AN ORDINANCE VACATING A TWENTY-FIVE (25) FOOT WIDE UTILITY EASEMENT GRANTED BY
RAINTREE DEVELOPMENT JOINT VENTURE, IN THE CITY OF COLLEGE STATION, DATED NOVEMBER
4, 1977, RECORDED IN VOLUME 384, PAGE 509, DEED RECORDS OF BRAZOS COUNTY, TEXAS.

Said right-of-way easement being more particularly described as follows:
BEING a strip of land twenty-five (25) feet in width, and lying adjacent to
and running parallel with the following described line:
BEGINNING at the south corner of a 112.11 acre tract conveyed to RainTree
Development Joint Venture in Volume 367, Page 61 of the Deed Records of Brazos
County, Texas, said corner also being the east corner of the Glynn A. Williams
tract described in Volume 252, Page 445 of the Deed Records of Brazos County,
Texas;
THENCE N 42009'33" E along the common line between the aforesaid 112.11 acre
tract and a tract of land conveyed to Clement A. Fojtik and recorded in Volume
247, Page 657 of the Deed Records of Brazos County, Texas, for a distance of
886.43 feet to a point for angle point;
THENCE N 41014'32" E for a distance of 235+ feet to the point of intersection
with an existing electrical line easement to the City of College Station, Texas,
for end of said easement.
BE IT ORDAINED by the City Council of the City of College Station, Texas
that:
WHEREAS, it has come to the attention of the City Council of the City of
College Station that there is a twenty-five foot easement for utilities
reserved from the developer to the City of College Station; and
WHEREAS, said easement is not needed and will not be needed in the future;
and
WHEREAS, the present property owner is desirous of adding said easement to
his present lots, from which it was taken;
IT IS THEREFORE ORDERED AND ORDAINED that such easement be vacated and that
the Mayor and City Secretary be authorized to release on behalf of the City
of College Station any right or claim which the City has in and to said
easement.
