HomeMy WebLinkAbout1977-1065 - Ordinance - 01/27/1977ORDINANCE NO. 1065 AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 850 AND ORDINANCE NO. 996, REQUIRING A CONDITIONAL USE PERMIT FOR MULTI -FAMILY RESIDENTIAL DEVELOPMENT IN R-3, R-4, R-6, R-7, C-1 AND C ZONES AND ESTABLISHING A PROCESS FOR CONSIDERATION OF THESE PROPOSALS. WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on Thursday, D cember 9, 1976 on the question of amending the Zoning Ordinance No. 850; AND, WHEREAS, the City Council has determined to amend Ordinance No. 850; THEREFORE, BE ITT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: The Zoning Ordi ance No. 850 is hereby amended to read as follows: 5-F DISTRICT R 3 - APARTMENT BUILDINGS: 5-F.1. PURPOSE: This district contains land used for a variety of housing types, primaril7 multiple family dwellings. This district is designed to provide the widest rang of housing types as well as the highest density in the community. Par icular emphasis is placed on the residential development of types most appr priate to satisfy the housing demand generated by Texas A&M University. 5-F.2. PERMITTED USES: Single Eamily dwellings, built under the zoning restrictions of District R-1 Duplex iwelling units, built under the zoning restrictions ,, of District R-2 Home oc upations Parking lots for operating vehicles Rooming houses -Boardink houses 5-F.3. CONDITIONAL USES: Refer to Section 6-L Refer to Section 5-F.3., Fraternity or sorority meeting place, as amended by Ordinance No. 1019 Apartment buildings Dormitories Townhou a dwelling units, built under the zoning restrictions of District R-4 5-F.3.A. PURPOSE: The purposes of this section shall be to: 1. Encour ge a more efficient use of land. 2. Reflec changes in the technology of land development so that r sulting economies may inure to the benefit of those who ne d shelter. 3. Lessen the burden of traffic on streets and highways. 4. Provide common open space for the utilization of the district's residents. 5. Encourage efficient use of land resulting in smaller networks of utilities and streets and thereby lowering development and mainte ance costs. 6. Provid a procedure which can relate the type, design and layout of residential development to the res ective i't 10d' p s e an !ln �'1rp ORDINANCE NO. 1065 Page 2 the particular demand for housing and other facilities at the time of development and in a manner consistent with the preservation of property values within established residential areas. 7. Provide for a more desirable environment than would be possible through the application of other sections of this Zoning Ordinance. 5-F.3. DEFINITIONS: For purpose of this section of the Zoning Ordinance, the following definitions shall apply: I. Applicant The individual seeking a conditional use permit under the provisions of this section of the Zoning Ordinance. 2. Common Open Space A parcel or parcels of land or an area of water or'a combination of land and water within the site for which a conditional use permit is sought. Said area is designed and intended for the use and enjoyment of residents of the proposed project. 3. Project Plan Drawings and related information illustrating the proposed multiple family residential complex as it pertains to the site for which the conditional use permit is sought. 4. Project Review Committee (PRC) A committee composed of the Director of Planning, the City Engineer, and the Chairman of the Planning and Zoning Commission, or his/her designated alternate. 5-F.3. CONDITIONAL USE PERMIT PROCEDURE: An Applicant shall contact the Department of Planning for an initial feasibility review discussion. The Director of Planning shall provide the Applicant with an appropriate application form and all necessary information for the Applicant to proceed. An Applicant shall file said application form with the Director of Planning. Said form shall be supplemented with a blueline or blackline print of the Project Plan, supportive materials and a legal description of the site for which the conditional use permit is sought. The Director of Planning shall notify the Applicant of the date, time and place for the preliminary review of the application by the Project Review Committee. The Project Review Committee shall hold a preliminary review within seven days of the filing of the application. The deliberations of the PRC shall be recorded and filed in the Office of the City Clerk. The PRC shall submit written recommendations to the Planning and Zoning Commission not less than three (3) days prior to the next regularly scheduled meeting of the Commission. Failure of the PRC to either hold said review or to submit the aforementioned recommendations within the prescribed period shall constitute approval of the Project Plan by the PRC. In submitting said recommendations, the Project Review Committee shall clearly indicate each reason in support of its approval or denial of the application. A copy of said report shall be sent to the Applicant. The PRC may recommend the imposition of needed additional conditions where said conditions are essential for the protection of the public health, safety and general welfare. The Planning and Zoning Commission shall hold a public hearing for the purpose of approving or denying the application for the conditional use permit. In holding said public hearing the Commission shall follow the procedure outlined in Sections 10-C.2.2 through 10-F of the City Zoning ORDINANCE NO. 1065 Page 3 Ordinance, except that the following appeal procedure, rather than 10-C.2.5, shall apply: The applicant or the owners of forty percent (40%) or more of the lots or land any part of which is immediately adjoining the subject property and extending two hundred (200) feet therefrom may appeal to the Council any determination (approval or disapproval) made by the P&Z Commission. 5-F.3. THE PROJECT PLAN: The following information shall be shown on the Project Plan: 1. The name, address and telephone number of the Applicant. 2. The date that the Project Plan was submitted to the PRC. 3. The name of the proposed project. 4. The names and addresses of adjoining property owners within two hundred (200) feet of the proposed project site. 5. A key map. 6. Topography and final grading plan. 7. All existing streets, drives, buildings and water courses. 8. The location and size of existing utilities within or adjacent to the proposed project site. r 9. The proposed location, type and size of the following: a. Buildings and structures b. Streets, drives and curb cuts c. Off-street parking areas with parking spaces individually drawn and counted d. Sidewalks e. Landscaping f. Common open space sites g. Sites for solid waste containers h. Signs 10. The total number of residential buildings and units to be constructed on the proposed project site. 11. The total number of bedrooms associated with the proposed project. 12. The density of dwelling units per acre as evidenced by the proposed project. The information requirements enumerated above shall be submitted to the Project Review Committee on a Project Plan Map drawn at a scale approved by the Director of Planning. Said map shall contain any additional information necessary for a complete understanding of the scope and nature of the proposed project. Upon approval of said Project Plan by the Planning and • Zoning Commission or the City Council, a permanent copy on mylar base material or other similar material shall be filed in the Office of the Planning Director. Said permanent copy shall be signed by the Chairman of the Planning and Zoning Commission and shall clearly indicate conditions which havd been imposed. ORDINANCE NO. 1065 Page 4 5-F.3. CONDITIONS FOR THE ISSUANCE OF A USE PERMIT: The following conditions shall be met prior to the issuance of a conditionaluse permit under the provisions of this section of the Zoning Ordinance; Parking The Project Plan shall contain at least one and one-half (1.5) off- street parking spaces for each bedroom included in the proposed project but in no event shall more than two (2) spaces per d.u. be required. Area Requirements In complying with the area requirements for the R-3, R-4, R-6, R-7, C-N, or C-1 Districts, the Applicant shall follow the regulations shown on Table A, Page 27, of the City Zoning Ordinance, subject to the following changes: Maximum lot coverage: Main and accessory buildings shall not cover more than forty percent (40%) of the lot area. Interior Streets, Drives, Utilities, Drainage and Sidewalks All interior streets, drives, utilities, drainage facilities and sidewalks shall be designed and constructed in accordance with accepted engineering practice. The City Engineer is hereby empowered to alter the provisions of the Section and Ordinance referred to above, where, owing to peculiar circumstances, the public health, safety, or general welfare of residents of the project would be imperilled in the absence of such alterations.
