Home My WebLink About1982-1395 - Ordinance - 12/08/1982ORDINANCE NO. 1395 AN ORDINANCE AUTHORIZING THE EMPLOYMENT OF THE LAW FIRM OF SEARS AND BURNS TO REPRESENT THE CITY IN SUIT PENDING IN FEDERAL COURT; APPROV- ING FORM OF CONTRACT BETWEEN CITY AND SUCH LAW FIRM; MAKING CERTAIN FINDINGS WITH RESPECT THERETO: AND PROVIDING AN IMMEDIATE EFFECTIVE DATE. WHEREAS, the City of College Station has been sued in Civil Action No. H -81 -2295 in United States District Court for the Southern District of Texas, Houston Division in the case styled: Robert C. Carroll, et al., v. City of College Station, et al., wherein present and former officers of the City of College Station have been sued as Defendants because of acts allegedly growing out of the duties of their employment in the enforcement of the laws; and, WHEREAS, the law firm of Sears and Burns fo Houston, Texas, has at the special instance and request of the City of College Station, under- taken the defense of such City on the terms hereinafter set forth; THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: Section 1. That the law firm of Sears and Burns of Houston, Texas be and such firm is hereby employed by the City of College Station to represent the City in the suit above described. Section 2. The City Council hereby approves the Contract of Employment between the City of College Station and the law firm of Sears and Burns, approved by the City Attorney, which Contract has been exhibited to Council prior the the passage of this ordinance, and hereby authorized the City Manager to execute such Contract for and on behalf of the City of College Station. 03T7'7 Ordinance No. 1395 Section 3. The City Council finds that all provisions of the Open Meetings Law of the State of Texas have been complied with, prior to the passage hereof; and that proper appropriation of current funds to cover the City's obligations hereunder exists and has been made.
