a report by the com-
missioners. The report was sent to
the Physical Facilities Advisory
Committee by commissioners and
will be discussed at a meeting of the
committee set for Monday night.
The meeting will be held at the
Brazos Center, 3232 Briarcrest Dr.,
at 7 p.m.
The courthouse and the annex
building, the old Bryan Hospital
diagonally across the street from the
courthouse, presently contain 67,757
square feet.
If all expansion needs are met, the
expansion would add 169 percent
more floor space for operation of
county government agencies.
At its first meeting May 2, the
committee was told by local ar-
chitect Jack Cumpton that four
possible concepts for expansion had
been arrived at to solve the space
problems. These were:
— Renovate the jail on the cour-
thouse's fourth floor, build ad-
ditional jail space on the third floor
and construct a new judicial and
office wing;
— Move the jail to an additional
downtown Bryan building and
renovate the fourth floor for
needed judical and office space;
— Build a new jail on another site
and renovate the fourth floor into
judicial and office space;
— Build a juvenile detention
facility on College Avenue property. -
More space for the jail and the
courts are the most pressing needs.
For the jail and supporting
facilities, 4,800 more square feet is
needed now, 16,000 more in 10 years
and another 8,000 in 20 years, the
committee was advised in a letter
from the Commissioners Court
dated Thursday.
The sheriff's department, which
runs the jail, needs 1,500 more
square feet now, another 1,000 in 10
years and 2,000 more in 20 years.
For the judicial branch of t
government, 3,800 more square feet
is needed now for the 272nd District
Court, 1,225 for the 85th District
Court and 300 for the county Court
at -Law, plus 4,000 for a future
district courtroom and supporting
offices.
Still more space will be needed 10
and 20 years hence.
Costs for those expansion needs
are slated to be presented and
discussed at Monday's meeting.

Judge Holmgreen opened the meeting and reviewed the charge
of the committee. He announced that he had selected Dr. E. E.
Burns to act as moderator - chairman.
Dr. Burns requested that comments from the first meeting
be reviewed and turned the meeting over to Jack Cumpton,
Architect, requesting him to briefly review his presentation
at the first meeting.
After reviewing the first meeting Mr. Cumpton moved on
to the presentation of space needs for the Courthouse and
jail for a ten (10) and twenty (20) year span. These needs
were derived from questionnaires completed by elected officials
and department heads.
Mr. Cumpton continued to present five (5) different
concepts of construction and cost of each concept. A Juvenile
Detention Facility Study was presented showing a cost of
$482,102 for a total complex including the Juvenile Probation
Department or $359,822 for a maximum'security unit only. A
copy of the .five concepts and costs are enclosed for further
review.
After the presentations the following comments were made:
1. Were the department heads required to justify their
space needs on the questionnaire or were they just
accepted and incorporated into the total need?
2. Has there been consideration given to future use of
the existing Courthouse complex if a new complex is
constructed?
3. Does concept 4 and 5 deal with a juvenile facility
being built with the jail?
4. Why was consideration given to housing juveniles in
the same building as adult prisoners?
5. What is presently housed in the Courthouse annex?
6. In using the annex would there be new jail construc-
tion?
7. By utilizing all of annex space, and building up 4
floors over existing structures could all offices
and jail be contained on the one block?

8. How much is the cost of construction of a parking garage?
Most counties do not furnish parking garages.
9. What happens to the Health Unith and County Agents if a
new jail is built at the annex?
10. What balloon and cushion has been figured into the jail
construction that could possibly come out?
11. Are there figures available for remodeling present jail
to make it comply to standards? Could they be presented?
12. Is there a difference between need and quality in figuring
the jail costs? Do the cost figures presented meet the
State Standards and no more?
13. Are we ready to discuss the tax amount needed to retire
construction cost?
14. Has any significant effort been made to find additional
office space for offices that do not need to be in the
Courthouse complex? Perhaps the committee should address
itself to what could be gained by finding a building to
use for housing various offices.

15. Has consideration been given to using the parking lot
south of the Courthouse as a sight for a new jail.
16. Is the parking areas as presented for employees and public
use to the Courthouse?
17. Would there be a charge for using the parking facility?
It was expressed that the county should not have a
parking facility that would not pay for itself.
18. If a ne Aid"county were to be selected for all facilities,
how much realize out of the existing building?
19. Has the county looked at any building, if so which ones
and for what use? Were they suitable or not?
20. A lot of work and preparation has gone into all concepts
presented. All concepts will cost around $10,000,000.
Can you show the committee something that costs less
that the county could get along with?
21. There are a number of offices, about 35 or 40 per cent,
that can be moved away from the present Courthouse complex
and that other buildings could be located to house these
offices.
22. Is it a possibility that the Varisco Building, or some
other building in the community could be remodeled to
house the jail?
23. How much room in the present Courthouse would it take to
bring the jail up to standards and allow for expansion?
24. If existing building were located away from the present
Courthouse complex to house various offices it would
aleviate part of the parking problem.
25. If the top three floors of the Courthouse were remodeled
to accomodate the jail, could this be done for less than
new construction of a jail ($175.00 sq. ft.)?
26. Could there be another concept using existing buildings
with lesser costs?

27. Has consideration been given to the Eagle building?
28. In all concepts is the juvenile facility and juvenile
probation offices on a separate site?
29. Would it cost less to renovate the existing building and
add on new construction than it would to totally construct
a new facility?
30. Has thought been given to building over the area where
the Treasurer and Auditor is housed to build on to the
jail and construct a Court complex?
31. Has thought been given to administrative costs while
remodeling the jail?
32. Is it a possibility that the City of Bryan could be
users or purchasers of the Courthouse complex? If this
is a possibility it would relieve the cost of Concept 5.
Would the Court consider approaching the City of Bryan
on this matter?
33. In dealing with the financing of any one of the concepts,
what would the taxpayer have to bare? What would the
taxpayer's amount be based on, a special tax or re- evalua-
tion?
Judge Holmgreen gave the following example as an
approximate cost to taxpayers based on a Bond indebted-
ness of $10,000,000 over a 20 year period:
A $50,000 house, at present evaluation total tax
dollars for the year would be $150.00. This figure
would include the present $.95 tax rate, $.04 road
bond indebtedness tax rate and $.51 bond rate for
new facility.
Please note that this is not a firm or accurate figure as
many factors are involved in determining the amount.
34. What is the county's present bond indebtedness?
35. It is fairly clear that the cost of the jail is basicly
the same, whether you remodel the present one and add
on to it, or construct a new facility. Possibly the
committee and Court could study areas that would cost
less to construct or remodel for office space.
36. The entire District Clerk's Office need not be adjacent
to the District Courts. A clerk is assigned to the
respective Courts and the support staff could be housed
away from the courtroom.
37. A multi -story parking garage is out of the question for
Brazos County.
38. In pursuing the concept of staying with a governmental
complex, the Irt might study the area of eminent domain
for a parking a.
39. Will the archite(_ and Court come up with another concept,
such as looking into areas for additional office spaces,
and present the figures to the committee at the next
meeting?
At this time Dr. Burns as, for any further comments or
ideas.

The suggestion was made that the figures on all concepts
be checked or the concepts be refigured and try to come up
with a figure less than $10,000,000 because a bond issue in
that amount might not pass. The opinion was expressed that a
sizeable bond issue would experience real opposition.
The Judge was asked if a copy of all concepts and any
additional concepts could be mailed to the committee members
early enough to give them sufficient time to study them before
the next meeting.
Dr. Burns adjourned the meeting, stating that the committee
would meet again in early July, the date to be announced.

Judge Holmgreen opened the meeting and turned the meeting
over to Dr. E. E. Burns, moderator - chairman.
Dr. Burns reminded the committee members that they were
only making a recommendation to the Commissioners' Court. He
advised the committee that a vote would be taken to rank the
concepts in the most favorable order and at the next meeting
the top three (3) concepts would be discussed thoroughly. Dr.
Burns then turned the meeting over to Jack Cumpton to review
all concepts.
Jack Cumpton reviewed the six (6) concepts and answered
all questions. The committee then recessed for coffee.

about the

QUESTION: Why is bond election necessary?
ANSWER: For two reasons:
(1) bringing the county jail facilities up to mandatory state
jail standards and compliance. (This cannot be ignored.)
(2) relieving the crowded and inefficient conditions in the
existing 25 year old structure which houses all of the tax
and revenue offices, all of the county and district court
systems, jail and sheriff's departments and many other
services provided by the county.
QUESTION: Why are we voting on two propositions?
ANSWER: Under state law two separate bond issues are required on the
ballot to satisfy the needs of the county. The law requires
that money needed for renovation and expansion of an existing
facility be separated by purpose from monies needed to acquire
other sites, buildings, equipment, etc. By law, the respective
monies cannot be shifted or used from one fund to the other.
QUESTION: What happens if bond election fails?
ANSWER: The county does not have funds to comply with the state jail
standards. Compliance is mandatory. The state can take over
control of the county's jail and force revenues to be used for
jail compliance improvements or force the county to transport
prisoners to another county whose jail is in compliance (pro-
vided willing county could be found).
Another method of financing the needed improvements would be
the issuance of time warrants which the County Commissioners
Court is, by law empowered to do. These warrants, to be paid
with taxpayers' monies, would bear a higher interest rate than
bonds.
QUESTION: What will it cost me in the way of taxes?
ANSWER: Financial advisors to the county believe that the bonds' issu-
ance would add negligible cost to taxpayers. (No more than
five cents per $100 valuation in additional taxes on property
in the county.) This optimism is based on the new industrial
complexes in the county which will go on the 1981 tax rolls to
provide additional revenues which would keep the tax increase
to a minimum.
QUESTION: Are there any other alternative methods of accomplishing these
needs?
ANSWER: These alternatives were explored by a 50 member Physical Fa-
cilities Advisory Committee made up of a cross section of lead-
ing citizens in the community. They were appointed by the
Brazos County Commissioners Court. Nine alternatives were
proposed and considered. The alternative that is proposed by
the committee for the bond election seemed to be the best so-
lution to the problem both from an economic standpoint and
most for the effective use of the existing physical facilities.
QUESTION: When does work on project begin if bond election passes?
ANSWER: Architects, engineers, and jail consultants have been retained,
and preparation of plans and specifications for the construction
of the project will begin immediately. The county must begin
to show compliance on the jail standards within one year. An-
other factor is construction cost rise due to inflation. Each
month this rise has been averaging better than one percent or
about thirteen percent for last year.

There are two separate propositions because the State law requires
two separate bond issues be on the ballot. One law requires bond issue
money be used only on the existing courthouse; the other requires bond
issue money be used to acquire additional land and buildings. The mon-
ies cannot be used interchangeably and both propositions must pass to
provide needed monies for the 20 year program.

ty, Texas, be authorized to issue bonds in the
amount of $8,600,000 for the purpose of con-
structing additions and improvements to the ex-
isting courthouse and jail building, and to levy
taxes upon all taxable property within said county
sufficient to pay the interest and principal of said
bonds as it matures?
Shall the Commissioners Court of Brazos Coun-
ty, Texas, be authorized to issue bonds in the
amount of $1,400,000 for the purpose of purchas-
ing, constructing, reconstructing, remodeling, im-
proving and equipping an office building or
buildings, or courts building or buildings, or jail
building or buildings (in addition to the existing
courthouse and /or jail), including the purchasing
and improving of the site or sites for any of such
buildings, and to levy taxes upon all taxable prop-
erty within said county sufficient to pay the inter-
est and principal of said bonds as it matures?
Why add to and remodel
the Brazos County Jail
and Courthouse?
The present jail and courthouse were designed
and constructed in 1955 and was planned for a
20 year anticipated growth. In the 25 years since
our jail and courthouse were conceived, the
county has grown tremendously and county gov-
ernment has far exceeded the initial space allo-
cations of 1955. The following brief review of
present conditions leading up to this bond issue
are recorded for your review and hopefully your
support.
JAIL
The 64th Texas Legislature in 1975 requires
county jails to meet stringent, minimum stand-
ards. Our county jail must meet these standards
and be approved by the Texas Jail Standards
Commission. Minimum standards incorporate
these specifics:
(1) the quality of construction, equipment,
maintenance and operation,
(2) the custody, care and treatment of
prisoners,
(3) the number of jail supervising personnel
and services to meet the needs of pris-
oners and,
(4) programs, rehabilitation, education and
recreation in county jails.
Our jail has had three annual reviews by the
Texas Commission on Jail Standards. Each time
it has failed to meet a number of major physical
facility requirements. Following the most recent
jail inspection, Brazos County was put on notice
by the Jail Commission that unless our jail is
brought into compliance within one statutory year
that they will issue a Remedial Order, remedying
the situation by an appropriate means such as
transferring all or some classes of prisoners, for-
bidding the housing of all or some prisoners,
or even closing our jail.
Our existing jail located on the fourth floor of
the courthouse has remained virtually as con-
structed in 1955. It houses 69 juveniles and
adults. To bring the jail into compliance will re-
quire the present 69 person population be re-
duced to approximately 35 as a result of the
standards for space allocation per inmate.
The rapid growth of Brazos County, the in-
creasing crime rate, the need for a juvenile jail
physically separated from the adult jail, the need
for a 20 -year master jail and sheriff's department
plan, additional offices and support facilities, all
urge us to make major modification and additions
to our county jail facilities.
COURTS
The 66th Texas Legislature in 1979 established
the 272nd District Court and required Brazos
County to provide space for the operation of this
court and its related activities.
Our courthouse does not have space to ade-
quately house the 272nd Court. The population
growth in Brazos County and the backlog of Dis-
trict Court cases will require that third court to
be added probably during the next legislative
session and a fourth court within 10 years.
The one County Court at Law facility now exist-
ing is grossly inadequate for the county's re-
quirements and an additional court is most de-
sirable. Prudent planning dictates that a third
county criminal court will be needed within 10
years.
Offices housed in the courthouse which work
directly with our court system are in dire need of
expansion and modifications. The District Clerk
and staff operate out of space which is approxi-
mately 1 /3 the prescribed size. The District At-
torney and his staff are housed in space 1 /2 the
size needed to properly administer their case
load. The Grand Jury, County Attorney, Consta-
ble, District and Criminal Court Judges, Court
Coordinator, jury rooms, and numerous other
judicial related operations need larger and better
planned facilities.
COUNTY OPERATIONS AND SERVICE
A number of county business and service oper-
ations such as the Tax Office, Treasurer, Auditor,
Civil Defense, County Clerk, Veterans Services
and Health Unit operate in space far undersized
for their present operation and cannot expand to
meet the ever expanding demands of our county.

Since some time has elapsed since our last meeting, I feel
You should be advised of the developments to the present time.
The Commissioners' Court accepted the recommendation of the
committee as to location and scope of the remodeling of the
courthouse. We have arrived at a tentative idea as to the
best method of solving our problems. Our plan is to purchase
the west half of the block north of the courthouse. We plan
to remodel the Western Auto building into the Tax office and
use the remainder of the block as parking area. We will
remodel the top floor of the Annex, old Bryan Hospital build-
ing, and use this for office space.
A wing will be added to the northwest corner of the present
building which will incorporate the Auditors office and
Deputy Sheriff's office into the addition. This wing will
be four (4) stories high and the Jail addition will be on
the fourth floor.
I am enclosing a copy of the actual call for election. You
will see there are two (2) propositions. It was necessary
because of the laws regarding bond issues. One law allows
us to remodel or add to the courthouse, but will not allow
us to buy additional property or remodel other buildings.
The second law works just opposite. We can not remodel the
courthouse but can acquire additional areas. If there are

I might add that the additional taxes required to fund this
