AN ORDINANCE VACATING A PORTION OF A TEN (10) FOOT WIDE UTILITY
EASEMENT, POOH'S PARK SECTION 1, LOT 1, BLOCK 4, GRANTED BY DON DALE,.
IN THE CITY OF COLLEGE STATION, DATED NOVEMBER 3, 1977, RECORDED
IN VOLUME 384, PAGE 867, DEED RECORDS OF BRAZOS COUNTY, TEXAS.
Said utility easement being more particularly described as follows:
BEING a two and one -half (2 112) foot wide strip on the south side of
the 10 ft. utility easement on the north side of Lot 1, Block 4 of
Pooh's Park Section 1 and running the length of the lot.
BE IT ORDAINED by the City Council of the City of College Station, Texas
that:
WHEREAS, it has come to the attention of the City Council of the City of
College Station that there is a twenty foot easement for utilities
reserved from the developer to the City of College Station; and
WHEREAS, said ten foot portion of easement is not needed and will not be
needed in the future;
WHEREAS, the present property owner is desirous`of adding said easement
to his present lots, from which it was taken;
+' IT IS THEREFORE ORDERED AND ORDAINED that such easement be vacated and
that the Mayor and City Secretary be authorized to release on behalf
of the City of College Station any right or claim which the City has in and
to said easement.
PASSED AND APPROVED this the 13th day of May 1382.
