AN ORDINANCE REZONING 73.03 ACRES OF A 193.49 ACRE TRACT OF LAND LYING AND BEING
SITUATED IN THE THOMAS CARUTHERS SURVEY, ABSTRACT 9, IN COLLEGE STATION, BRAZOS
COUNTY, TEXAS, AS RECORDED IN VOLUME 469, PAGE 697; VOLUME 491, PAGE 229; AND VOLUME
469, PAGE 426, OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS AND BEING MORE FULLY
DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM AGRICULTURAL -OPEN
SPACE DISTRICT A -0 AND TOWHNHOUSE- ROWHOUSE DISTRICT R -3 TO SINGLE FAMILY RESIDENTIAL
DISTRICT R -1 AND PLANNED COb1MERCIAL C -3.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS:
WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on
Thursday, January 28, 1982 on the question of rezoning certain areas within the city
limits;
AND, WHEREAS, the City Council has determined the following:
To rezone or change the classification of the following three (3) tracts of land all
lying and being situated in the Thomas Caruthers Survey in College Station, Brazos
County, Texas and being more fully described by metes and bounds as follows:
TRACT NO. 1:
Being a 48.42 acre tract or parcel of land lying and being situated in the Thomas
Caruthers Survey, Abstract 9, Brazos County, Texas and being a portion of the following
tracts;
(1) A 79.00 acre tract conveyed to Cornerstone Investment Group by Raintree
Development Joint Venture by deed recorded in Volume 469, page 697 of the Deed Records
of Brazos County, Texas;
(2) A 26.07 acre tract conveyed to Cornerstone Investment Group by East Bypass
Development Group by deed recorded in Volume 491, page 229 of the Deed Records of
Brazos County, Texas;
(3) An 88.43 acre tract conveyed to Cornerstone Investment Group by Edward Uvacek,
Jr. et ux by deed recorded in Volume 469, page 426 of the Deed Records of Brazos County,
Texas;
Said 48.42 acre tract being more particularly described by metes and bounds as
follows:
BEGINNING at the south corner of Lot 13, Block 6, Foxfire Phase 2 an addition to
Brazos County, Texas;
THENCE N 44 56' 17" E along the southeast lines of Lot 13, Lot 14, Block 6,
Foxfire Phase 2, across Foxfire Drive and along the southeast line of Lot 1, Lot 3,
and a portion of Lot 4, all in Block 7, Foxfire Phase 2 for a total distance of 998.94
feet to an iron rod for corner;
THENCE S 45 00' 14" E along the southwest line of Lot 10 and Lot 11, Block 7,
Foxfire Phase 2 for a distance of 573.00 feet to a point for corner;
THENCE along the centerline meanders of a existing creek for the following calls;
S 22 49' 10" E for a distance of 614.70 feet; 10��

S 11 00' 00" W for a distance of 310.00 feet;
S 23 00' 00" W for a distance of 394.00 feet;
S 01 00' 00" W for a distance of 60.00 feet;
THENCE S 37 59' 24" E for a distance of 30.00 feet to the center of a proposed
street right -of -way and lying on a curve concave to the northwest;
THENCE southwesterly along said curve for an arc distance of 952.02 feet to the
end of said curve, (Curve Data: Central Angle = 28 24'35 ", Radius = 1920.00 feet,
Tangent = 486.01 feet, the chord bears S 66 12' 54" W for a distance of 942.30 feet);
THENCE S 80 25' 11" W continuing along the centerline of the proposed street
right -of -way for a distance of 313.78 feet to a point for corner;
THENCE N 09 34' 49" W for a distance of 268.04 feet to a point for angle point;
THENCE N 03 23' 01" W for a distance of 819.00 feet to a point for corner;
THENCE N 86 36' 59" E for a distance of 285.00 feet to a point for corner;
THENCE N 03 23' 01" W for a distance of 165.00 feet to a point for angle point;
THENCE N 41 38' 25" W for a distance of 246.31 feet to the PLACE OF BEGINNING
and containing 48.42 acres of land more or less from Agricultural -Open Space District
A -0 and Townhouse - Rowhouse District R -3 to Single Family Residential District R -1.
TRACT NO. 2:
Being a 21.60 acre tract or parcel of land lying and being situated in the Thomas
Caruthers Survey, Abstract 9, Brazos County, Texas and being a portion of a 79.00 acre
tract conveyed to Cornerstone Investment Group by Raintree Development Joint Venture by
deed recorded in Volume 469, page 697 of the Deed Records of Brazos County, Texas and
being a portion of a 26.07 acre tract conveyed to Cornerstone Investment Group by East
Bypass Development Group by deed recorded in Volume 491, page 229 of the Deed Records
of Brazos County, Texas; said 21.60 acre tract being more particularly described by
metes and bounds as follows:
BEGINNING at the east corner of the aforementioned 79.00 acre tract, same lying
on the southwest perimeter line of Foxfire Phase 2, an addition to Brazos County;
THENCE S 44 16' 47" W along the southeast line of the said 79.00 acre tract - for
a distance of 1430.40 feet to the south corner to the aforesaid 79.00 acre tract, same
being the east corner of the aforementioned 26.07 acre tract;
THENCE S 44 07' 30" W along the southeast line of the said 26.07 acre tract for
a distance of 260.00 feet to a point for corner;
THENCE N 05 00' 00" E for a distance of 382.00 feet to a point for corner;
THENCE N 08 30' 00" W for a distance of 389.00 feet to a point for corner;
THENCE N 10 00' 00" E for a distance of 323.42 feet to a point on a curve concave
to the northwest and being on the centerline of a proposed street;
THENCE northeasterly along said curve and centerline of proposed street for an arc
distance of 235.04 feet to the end of said curve, (Curve Data: Central Angle = 07° 00'
50 ", Radius = 1920.00 feet, Tangent = 117.67 feet, the chord bears N 48° 30' 1- j "_F..for

a distance of 234.89 feet);

THENCE N 44 59' 46" E continuing along the centerline of a proposed street for a
distance of 666.81 feet to a point on the said southwest line of Foxfire Phase 2, and
the northeast line of the said 79.00 acre tract; said point also bisecting the right -
of -way of Faulkner Drive in said Foxfire Phase 2;
THENCE S 45 00' 14" E along the common line between the said 79.00 acre tract
and Foxfire Phase 2 for a distance of 707.49 feet to the PLACE OF BEGINNING and con-
taining 21.60 acres of land more or less from Agricultural -Open Space District A -0
to Single Family Residential District R -1.
TRACT NO. 3:
Being a 3.01 acre tract or parcel of land lying and being situated in the Thomas
Caruthers Survey, Abstract 9, Brazos County, Texas and being a portion of an 88.43 acre
tract conveyed to Cornerstone Investment Group by Edward Uvacek, Jr. et ux by deed
recorded in Volume 469, page 426 of the Deed Records of Brazos County, Texas, said 3.01
acre tract being more particularly described by metes and bounds as follows:
BEGINNING at the south corner of the aforementioned 73.43 acre tract, same also
lying on the centerline of Rock Prairie Road;
THENCE N 84 Ol' 20" W along the centerline of Rock Prairie Road for a distance of
373.41 feet to a point for corner;
THENCE N 12 38' 08" W for a distance of 329.63 feet to an iron rod for corner;
THENCE S 84 07' 03" E for a distance of 294.28 feet to a point for corner;
THENCE S 05 52' 57" W for a distance of 85.00 feet to a point for corner;
THENCE S 84 07' 03" E for a distance of 304.22 feet to a point on the southeast
line of the said 73.43 acre tract;
THENCE S 33 41' 57" W along said southeast line of the said 73.43 acre tract for
a distance of 258.00 feet to the PLACE OF BEGINNING and containing 3.01 acres of land
more or less from Townhouse - Rowhouse District R -3 to 'Planned Commercial C -3.
And, it is ordained that said changes shall become effective immediately.
