AN ORDINANCE VACATING AN EASEMENT IN THE RICHARD CARTER LEAGUE OF BRAZOS COUNTY,
TEXAS, WITHIN THE CITY OF COLLEGE STATION, TEXAS.
Said easement being more particularly described as follows:
All that certain strip, tract or parcel of land lying and being situated
in the Richard Carter League of Brazos County, Texas, and being out of the
subdivision formerly known as the D.A. Smith Subdivision of a 69 acre tract
of said League and recorded in Volume 49, page 105, of the Deed Records,
Brazos County, Texas, said plat having been abandoned and vacated,
said strip of land being more particularly described as follows:
BEGINNING at a point N 45° W 40 feet from the beginning corner of the tract
conveyed in deed recorded in Volume 136, page 28, executed by G.E. Potter
et ux to P.F. Sousares, and State Highway No. 6;
THENCE N 45° W 10 feet and corner a stake in said line;
THENCE N 45° E 160 feet to stake for corner;
THENCE S 45° E 10 feet to stake for corner;
THENCE S 45 W 160 feet to the place of BEGINNING:
said strip of land having been dedicated as a roadway for the public in deed
fron J.C. Culpepper to C.P. Clayton, dated August 31, 1946, recorded in
Volume 130, Page 497, Deed Records, Brazos County, Texas.
BE IT ORDAINED by the City Council of the City of College Station, Texas, that;
WHEREAS, it has come to the attention of the City Council of the City of College
Station that there is an easement dedicated to the public within the City
of College Station; and in a deed from J.C. Culpepper to C.P. Clayton, dated
August 31, 1946, and recorded in Vol. 130, Page 497 of the Deed of Records
of Brazos County Texas.
WHEREAS, said easement is not needed, has not been used for a period of years,
and will not be needed in the future for use as a public street or access
way; and;
IT IS THEREFORE ORDERED AND ORDAINED that such easement be vacated and abandoned;
that the Mayor and City Secretary be authorized to release on behalf of the
City of College Station any right or claim to use such easement for street or
public access purposes which the City has in and to said easement, but retain-
ing any other existing easements or right of way therein for public utilities.
