AGENDA ITEM NO. 1: Call to order.
Chairman Nichols called the meeting to order at 11:05 AM
AGENDA ITEM NO. 2: Consideration, discussion and possible action on absence
request. Ward Wells
Chairman Nichols motioned to approve the absence request. Hunter Goodwin seconded the
motion; which passed unopposed (4-0).
AGENDA ITEM NO. 3: Consideration, discussion and possible action to approve
meeting minutes for March 9, 2010.
Katy Jackson motioned to approve the meeting minutes. The motion was seconded by Jason
Kinnard and passed (4-0).
Chairman Nichols asked the Commission and staff if the agenda items no. 4 and no.5 could
be switched since the applicant was present for no. 5. Commission and staff agreed to switch
the items.

Alan King arrived at the meeting during the discussion of Agenda item no. 4
AGENDA ITEM NO. 4: Presentation, possible action, and discussion on waivers to
the requirement for sidewalk width, street trees, and street benches in the Northgate
zoning district for Aquarium Bar, located at 209 University Drive. Case 408-00500162
(LH)
Staff Planner Lauren Hovde presented the staff report stating that the UDO Section
5.6.B.8.b.1 requires a minimum 12-foot sidewalk along University Drive. The portion of
sidewalk within the subject property ranges from eight to ten-foot wide. The existing
sidewalk is constrained between the building's front facade wall and the TxDOT right-of-
way, which contains metered parallel parking spaces. The applicant is requesting a waiver to
the required widening of the sidewalk based on these constraints.
Alan King motioned to give a waiver to the trees and bench requirements due to the width of
the existing sidewalk and the nature of the pedestrian and vehicular traffic on University
Drive. As an alternate, the planter under the existing window as well as planters or plantings
on the second floor balcony on both University Drive and the facade of the building that
wraps to the East, must be improved with plantings appropriate for the exposures. Katy
Jackson seconded the motion which passed (5-0).
AGENDA ITEM NO.5: Presentation, possible action, and discussion on a sign
package for Tutta Pasta at The Lofts at Wolf Pen Creek, located at 614 Holleman Drive
East, in the Wolf Pen Creek District. Case 410-00500102 (LH)
Staff Planner Lauren Hovde presented the staff report, stating that the sign was in compliance
with the ordinance and that staff was recommending approval.
There being no discussion, Alan King motioned to approve the item as submitted, Katy
Jackson seconded the motion which passed (4-0), with Jason Kinnard abstaining from voting
because of a business relationship with the owner.

ITEM SUMMARY: The applicant is requesting to implement a color scheme for
each of the facades using colors that are not on the City's approved color palette.

ITEM BACKGROUND: Whataburger is proposing to construct a new
freestanding structure near the intersection of William D. Fitch Parkway and the
State Highway 6 South Frontage Road. When constructed, the new structure will
be part of a building plot that has more than 150,000 gross square feet of floor
area. Section 7.9.f.5 of the Unified Development Ordinance requires that when a
building is part of a building plot with a gross area of 150,000 square feet or
more, that accent colors may be used on no more than 5% of the fagade on
which the accent color is applied. Accent colors are those not included on the
approved color palette.
This site is also located in the Overlay District, which requires that all building
colors be neutral and harmonious with the existing man-made or natural
environment and states that only compatible accent colors be used. The paint
colors for the proposed Whataburger do not match any colors that are currently
utilized on the existing commercial development. However, the color and type of
brick proposed for the new structure will match what is currently used on the
building already developed in this building plot.
The requested color scheme is a part of the Whataburger corporate brand and
has been used at other locations throughout Texas and in College Station (color
palette will be available at the meeting for review).
STAFF RECOMMENDATION: Staff recommends denial of the applicant's
request to implement a color scheme using colors that are not on the City of
College Station's approved color palette. The approved color palette includes
several color options that are very similar to the colors being requested by the
applicant.

ISSUES / ITEMS FOR REVIEW: Section 7.9 of the Unified Development
Ordinance requires that "all building facades and roof shall consist of only colors
from the color palette approved by the City Council as amended by the Design
Review Board." The Design Review Board may grant a variance for these
standards of up to one hundred percent (100%) to allow alternate colors and
materials on each fagade if the applicant shows that:
a. The applicant is a franchised and/or chain restaurant to be developed as a
single detached building (not integrated into a multi-tenant building); and
b. The proposed colors/materials are part of its corporate branding; and
c. The applicant provides all of the alternative color/materials schemes the
chain has used.
Color samples will be provided at the meeting for the Design Review Board to
review.

The use of the Whataburger brand-specific orange and white (roof and accent colors) along with the maroon accent
stripe on the roof contributing to the A&M University recognition throughout the City of College Station..
2. The unnecessary hardship(s) involved by meeting the provisions of the ordinance other than financial hardship
is/are:
The use of a color other than the prototypical Whataburger colors would deviate from any other store they have
developed in the history of the company. The colors proposed do not vary in extreme hues from the City approved
palette but Whataburger feels that it could hinder the brand recognition that they have worked very diligently to keep
throughout their development.
3. The following alternatives to the requested appeal/waiver are
