HomeMy WebLinkAbout1981-1316 - Ordinance - 08/27/1981ORDINANCE NO. 1316 AN ORDINANCE AMENDING CHPATER 4, SECTION 10 -H OF THE CODE OF ORDINANCES, CITY OF COLLEGE STATION RELATING TO WRECKER FEES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: THAT CHAPTER 4, SECTION 10 -H OF THE CODE OF ORDINANCES, CITY OF COLLEGE STATION IS HEREBY AMENDED TO READ AS FOLLOWS: 1. H. FEES TO BE CHARGED BY PERMIT HOLDERS The standard fee which shall be charged by permit holders shall be in an amount which is sufficient to compensate the wrecker company for its service. The amount of a fee for any particular type of tow may be set by the City Council be resolution, after public hearing. The City Secretary shall publish a notice in a newspaper of general circulation at least ten days before such hearing setting forth the date, time, and type of tows for which a fee is proposed to be set. The council may complet the attendance of witnesses and issue a subpoena duces tecum for any relevant financial records; any subpoena to be signed by the Mayor. This fee shall include taking the wrecked or disabled vehicle anywhere in the city limits of College Station or Bryan. 2. Should any section, paragraph, sentence, clause, phrase, or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. 3. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. 4. And, it is ordained that this ordinance shall become effective from and after its passage in accordance with the City Charter of the City of College Station.
